About this file

This document is a Reseller Agreement template establishing participation requirements for authorized resellers under the Kentucky Department of Education (KDE) KETS Network Products and Services contract. The agreement is a tripartite arrangement among KDE, Original Equipment Manufacturers (OEMs), and authorized resellers to facilitate the distribution of network products and services to Kentucky K-12 public school districts through the KETS procurement framework. Resellers must execute this compliance form prior to participating in contract-related activities and must maintain current OEM authorization for all offered products and services. Resellers are required to demonstrate eligibility and good standing under the Federal E-Rate Program, comply with all FCC rules and USAC requirements, and immediately notify KDE and the OEM of any changes in E-Rate eligibility within five business days.

The agreement establishes specific operational requirements for reseller participation, including pricing compliance, quote validity periods, and mandatory OEM approval for all E-Rate minibid responses prior to submission. Resellers must meet or exceed minimum discounts off Manufacturer's Suggested Retail Price (MSRP) established by the OEM and ensure all pricing is contract-compliant, transparent, equitable, and auditable. Each reseller must designate a single point of contact for communications with KDE and maintain a dedicated email mailbox for E-Rate-related correspondence that is actively monitored and accessible to multiple authorized staff members. Resellers are required to assign specific personnel for E-Rate program support, technical support, sales and account management, and warranty services, and must maintain current knowledge of KETS contract details, the Kentucky public school customer base, the KETS Master Plan, and the Federal E-Rate Program. Non-compliance with the agreement may result in suspension or removal as an authorized reseller, disqualification from minibids, and other remedies available under the contract or applicable law.
