About this file

This is a Short Form Application for Details and Checklist issued by the Kentucky Department of Fish and Wildlife Resources (KDFWR) for the Ohio River Basin Invasive Carp Contract Fishing Program (RFB 660 2700000081). The program seeks to contract with qualified commercial fishers to harvest invasive carp species—including Silver Carp, Bighead Carp, Grass Carp, and Black Carp—from the Ohio River and its tributaries in Kentucky and adjacent waters. Applicants must hold a valid current commercial fishing license, maintain current boat registration from their state of residence, meet mandatory equipment standards, and possess a minimum of three years of commercial fishing experience with at least two years holding a valid commercial fishing license. Program participants are required to fish a minimum of four days per week (weather and river conditions permitting), maintain familiarity with invasive carp identification and targeting methods including gill netting and side-scan sonar technology, provide all necessary labor and equipment, and retain a helper for daily harvesting operations. Participants must submit professional itemized invoices weekly and allow KDFWR biologists and observers onboard during all fishing operations. Monthly reports are required in compliance with applicable Kentucky regulations. Contracts are valid for one year from award initiation or until funding is exhausted, with cancellation possible by either party with 30 days' written notice.

Commercial fishers enrolled in the program will be compensated at a contractual rate of $1,200 per day for eight hours of work, or $150 per hour for partial days, with prorated payment for days exceeding the minimum eight-hour threshold if more than 6,000 pounds of invasive carp are harvested. Invoices will be processed biweekly with payment dependent on days and hours worked. Program participants are prohibited from seeking subsidies or additional reimbursement through federally funded programs related to invasive carp sales, though they may sell harvested carp at market value to processors. Applicants must provide supporting documentation including a notarized affidavit, Kentucky Tax Permit, and copies of commercial fishing license documentation. All non-target fish species caught must be returned immediately to the water. The KDFWR Point of Contact maintains authority to modify dates, schedules, locations, fishing hours, observers, and program participants, or cancel fishing operations as required. Program participants demonstrating the largest consistent harvests of invasive carp may receive priority scheduling to maximize the program's impact on invasive species control objectives.

The Kentucky Department of Fish and Wildlife Resources (KDFWR) has regulatory authority and manages fish and wildlife resources in portions of the Ohio River for the people of Kentucky and in cooperation with other state and federal agencies. KDFWR implements projects to investigate and facilitate the harvest of Invasive Carp found in the Ohio River and its tributaries in accordance with strategies set forth in the Management and Control Plan for Bighead Carp, Black Carp, Grass Carp, and Silver Carp in the United States and the Ohio River Basin Invasive Carp Control Strategy Framework. KDFWR administers an Ohio River Basin Contract Fishing Program in an effort to help control the upstream expansion of Invasive Carp. Program participants are commercial fishers enrolled in the program and fish restricted waters (301 KAR 1:140; 1:146; and 1:155) under authority of the Invasive Carp and Scaled Rough Fish Harvest Program (301 KAR 1:152) and Master Agreement. To be considered for participation in this program, qualified commercial fishers must agree to the requirements stated in this application and Master Agreement. Upon submission and approval of this application, the applicant will be added to the Master Agreement as a program participant. Successful applicants will be required to provide supporting documentation, including a notarized affidavit, Kentucky Tax Permit, and other documents as requested for program participation.

PROGRAM DETAILS

Water to be Fished:

Ohio River Basin Contract Fishing Program participants will be paid to harvest Invasive Carp.

The pools accessed for contract removal on this program are within the Ohio River and its tributaries. Fishing locations will be cleared with the KDFWR point of contact (POC) and permission to fish restricted waters will be at the discretion of the project authority.

Fish Considered to be Invasive Carps:

Invasive Carps include four invasive species: Silver Carp (Hypophthalmichthys molitrix), Bighead Carp (Hypophthalmichthys nobilis), Grass Carp (Ctenopharyngodon idella), and Black Carp (Mylopharyngodon piceus)*. All other species caught through participation in the Ohio River Basin Contract Fishing program are ineligible for harvest and shall be returned immediately to the water from which they were taken.

*Program participants must contact the KDFWR POC for instructions on protocol if a Black Carp is harvested.

Program participants are prohibited from seeking subsidies or other types of reimbursement through federally funded programs related to the sale and purchase of Invasive Carps. They may sell their Invasive Carp at market value to processors, but should not accept additional subsidies.

Qualified applicants must meet and maintain the following requirements to be considered for addition to the ORB Contract Fishing Master Agreement (please initial on the blank line).

The third year may consist of either holding a commercial fishing license, or as a commercial fishing helper. (Copies of documentation required – provide to POC)

A fishing day is defined as eight (8) active hours on the water traveling between fishing locations or deploying and retrieving nets. Permission to fish less than four days must be approved and coordinated through the KDFWR POC. Refusal to fish when contacted on three or more occasions annually shall be justification for termination of your contract;

10. Arrange a review and approval of your equipment with the KDFWR POC (Fw.fisheries@ky.gov)

GENERAL INFORMATION:

KDFWR may provide information on locations of high densities of Invasive Carp as is possible and program participants may be asked to fish in a number of locations.

Program participants will be allowed access to Kentucky waters otherwise restricted to commercial fishing and are required to follow 301 KAR 1:152 regulations and only harvest Bighead Carp, Black Carp, Grass Carp, and Silver Carp. All other non-target species will be returned to the water immediately. Waters restricted to commercial fishing in Indiana will be subject to the Indiana Department of Natural Resources (INDNR) rules and regulations and any exceptions that Indiana may provide in collaboration with this program.

The KDFWR POC shall,

a. Notify fishers in advance of scheduled dates.

b. Coordinate with program participants to determine fishing locations and launch sites to which they will report each day.

c. Provide a schedule to program participants and other KDFWR personnel of fishers, dates, locations, and observers.

d. Have the authority to change dates, schedules, locations, hours of fishing, observers, and program participants, or cancel fishing as required.

e. Approve and process invoices when received to ensure payment in a timely manner.

Program participants can expect and agree to a proration when not fishing for 8 hours.

Commercial fishers that are program participants will work at a contractual rate of $1,200/ day (8 hours; or $150.00/ hour for up to 8 hours a day as approved by KDFWR POC) to gill net for Invasive Carps only and remove these fish from the Ohio River and its tributaries, as directed under the supervision of KDFWR. Invoices will be processed biweekly, and payments will be dependent upon the number of days/hours worked. If program participants work less than a full eight (8) hour day, they must coordinate with the POC, and a written explanation and proration of services ($150.00/hour) will be expected on invoices submitted. Program participants can be paid without reaching the full 8-hour minimum per day if they harvest > 6,000 lbs. and need to pull off the water to sell or legally dispose of harvests safely.

Multiple contracts will be awarded to cover management areas. Contracts will be valid for one year from the time that the awards are initiated or limited by funding available to the program.

Success and continuation of this program is dependent upon the total annual Invasive Carp harvest amounts from Ohio River target areas. For that reason, KDFWR expects program participants to provide sufficient effort and time to justify the funds being expended for this program. Therefore, a program participant who consistently harvests the largest amounts of Invasive Carp may be given priority when scheduling to make the greatest impact on the stated purpose of invasive species control.

Contracts with a program participant may be canceled, within 30-days of submitting a written notice, at any time by KDFWR or by the program participant.
