About this file

This is an Errors and Omissions (E&O) Insurance policy requirements document issued by the Kentucky Real Estate Commission (KREC), an agency of the Commonwealth of Kentucky's Public Protection Cabinet. The scope of services requires vendors to provide claims-made basis E&O insurance coverage for all active Kentucky real estate licensees (approximately 13,372 licensees as of July 1, 2021) performing professional services under Kentucky Revised Statutes Chapter 324. The policy must provide $100,000 per-claim and $1,000,000 aggregate coverage per licensee with no deductibles for damages or claims expenses. Six mandatory coverage components are required: primary residence coverage, environmental coverage ($5,000 per claim, $10,000 aggregate), fair housing coverage ($10,000 per claim and aggregate), escrow account/earnest money coverage ($2,500 per claim, $5,000 aggregate), franchise grantor coverage, and regulatory coverage ($2,500 per claim, $5,000 aggregate). The initial contract term is a biennial period (April 1 of year one through March 31 of year two) with one optional two-year renewal period. The Commonwealth reserves the right to extend or renegotiate terms and has indicated the contract effective date of April 1, 2026.

Premium rates must not exceed $200 per person for basic E&O coverage and $200 per person for extended reporting period coverage. Vendors must maintain an A.M. Best rating of B+ or higher, hold licensure from the Kentucky Department of Insurance, and compile a list of approved attorneys with at least one year of real estate litigation experience and principal business addresses in Kentucky or within 50 miles thereof. All bids are guaranteed for 90 calendar days after bid opening, with rates guaranteed through the Master Agreement contract expiration. The successful vendor must provide an electronic web service system compatible with KREC's professional licensing system, submit quarterly loss run reports with specific claim information, furnish annual loss summaries by June 1st, and provide 120-day cancellation notice. The vendor shall collect premiums directly from licensees on a pro rata quarterly basis, with the Commonwealth handling no premium funds. Premiums are fully earned upon policy issuance, though pro rata refunds are available if policy cancellation is requested in writing before expiration. The vendor must also comply with Kentucky surcharge requirements under KRS 136.392 and provide extended reporting period notices to licensees not renewing group coverage.
