VHAPM Part 813.106 Page 1 of 2 Original Date: 08/30/17 Revision 02 Eff Date: 03/31/2020
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C258-21-AP-1078
1. Contracting Activity:
Department of Veterans Affairs
VISN 22
Phoenix Medical Center Contracting Agency: NCO22-G 2237: 644-21-3-201-0059
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
This procurement is to expand current Government-owned patient monitoring to include a remote nurse’s station for Operating Room at the Carl T. Hayden VAMC, Phoenix, AZ.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The Carl T. Hayden VAMC in Phoenix, AZ has a need to procure equipment in order to expand the current Government owned patient monitoring system currently in place. The current patient monitoring system was purchased through Nihon Kohden America, and only compatible equipment will meet the Government’s need for the requested equipment at this time due to existing patient monitoring and IT infrastructure currently in place. Nihon Kohden America is the OEM for the requested patient monitoring equipment, and as such, they are the only company capable of providing the needed equipment to upgrade the existing telemetry system.
4. Description of market research conducted and results or statement why it was not conducted:
Interviews were conducted my interview with Ms. Hayley Kennedy from Nihon Kohden, she informed me that her company only has one teaming relationship with SDVOSB concerns. After Actions Medical is the only SDVOSB authorized to sell/distribute the Nihon Kohden line of bedside monitors. These effects the Rule of Two requirement. Because the marketplace is either the OEM, Nihon Kohden, or the one SDVOSB concern, the Rule of Two cannot be met. Therefore, the Contracting Officer will recommend an unrestricted solicitation on the open market. In my discussion with Mr. Cristobal Yubeta from the Phoenix Medical center he informed me that the current patient monitoring system was purchased through Nihon Kohden America, and only compatible equipment will meet the Government’s need for the requested equipment due to existing patient monitoring and IT infrastructure currently in place. Nihon Kohden America is the OEM for the requested patient monitoring equipment, and as such, they are the only company capable of providing the needed equipment to upgrade the existing telemetry system.
