About this file

This is an affidavit attachment document for the Kentucky Commonwealth related to the KCNA Wholesale Services contract opportunity. The document contains three required affidavits that bidders, offerors, and contractors must submit to be awarded or renew a contract. All affidavits must be completed by an authorized representative, notarized, and returned to the Commonwealth. Each affidavit is effective for one year from the date of execution and serves as the bidder's attestation of compliance with state requirements.

The first affidavit requires contractors to swear under penalty of perjury that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provision. The second affidavit applies to bidders claiming resident bidder status and requires attestation that the entity is authorized to transact business in Kentucky and has for one year prior to bid advertisement filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained a valid workers' compensation policy. The third affidavit applies to bidders claiming qualified bidder status and requires certification that the entity and all subcontractors meet qualified bidder requirements under 200 KAR 5:410(3). Qualified bidder status includes nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities that employ such individuals for at least seventy-five percent of direct labor hours. The bidding agency reserves the right to request supporting documentation for any claimed status and may disqualify bidders or terminate contracts for failure to provide requested documentation.
