About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document authorizing a brand-name, firm-fixed-price purchase order for explosives and explosive supplies for the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) National Center for Explosives Training and Research (NCETR).

The ATF requires purchase of specific Dyno Nobel and related explosive products totaling $266,796.68, including Primacord in various specifications (10, 21, and 5 grain per foot), Electric MS/16FT Zero Delay detonators, NONEL EZ Drifter detonators in two configurations, Blastex cartridges, DynoSplit EX charges, DYNO AP PLUS cartridges, and UNIMAX cartridges. All items must have a manufacturing date within one year of delivery, with a required delivery date no later than 90 days. The acquisition is justified under 41 U.S. Code § 3304 and FAR 6.103-1 (only one responsible source) because these specific brand explosives are essential for the Advanced Explosives Disposal Techniques (AEDT) training course curriculum. The course requires consistent use of specific manufacturer brands to maintain training continuity, ensure proper mathematical calculations for disposal shots, and facilitate interoperability among different explosives disciplines. The Contracting Officer (Brian Wilkins) determined the fair and reasonable price based on previous years' costs plus 6-8% inflation. Market research was conducted through small business searches and GSA eBuy. The contracting activity is the ATF Office of Management—Acquisitions Management Division in Washington, DC, with delivery required to Redstone Arsenal, Alabama, unless pickup can be arranged within 250 miles of that location.

4. Identify statutory authority permitting limiting sources.

The Brand Name is essential to the Government’s requirement.

ATF’s Advanced Explosives Disposal Techniques (AEDT) is an eight (8) day (65 hour) course that will provide best practices for safe disposal of deteriorated explosives, unknown energetic

Version MAR 2025 powders, pyrotechnics, and specialty items such as oil well perforators. The purpose of this course is to provide the audience members with additional techniques that have been put to test and proven to be safe, not only for the operators, but for the community and environment as well.

The course is highly interactive and requires the applicants be a full-time ATF Certified Explosives Specialist (CES) and/or public safety official trained as a Bomb Technician and whose mission includes destruction/disposal of explosive materials. Military EOD personnel are also welcome.

This course stresses interoperability between the aforementioned explosive disciplines to ensure proper communication and understanding of different advanced disposal techniques. Part of this training course provides techniques by utilizing the specific brands of explosives that are required for specific teaching points and for training consistency between classes.

This acquisition is conducted under the authority of 41 U.S. Code § 3304 – Use of Non-Competitive Procedures and the exceptions listed under RFO Part 6.103 – Circumstances permitting other than full and open competition.. (Check the appropriate box for the authority – and bold the statement)

☒RFO 6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

☐ FAR 6.103-2 Unusual and compelling urgency.

☐ FAR 6.103-3 Industrial mobilization; engineering, developmental, or research capability; or expert services.

☐ FAR 6.103-4 International agreement.

☐ FAR 6.103-5 Authorized or required by statute.

☐ FAR 6.103-6 National security.

☐ FAR 6.103-7 Public interest.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.

The aforementioned explosive brand is required to illustrate a specific teaching point which enhances the current curriculum of the AEDT course.

AEDT utilizes multiple different manufacturers of explosives. Our curriculum addresses multiple different types of explosives. The shot layouts have been designed for disposal and the accompanying mathematical calculations necessitates a specific brand be used.

If we constantly use different types of explosives for our shots, we lose continuity within the program and would continually have to amend training aids and curriculum. Explosives manufacturers use different explosives and different ratios of explosives, it is their proprietary mix. Different parts of the course address different manufacturing companies thus addressing the need for different brand name high explosives.

In addition, the requirement to familiarize the different disciplines with the specific explosives will contribute to the consistency between class deliveries and provides an environment of interoperability, which is a key objective of the training.

Note: all of the items must have a date shift code within a year of manufacture at the time of delivery.

Items must be delivered to the Redstone Arsenal unless pickup can be arranged within 250 miles of the Redstone Arsenal.

6. A description of efforts made to ensure offers/quotes were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies.

It is recommended that this requirement be awarded on solicitated on an unrestricted basis to maximize competition among both small and large businesses capable of meeting the Government's requirements. Market research indicates that adequate competition exists within industry, and limiting the procurement may unnecessarily restrict qualified sources. An unrestricted approach is therefore determined to be in the best interest of the Government to support mission requirements and obtain best value.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.

The Contracting Officer deems the Base year only for $266,796.68 to the government will be fair and reasonable based on the previous years and a slight inflation cost of 6% - 8%.

8. A description of the market research conducted and the results or the reason market research was not conducted.

Market research was conducted by collecting and analyzing product/service information on the technical capabilities and prices/costs within the marketplace to satisfy agency needs. Small business search and GSA eBuy were taken into consideration.

Previous years made this procurement challenging to source a firm that is capable of acquiring the needed pyrotechnics.
