About this file

This document is an attachment containing required affidavits and attestations for bidders, offerors, and contractors seeking to contract with the Commonwealth of Kentucky. The affidavits are mandatory submissions for contract award or renewal and must be completed by an authorized representative of the contracting party, notarized, and returned to the Commonwealth. The affidavit is effective for one year from the date of execution. Three primary affidavit forms are included: the Required Affidavit for Bidders, Offerors and Contractors (per KRS 45A.110 and 45A.115), which attests that the contractor has not knowingly violated Kentucky campaign finance laws; the Required Affidavit for Resident Bidder Status (per KRS 45A.494(2)), which certifies that the bidding entity is authorized to conduct business in Kentucky and has maintained compliance with state tax filing, unemployment insurance fund payments, and workers' compensation insurance for the prior year; and the Required Affidavit for Qualified Bidder Status (per 200 KAR 5:410(3)), which applies to nonprofit corporations or qualified nonprofit agencies for individuals with severe disabilities meeting specific organizational and employment requirements.

The Commonwealth of Kentucky reserves the right to request updated affidavits and supporting documentation at any time to verify claimed bidder status. Failure to provide requested documentation upon demand may result in bidder disqualification or contract termination. All attestations require notarization with the notary's seal, commission expiration date, and specific date of execution. The resident bidder affidavit requires documentation proving one year of Kentucky corporate income tax filing, unemployment insurance fund contributions, and active workers' compensation policy maintenance. The qualified bidder affidavit specifically requires nonprofit organizations claiming qualified bidder status to demonstrate employment of individuals with severe disabilities for not less than seventy-five percent of direct labor hours and registration in good standing with the Kentucky Secretary of State.
