About this file

This document is an attachment containing affidavit requirements issued by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking state contracts. The affidavits serve as mandatory compliance documentation under Kentucky Revised Statutes (KRS) 45A.110 and 45A.115, with each affidavit valid for one year from the date of execution. The file contains three separate affidavit templates that bidders must complete and have notarized before submission to the Commonwealth: a Required Affidavit attesting to compliance with Kentucky campaign finance laws, a Resident Bidder Status Affidavit for entities claiming resident status, and a Qualified Bidder Status Affidavit for entities claiming nonprofit or qualified nonprofit agency status. All affidavits must be executed by an authorized representative of the contracting party under penalty of perjury.

The Resident Bidder Status Affidavit requires bidders to confirm that on the date of contract advertisement, the entity is authorized to transact business in Kentucky, has filed Kentucky corporate income taxes for one year prior to advertisement, has made payments to the Kentucky unemployment insurance fund, and maintains an active Kentucky workers' compensation policy. The Qualified Bidder Status Affidavit applies to nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities that employ individuals with severe disabilities for at least seventy-five percent of direct labor hours. The Commonwealth reserves the right to request supporting documentation for any claimed status, with failure to provide such documentation resulting in bidder disqualification or contract termination. The document was revised as of September 16, 2022, with processing notes indicating February 28, 2023 and March 27, 2023 timestamps.
