About this file
This is an affidavit attachment document for the Commonwealth of Kentucky establishing required attestations for bidders, offerors, and contractors seeking state contracts. The document contains three separate affidavit forms that contractors must complete, have notarized, and submit to the Commonwealth prior to contract award or renewal. The affidavits are effective for one year from the date of execution and must be completed by an authorized representative of the contracting party under penalty of perjury. No specific products, services, quantities, response dates, due dates, site visits, bidders' meetings, award dates, or contract terms are identified in this attachment, as it serves as a standardized compliance document applicable across multiple procurement opportunities.
The first affidavit requires contractors to attest that they have not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance law provision. The second affidavit requires bidders claiming resident bidder status to affirm that they are authorized to transact business in Kentucky and have, for one year prior to contract advertisement, filed Kentucky corporate income taxes, made payments to the Kentucky unemployment insurance fund, and maintained an active Kentucky workers' compensation policy. The third affidavit is for bidders claiming qualified bidder status, requiring attestation that the entity and all subcontractors meet the definition of a qualified bidder under 200 KAR 5:410(3), which includes nonprofit corporations furthering Kentucky Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities employing such individuals for at least seventy-five percent of direct labor hours. The bidding agency reserves the right to request supporting documentation for any claimed status, with failure to provide documentation resulting in potential bidder disqualification or contract termination.
