Water Interconnection to Ridgeville - Phase 2B

This specification document outlines the technical requirements and contract procedures for the Water Interconnection to Ridgeville Project Phase 2B, a municipal water infrastructure project administered by Dorchester County Water and Sewer (DCWS) in South Carolina. The project involves the installation of approximately 27,000 linear feet of new 16-inch water main via open-cut and trenchless methods, including one jack and bore operation and five horizontal directional drill (HDD) operations. Associated work includes installation of approximately 10 linear feet of 12-inch water main, 32 gate valves, 22 fire hydrant assemblies, 8 air release valves, 79 water service lines, surface restoration, sediment and erosion control, traffic management, and all incidental work necessary for completion. The contract encompasses divisions covering mobilization/demobilization, water main construction, appurtenances, testing, disinfection, and final restoration. The project will be evaluated on a unit price basis with specific line items for pipe installation by material type and installation method, fittings, valves, services, and restoration activities. All materials must be manufactured in the United States, and the contractor must provide comprehensive project controls including scheduling, submittals, quality control testing, and record documentation throughout construction.

Contract execution requires adherence to DCWS minimum standards, AWWA standards, ASTM specifications, and applicable South Carolina Department of Environmental Services regulations. The contractor is responsible for all permits, utility locating, environmental controls including erosion and sedimentation management, dewatering, traffic control, and protection of existing utilities and structures. Hydrostatic pressure testing, bacteriological sampling, and disinfection of potable water mains must be completed prior to final acceptance. The contractor must maintain a two-year warranty period following final payment and provide as-built documentation certified by a licensed South Carolina surveyor. Payment will be processed within 21 working days of approved applications, with retainage held per contract terms. The project includes detailed specifications for HDD operations with inadvertent release control plans, fusion techniques for polyvinyl chloride pipe, equipment requirements, and comprehensive environmental protection measures, particularly regarding drilling fluid containment and disposal.

SECTION 01026

APPLICATIONS FOR PAYMENT

PART 1 GENERAL

1.01 SCOPE OF WORK

A. This section includes the requirements that the Contractor shall follow for submitting applications for payment.

B. Its noted that the Owner, at its sole discretion, may authorize the Engineer to act on its behalf for any or all the of the tasks describe herein.

1.02 RELATED WORK

A. Section 01025 - Measurement and Payment.

B. Section 01370 - Schedule of Values.

1.03 PROCEDURES FOR SUBMITTING APPLICATIONS FOR PAYMENT

A. The Contractor shall submit their draft Application for Payment on or before the third working day of each month, or another specific day established at the Pre-Construction Meeting as authorized by the Owners Project Manager (PM). The Owner will pay the Contractor the value of the work performed, as approved by the Engineer, less retainage, less the aggregate of previous payments, typically within 21 working days of receipt from Engineer of final approved

Application for Payment. Draft Applications for Payment that are submitted later will require additional time for processing for payment.

B. The Owners approving authority, usually the Engineer, will review the draft Application for

Payment and provide the Contractor with comments typically within 10 working days. The

Contractor shall then address all comments and be prepared to submit a final Application for

Payment on the established date of the Monthly Construction Progress meeting. Final

Applications for Payment that are submitted later will require additional time for processing for payment.

C. Each Application for Payment shall be an itemized Application for Payment that includes the work completed as of the date indicated on the application, with supporting documentation showing the extent of the work and/or quantities for which payment is requested. Supporting documentation shall be in a form, such as drawings, that represent the actual measurements and dimensions so they can be field verified and/or used in subsequent Applications for Payment.

Previous quantities paid shall also be shown in the supporting documentation for comparison purposes and for tracking previous quantities paid and the respective locations at which they were paid.

D. Each Application for Payment shall include a summary showing Adverse Weather Days (Weather

Delays/Rain Days) incurred for the month and the supporting documentation. See Contract

Article 8 - Section 8.8. Failure to submit this summary on a monthly basis forfeits the Contractors rights to further adverse weather claims.

01026 - 2

E. Applications for Payment will be made using the Owners standardized Application for Payment form(s). The PM will provide the Contractor an electronic copy of the form(s) prior to the first pay request. The Contractor shall reference the project name, purchase order number, description, and Engineer/Owners project number on all pay requests.

F. All final Applications for Payment must be addressed to the PM. Four (4) original Application for Payments shall be signed, dated, notarized and submitted for payment. Payments will not be processed from copies. At the Owners discretion, electronic submittals may be allowed if authorized at the Pre-Construction Meeting.

G. If the Construction Management Team requests changes prior to payment or rejects payment in its entirety, the Contractor will be notified of those changes and/or the reasons for rejection and what the Contractor must do before the Application for Payment will be considered.

H. Submittal of an itemized Application for Payment and supporting documentation by the

Contractor shall indicate that the Contractor has inspected those portions of the work included in the application and has determined and certifies that all portions of the work are in compliance with the Contract Documents and that the quantities submitted for payment are true and accurate.

I. Recommendations for payment will constitute a representation by the Owner based on supporting data that, to the best of the Owners knowledge, information, and belief the work has progressed to the point indicated. However, recommendation for payment does not waive claims for defects, does not constitute acceptance of work not in accordance with the Contract Documents, does not indicate that the work was constructed in accordance with the Contract Documents, and does not relieve the Contractor of the responsibility to correct any deficiencies or damaged work that may be found at a later date.

J. If payment is requested on a basis of materials not yet incorporated into the work but which are delivered, suitably stored, and verified by the PM, the bill of sale, invoice, or other documentation shall be submitted with the Application for Payment warranting to the Owner that the materials are free and clear of all liens and evidenced that the materials are covered by appropriate property insurance or other arrangements showing protection of materials. Payment for stored materials shall be limited to 60% of the contract price listed in the Schedule of Values. Stored materials shall be stored at an Owner approved location within the State of South Carolina. Payment for stored materials does not imply acceptance. Include in the Application for Payment amounts applied for materials or equipment purchased or fabricated and stored, but not yet installed.

Differentiate between items stored on-site and items stored off-site.

1. Provide certificate of insurance, evidence of transfer of title to Owner, and consent of surety to payment, for stored materials.

2. Provide supporting documentation that verifies amount requested, such as paid invoices.

Match amount requested with amounts indicated on documentation; do not include overhead and profit on stored materials.

3. Provide summary documentation for stored materials. Submit and maintain a Stored

Materials Log. The Stored materials Log will indicate the following:

a. Value of materials previously stored and remaining stored as of date of previous

Applications for Payment.

01026 - 3

Payment and on or before date of current Application for Payment.

c. Value of materials stored since date of previous Application for Payment and remaining stored as of date of current Application for Payment.

K. The Owner may withhold, in whole or in part, payments previously made to such extent as may be necessary in the Owners opinion to protect the Owner from loss for which the Contractor is responsible, including loss resulting from acts and/or omissions of the Contractors employees, subcontractors and their agents and employees, and other persons or entities performing portions of the work for, or on behalf of, the Contractor or any of its subcontractors because of, but not limited to, the following:

1. Defective work not remedied;

2. Third party claims filed or reasonable evidence indicating probable filing or such claims unless security acceptable to the Owner is provided by the Contractor;

3. Failure of the Contractor to make payments properly to subcontractors or for labor, materials and/or equipment;

4. Reasonable evidence that the work cannot be completed for the unpaid balance of the

Contract Sum;

5. Damage to the Owner or another Contractor;

6. Reasonable evidence that the work will not be completed within the Contract Time, and that the unpaid balance would not be adequate to cover actual or liquidated damages for the anticipated delay; or

7. Persistent and repeated failure to carry out the work in accordance with the Contract

Documents.

L. The Contractor agrees that they will indemnify and hold the Owner harmless from all claims growing out of the lawful demands of subcontractors, laborers, workmen, mechanics, material, men, and furnishers of machinery and parts thereof, equipment, power tools, and all supplies, including commissary, incurred in the performance of this contract. The Contractor shall, at the

Owners request, furnish satisfactory evidence that all obligations of nature hereinabove designated have been paid discharged or waived. If the Contractor fails to do this the Owner may, after having served written notice on the Contractor, either pay unpaid bills, of which the Owner has written notice, or withhold from the Contractors unpaid compensation a sum of money deemed reasonably sufficient by the Owner to pay any and all lawful claims. When satisfactory evidence, as determined by the Owner, is furnished that all liabilities have been fully discharged, payment to the Contractor shall be resumed in accordance with the terms of this Contract. In no event shall the provisions of this paragraph be construed to impose any obligations upon the

Owner to either the Contractor or his surety. In paying any unpaid bills of the Contractor, the

Owner shall be deemed the agent of the Contractor, and any payment so made by the Owner shall be considered as payment made under the Contract to the Contractor, and the Owner shall not be liable to the Contractor for any such payment made in good faith.

01026 - 4

1.04 PROCEDURES FOR SUBMITTING APPLICATIONS FOR FINAL PAYMENT
