SCOPE OF WORK

HARPERS FERRY NATIONAL HISTORICAL PARK

SOLID WASTE DISPOSAL CONTRACT

I. BACKGROUND

Harpers Ferry National Monument was authorized by an act of Congress on June 30, 1944, and became Harpers Ferry National Historical Park on May 29, 1963. Harpers Ferry contains approximately 3,745 acres, primarily in West Virginia, with additional lands in Maryland and Virginia. Harpers Ferry (HAFE) lies at the confluence of the Potomac and Shenandoah Rivers. The confluence cuts a gap through the Blue Ridge as the Potomac continues its voyage to the Chesapeake Bay. The park was established primarily to preserve historic resources and to commemorate the historic events that occurred at and around Harpers Ferry. HAFE requires the removal and compliant disposal of solid waste and unserviceable scrap that includes construction debris and office wastes.

II. PURPOSE

The purpose of this contract is to provide one, 30-cubic yard, uncovered roll-off container with once every four (4) week emptying of that container, for the Harpers Ferry National Historical Park, to be sent to a landfill.

III. CONTRACT TYPE

The NPS anticipates awarding a firm fixed price contract. It is anticipated that no more than three (3) tons of waste will be accumulated during any four (4) week period during the life of the contract.

IV. SCOPE AND OBJECTIVES

The contractor shall provide the National Park Service with all labor, supplies, materials, and all travel required to provide and empty one (1), 30-cubic yard uncovered roll-off container of solid waste and unserviceable scrap that includes construction debris and office wastes at Harpers Ferry National Historical Park, Maintenance Facility, 230 Zachary Taylor Street, Harpers Ferry, West Virginia, 25425.

Removal of the container and its contents for waste disposal will be executed every four (4) weeks on Tuesday of the fourth (4th) week. If that Tuesday is a Holiday, the removal will be on the next following normal business day. The contents of the container shall be sent to a landfill.

V. PERIOD OF PERFORMANCE

The period of performance of this contract shall be for ONE (1) base, and four (4) option periods (*subject to availability of funds), as specified below:

VI. HOURS OF OPERATION

a. The service to be performed under this contract shall be performed during normal Park business days. The schedule of service will during normal workday hours, 7:00 AM – 2:00 P.M., and if not finished that day will return on the following workday to complete the task. Services will not be scheduled to be performed on a regular Federal holiday (see below), or one designated by Presidential proclamation.

b. * The holiday is observed on the preceding Friday or the following Monday when the holiday occurs on Saturday or Sunday, respectively.

V. DELIVERABLES AND DESTINATION POINT

All deliverables shall be shipped Free On Board (FOB) Destination, within Consignee’s premises, with all shipping and transportation costs prepaid.

VI. GOVERNMENT-FURNISHED PROPERTY

No Government furnished property.

VII. SPILL RESPONSIBILITY

a. The Contractor is solely responsible for all debris, spills or leaks during the performance of this contract, which occurs because of, or is contributed to by the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks in accordance with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the Government. The Contractor shall report all such spills or leaks, regardless of their quantity, to the COR and CO immediately upon discovery. A written follow-up report shall be submitted to the COR and CO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

1. Description of item spilled (including identity, quantity).

2. Whether amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

3. Containment procedures initiated.

4. Summary of any communications Contractor has with press or PARK officials other than the CO.

5. Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

6. Description of item spilled (including identity, quantity).

VIII. LOSS OR DAMAGE

The contractor shall be liable for any loss or damage to any government property caused by negligence, theft, or willful misconduct of the contractor, his agents, servants, and employees, and shall indemnify and save the government harmless against all actions, proceedings, claims, demands, costs, damages, and expenses, including attorney’s fees, by reason of any suit or action brought for any actual or alleged injury to or resulting from the performance of this contract. The contractor shall submit a full written report to the COR within 24 hours following the occurrence of such damage, loss, or injury.

If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the contractor shall be responsible for same. The government, at its option, may in lieu of repayment, require the contractor to replace at his own expense, all such property as directed by the Contracting Officer. Until the equipment is repaired or replaced, the contractor shall furnish similar, adequate replacement property and/or equipment at no charge to the government, within two working days of the date the equipment has been lost, stolen, or damaged.
