Performance Work Statement Solicitation No. 140R6024Q0046

1.0 BACKGROUND & SCOPE

Tiber Dam impounds the Marias River forming Lake Elwell (Tiber Reservoir). Tiber Reservoir is located approximately 20 miles Southwest of Chester, Montana. The Bureau of Reclamation facility was originally constructed for flood control and irrigation purposes. Present operations also supply municipal and industrial water, provide recreation opportunities, enhance fish and wildlife habitat and provide electricity through a privately developed hydropower plant. This reservoir, with 181 miles of shoreline, extends upstream of the dam for approximately 24 miles.

The objective of this contract is for the Bureau of Reclamation to obtain landscape and grounds maintenance services from the contractor to maintain and clean structures listed in the table below at Tiber Reservoir Recreation Area and the indoor janitorial services for the Tiber Field Office in order to provide clean and safe recreational areas for visitors. The structures include restroom facilities, parking area, fire rings, grills, picnic tables, and shade shelters and group use shelters. Additionally, litter removal, leaf cleanup and mowing are required.

The Bureau of Reclamation maintains eight recreational areas (See Area Map attached). The reservoir offers fishing for walleye, perch, and northern pike; plus, concrete boat ramps, campgrounds, and picnic shelters. Recreational activities include: boating, camping, fishing, hunting, picnicking, recreational vehicles, water sports, and winter sports.

The Contractor shall provide maintenance including the furnishing of all supplies, labor materials, and equipment, except Government-furnished paint, to accomplish services at Tiber Reservoir. The task and performance requirements stated below of cleaning is defined as the removal of all-foreign substances and/or matter from the item or area being serviced, including litter, fire pit cleaning, routine table and floor space cleaning, and cleaning and stocking restroom facilities. Maintenance applies to work performed to the item or area to keep its condition clean, functional, and safe.

2.0 PERIOD OF PERFORMANCE

The term of the contract will be from May 1, 2024 (to be adjusted based on actual award date) through April 30, 2025, plus four 1-year option periods. Reclamation will exercise such option periods at its discretion.

HOURS OF OPERATION: The Contractor shall only perform work from 8:00am to 8:00pm, Monday thru Friday, unless otherwise notified.

The Contractor shall conduct extra cleaning and more frequent restocking of restrooms during peak use periods which are defined as during the following dates and associated weekends:

* Memorial Day Weekend;

* Independence Day; and

* Labor Day Weekend.

Performance shall be based on the end user’s evaluation of results, not the frequency or method of performance. Final results will be the determining factor for the success or failure of this PO shall perform ground maintenance services at frequencies as determined by the contractor to achieve the prescribed Performance Standards listed below.

5.0 PERFORMANCE STANDARDS - The contractor shall perform the required tasks to the standards and procedures listed below:

5.1 RESTROOM PERFORMANCE

5.1.1 Toilet bowls, risers, seats, and seat covers shall be free of deposits on surfaces.

5.1.2 Building interiors shall be free of dirt, trash, graffiti, insects/rodents (dead and alive), and all other foreign object.

5.1.3 Floors free of standing water and dirt and debris.

5.1.4 Toilet paper stocked through next cleaning. The contractor is responsible for supplying the toilet paper. Toilet paper should not be allowed to run out in any restroom.

5.1.5 Unpleasant odors (both sewage and chemical) shall be minimized.

5.1.6 Concrete sidewalks and parking places shall be swept and clean from dirt and debris.

5.1.7 Interior and exterior walls shall be free of graffiti. Any required paint will be supplied by Reclamation.

5.1.8 Interior and exterior shall be free of wasp nests, bird nests, and spider webs.

5.1.9 Notify Reclamation personnel when vaults are three-fourths full.

5.1.10 Any vandalism shall be reported to Reclamation personnel within 24 hours of discovery.

The Contractor shall ensure that cleaning tools be color coded or otherwise labeled to ensure contaminated tools are not improperly used, causing cross-contamination. The contractor shall follow disinfectant manufacturers’ directions for proper disinfecting and cleaning.

Multiple restrooms shall not be closed completely for cleaning at any time. The contractor shall promptly clean restroom units one (1) unit at a time, leaving the other unit(s) for use by the public. The contractor shall erect or hang a sign on the unit being cleaned indicating that the unit is presently not available for use.

5.2 PICNIC TABLES AND BENCHES

5.2.1. Picnic tabletops and seats are to be cleared and cleaned of any debris or foreign objects such as food remnants, including food lodged in cracks.

5.2.2. The undersides of the tables shall be free of spider webs, etc.

5.2.3. Tops, seats, and legs shall be secure and functional.

Damaged or vandalized tables shall be reported to QAE within 24 hours of discovery.

5.3 FIRE RINGS, CAMPFIRE GRILLS, AND PEDISTAL BARBEQUE GRILLS

5.3.l. Grills shall be free of grease, garbage, food particles, and all foreign objects.

5.3.2. Fire rings shall be free of garbage and other foreign objects.

Any damage or vandalism to grills or fire pits shall be reported to QAE with 24 hours of discovery.

STANDARD

• The contractor shall perform the above tasks with no deviation in timeliness or quality.

• The contractor uses the appropriate equipment, tool, and chemicals that are in good operational condition for completing the required services in a satisfactory manner.

• No more than 3 tasks per year shall result in the need for service re-performance.

5.4 LITTER/REFUSE CLEANUP

Recreation areas, campsites, and structures shall be free of litter. These areas are identified on the attached maps and include all annotated areas including specific locations and areas within identified boundaries.

Litter shall be collected and properly disposed of.

• The contractor shall perform the above tasks with no deviation in timeliness or quality.

• The contractor uses the appropriate equipment, tool, and chemicals that are in good operational condition for completing the required services in a satisfactory manner.

• No more than 3 validated customer complaints per month.

5.5 MOWING, TRIMMING GRASS, AND LEAF COLLECTION

5.5.1 Area and Schedule: Mowing and trimming for Tiber totals approximately 34 acres. Leaf collection takes place in Sanford Park before Memorial Day and after Labor Day. Mowing, trimming, and leaf collection shall be completed at any time EXCEPT during the following times and occasions:

• Weekdays between the hours of 6:00pm and 8:00am.

• Weekend periods between 5:00pm Friday and 8:00am Monday.

• Anytime on a federally observed holiday and the associated weekend, including

Memorial Day, Independence Day, and Labor Day.

• During any short-term special recreation event at the area, as communicated by the

Quality Assurance Evaluator (QAE).

• Anytime mowing cannot be safely accomplished as identified by the QAE.

• Anytime mowing is prohibited by the QAE for any reason.

5.5.2 Suspension of Tasks/Rescheduling: In the event the Government suspends mowing or trimming for other reasons, the QAE will provide 24-hour advance notice to the contractor.

The contractor shall schedule mowing and trimming operations to be completed before any of the above predictable prohibited periods. The QAE will approve changes to scheduling upon written request by the contractor.

5.5.3 MOWING AND TRIMMING GRASS TASKS:

5.5.3.1. Litter Cleanup: Litter cleanup shall occur before any mowing takes place.

5.5.3.2. Recreation areas, campsites, and around structures: These areas shall be trimmed, mowed, and maintained at a desirable level. These areas are identified on the attached maps and include all annotated areas including specific locations and areas within identified boundaries.

5.5.3.3. ADA concrete handicap parking spaces and concrete sidewalks. Grass and weeds shall be trimmed 2 feet around all these spaces and sidewalks.

5.5.3.4. Trees, facilities, restrooms, walkways, roads, kiosks, grills, signs, fences, RV hookups, boat ramps, trails, parking areas, road/campground barriers, recreation shelters, and under/around picnic tables. Grass and weeds shall be trimmed 2 feet around these items, being careful not to damage or gridle trees/bushes in particular.

5.5.3.5. Trimming around tree requirements: Grass and weeds shall be trimmed 2 feet around trees (being careful not to damage or girdle trees/bushes)

5.5.3.6. Grass cutting requirements: Four (4) inches or more requires mowing at which time mowing should include a height of two (2) inches average height. Bagging grass clippings is authorized, but not a requirement of this contract; however, the contractor shall ensure that there is not a significant buildup or clumping of cut vegetation, as determined by the COR.

Contractor shall insure mowing does burn the grass as a result of it being cut too short.

5.5.3.7. Leaves collection requirements: Areas where leaves shall be collected include all lawn areas, guard rails, ditches, shelters, restrooms, roads, trails, parking areas, and appurtenant features. The first collection should occur between October 15th and November 14th and the second collection between November 15th and April 30th. A minimum of two weeks shall pass between the collections. Deviations to the above schedule will be made if snow and ice conditions warrant changes to the schedule. Leaves will be collected and properly transported (so as to ensure no loss of material during transport) for disposal. The Contractor may recycle or compost leaves but shall not store such materials on Federal lands.

5.5.3.8. Mower requirements: Rotary, flail, or reel type mowers are acceptable, but sickle-type mowers are not acceptable.

The use of herbicide is prohibited (unless approved by Reclamation’s Quality Assurance Evaluator (QAE). Any observed noxious weeds or invasive species shall be reported to Reclamation personnel within 24 hours of discovery.

Special caution shall be taken while mowing in areas that are irrigated. Contractor shall determine the location of irrigation heads and other critical sprinkler system components and be aware of them prior to mowing irrigated areas. The Contractor is responsible for replacing or repairing any damage caused to irrigation equipment by the Contractor’s employees or equipment. Any damage occurred or found shall be reported within 24 hours of discovery.

Damaged irrigation components shall be replaced in kind and is subject to Reclamation approval.

In the event the Government suspends mowing or trimming for other reasons, the QAE will provide 24-hour advance notice to the Contractor. The Contractor shall schedule mowing and trimming operations to be completed before any of the above predictable prohibited periods.

The COR will approve changes to scheduling upon written request by the Contractor.

5.5.4 SHADE SHELTER/GROUP USE SHELTERS

5.5.4.1. Structures shall be free of litter, debris, bird droppings, and non-governmental flyers.

5.5.4.2. The shelters shall be kept clean.

Storage of any materials, vehicles, and equipment outside is not allowed without permission from the QAE.

• The contractor shall maintain the above requirements in quality.

5.5.5 TIBER OFFICE CLEANING (JANITORIAL SERVICE)

5.5.5.1. Floors and walls in entire building shall be free of dirt, mud, debris, trash, scuff marks, and stains (Vacuuming and mopping).

5.5.5.2. Mirrors shall be free of water and scum marks.

5.5.5.3. All sinks and showers shall be free of debris, dirt, mud, water and scum marks.

5.5.5.4. All toilets and seats shall be free of deposits.

5.5.5.5. Counter tops and tables shall be free of spills, water and scum marks, and debris.

5.5.5.6. All horizontal surfaces shall be free of dust.

5.5.5.7. Windows shall be free of debris, webs, dirt, and markings.

5.5.5.8. Garbage will be taken out weekly and disposed in dumpsters provided by the office.

5.5.5.9. All hand soap dispenser shall be filled as needed in all restrooms.

Tiber Office cleaning will need to be performed in order to maintain a standard industry level of cleanliness (weekly).

The Contractor shall wax floors and shampoo carpets according to manufacturer’s recommendations (annually).

The Contractor shall wash and clean windows inside and out in order to maintain an industry

P a g e 9 | 15 standard of cleanliness (annually).

• The contractor shall maintain the above requirements in good quality.

6.0 PERFORMANCE CRITERIA

The designated QAE will document acceptable and unacceptable contract performance. If the QAE considers the contractor's performance to be unsatisfactory, the information will be reported to the CO. The CO may require the contractor to explain, in writing, the cause of the poor performance, any corrective actions the contractor has already taken to obtain an acceptable level and any future corrective actions the contractor will utilize to prevent unacceptable performance.

The contractor shall be required to meet with the QAE at least weekly during the first month of the contract and as necessary thereafter to establish a partnering relationship with the contractor to address performance problems encountered and their resolution. The time and location will be mutually agreed upon. The Government reserves the right to change the frequency of the meetings depending upon the quality of service provided by the contractor. The Government will prepare and distribute minutes of the meetings to all those who attend. If the contractor does not concur with any portion of the minutes; the contractor shall inform the QAE within 5 days of receiving the minutes.

8.0 GOVERNMENT REMEDIES

All work shall be subject to inspection, approval, and acceptance by the Government. The government will compare the contractor's performance to industry standards and will not exclude common sense considerations as applied by the QAE. The CO will follow the requirements of FAR Clause 52.212-4(a) for the contractor’s failure to correct nonconforming services. The Government will consider work incomplete when any one of the following conditions exists:

-The contractor did not perform any or all the tasks at the required frequency and/or at an acceptable level of quality as determined by random inspections and/or customer complaints that are verified.

If the performance of any required service is unsatisfactory, and poor performance is clearly the fault of the contractor, the Government will reject invoiced amounts related to the site(s) that were found to reflect non-performance of the required tasks.

10.0 CONTRACTOR PERSONNEL

Contractor employees performing repair or regular maintenance may be required to show a driver’s license before being granted access to a building. In the absence of a driver’s license, the employee shall provide an alternate source of official identification that includes: First, Middle, Last Name; date and place of birth; and place of residence. All contractor employees must be U.S. citizens or have a valid Immigrant Visa Number, Permanent Resident Card, or Resident Alien Card authorizing them to We work in the U.S. The contractor shall abide by all Federal, State, and Local laws pertaining to hiring and assigning tasks to personnel.

In accordance with WBR 1452.237-80 Security Requirements – Bureau of Reclamation, the contractor shall provide a listing of all personnel performing work under the contract prior to performance.

Copies of state-issued licenses that pertain to work related tasks may be required. The contractor shall notify the CO and the QAE in writing of any personnel change to this list prior to the implementation of such change(s).

The contractor/or contractor’s personnel shall promptly report any damaged, clogged, or inoperable systems, fixtures, or facilities to the QAE. All conditions, which prevent the proper performance of the contractor’s duties, shall be reported to the QAE. Notification will be in writing, by telephone, or in person stating the location no later than the following workday.

The contractor shall, by telephone or via e-mail, report to both the QAE and the CO, any accidents involving injury, death, damage to Government property, or accidental loss of Government property resulting from the activities of the contractor, their subcontractors, their agents, or their employees. A report shall be forwarded to the QAE and CO within 2 working days after the date of the accident. All accident records required by the Occupational Safety and Health Act shall be maintained in accordance with OSHA guidelines. In addition, the contractor shall cooperate with the QAE and CO and provide data to any follow-up investigation by the Government of any accidents.

11.0 CONTRACTOR FURNISHED SUPPLIES

The Contractor shall furnish all supplies in accordance with standard industry practices required to perform under the contract to include at least the following:

a. Cleaning Supplies: The contractor shall furnish cleaning supplies as commonly utilized in industry practice to include, but not limited to, such items as mops, brooms, mop buckets, rubber gloves, sponges, wipes, waxes, polishes, cleaners, disinfectants, brushes, hand soap, etc.

b. Restroom Supplies: The contractor shall furnish supplies for restocking of the restrooms including toilet paper.

c. Ground Maintenance Equipment: The contractor will provide ground maintenance equipment including mowers, trimmers, and any other equipment that the contractor finds pertinent. Rotary, flail, or reel-type mowers are acceptable. Sickle-type mowers are not acceptable.

d. Contractor’s Responsibilities: The contractor is responsible for providing all labor, equipment, materials, supplies, and state issued commercial applicator’s license (if applicable)

P a g e 13 | 15 necessary to meet the requirements of the contract. Trucks, vehicles, and personnel will be licensed, insured, and certified as required by the appropriate governing agencies. Trucks shall be operational in accordance with Montana Department of Transportation requirements.

12.0 SAFETY AND HEALTH

a. Occupational Safety and Health Administration (OSHA) rules and regulations shall be adhered to.

b. The contractor shall follow Reclamation Safety and Health Standards (Revised 2014); copy available upon request. The contractor is required to practice safety always when carrying out PO requirements.

c. A careful consideration for safety in operations shall be exercised when carrying out the contract work requirements in the public recreation areas: especially during mowing activities such as throwing rocks and causing minor or major damages to people's properties and children surrounding the areas.

d. Exceptional care shall be taken when children, adults, and the elderly are in the area. This will require the contractor to alter scheduled work to avoid these potential conflicts.

e. The contractor shall contact the QAE if these potential conflicts affect, or are anticipated to affect, PO requirements.

f. The contractor shall use extra caution when operating powered equipment and vehicles to ensure the safety of the contractor and the public.

g. The contractor shall operate vehicles at or below the posted speed limits in the recreation areas.

h. Approved first aid kits shall be carried in all contractors’ vehicles.

i. The contractor shall be responsible for supplying personal protective equipment for all the contractor’s employees.

j. The contractor shall provide a means of hand washing to the contractor’s employees for those sites without potable water.

k. The contractor shall erect a sign on the restroom unit being cleaned to indicate the unit is not available for use.

l. The contractor shall immediately report all spills of waste materials to the QAE.

m. The contractor shall keep the premises free from debris and accumulated waste.

n. The contractor shall notify the QAE as soon as possible of any wasp nest, rattlesnakes, skunks, animal burrows under structures, or other potential hazards in the recreation areas.

o. Any vandalism, security, safety, or health issues shall be reported as soon as possible to the

QAE. Any crimes against property or people, or need for emergency services, shall first be reported to the appropriate County Sheriff’s Office or emergency medical provider. If possible, also provide the QAE any information pertaining to the condition, time, date, place, and description of damages, witnesses, suspects, or other information.

p. During dry conditions, the contractor shall use extreme caution when mowing to prevent fire related hazards.

13.0 ENVIRONMENTAL PROTECTION

a. The contractor shall comply with all federal, state, and local laws, regulations, and standards.

All environmental protection matters shall be coordinated with the CO or QAE.

b. The contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002, Executive Order 13423 and the Federal Acquisition Regulation to provide biobased products. Therefore, the contractor shall utilize products and material made from biobased materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. The QAE must approve all supplies and material used in the performance of the contract.

c. The contractor shall submit a complete list of biobased products that the contractor will use in carrying out the requirements of the PWS. This list shall include the name of the manufacturer, cost of each material, and the intended use of each of the materials. It is desirable that the contractor supply the greatest number of biobased products listed that meet the health and environmental specifications. The following is an example list of products that the contractor may use in this contract for which biobased products are available. The list is not all-inclusive.

• Bathroom and Spa Cleaners

• General Purpose Cleaners

• Glass Cleaners

• Graffiti and Grease Removers

• Industrial Cleaners

• Multi-Purpose Cleaners

14.0 GOVERNMENT FURNISHED EQUIPMENT/INFORMATION

The contractor is responsible for providing all labor, equipment, materials, supervision, and supplies necessary to meet the requirements of the PO except Government-furnished paint. All personnel employed by the contractor for performance of the PO, or any representative of the contractor entering the Government installation, shall abide by all security regulations of the installation. A key to the padlock for the restroom units will be issued by the QAE to the contractor. The contractor is prohibited from having additional keys made (copied) and is responsible for all costs associated with rekeying if the assigned key is lost.

15.0 CONTRACTOR QUALITY CONTROL PLAN

The contractor is responsible for the management and quality control actions necessary to meet the quality standards set forth by the PO. The contractor shall develop and maintain a quality control program to ensure maintenance services are performed in accordance with this PO.

Each phase of the service rendered under the PO is subject to Government inspection by the QAE during any or all times of the contractor’s work. The Government’s Quality Assurance program is not

P a g e 15 | 15 a substitute for the QCP. The Government will monitor the contractor’s performance. Non-compliance with the PO will result in a required service being re-performed to the performance standards as stated in the PWS without additional expense to the Government. The Government reserves the right to utilize any method of inspection as necessary to assure contractor performance with all the requirements of the PO.

No materials, supplies, or processes shall be used that will damage floors, floor coverings, woodwork, painted surfaces, structures, or other items being cleaned. Materials and supplies that do not fully comply with environmental regulations or that are of a highly caustic or/of a toxic nature shall not be used or permitted in any building or area covered by this contract. The contractor shall refer the contemplated use of any materials of an unidentified or doubtful nature as to flammable or caustic qualities to the QAE for approval, prior to use. The Government will assume no responsibility for contractor materials or supplies which are lost, stolen, or damaged. The contractor shall only provide material and supplies that meet or exceed standard industry practices.

16.0 INVOICES

In accordance with Reclamation Acquisition Circular (RAC) 13-08, all invoices must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP) located at www.ipp.gov. The contractor shall be registered in the IPP system before any payment is made to the contractor. The IPP system is FREE to register and use.

Invoices shall specifically cite each line item for each site for payment. Combining prices for multiple line items will result in a rejected invoice. Prior to official submission in IPP, the Contractor shall submit an electronic copy of a draft invoice to the Contract Specialist, Michael Hirsch at mhirsch@usbr.gov. Once the Contract Specialist provides acceptance, then the Contractor shall submit the official invoice through IPP with a copy of the invoice to the IPP submittal. Invoices submitted prior to goods or services being received and accepted shall be rejected.
