About this file

This document is an Attachment A - Office of Attorney General's Response to Vendors' Written Questions for Request for Proposal (RFP) 040 2600000030, involving the Commonwealth of Kentucky. The RFP is an active solicitation for panel counsel, with a proposal deadline of September 17 and written questions due by August 15. The contract term appears to run through June 30, 2026, and is open to law firms interested in providing complex litigation services. Vendors from other states are required to have a Certificate of Authority to Transact Business in Kentucky, which must be either granted or pending at the time of submission.

The document clarifies key procedural requirements, specifically noting that pursuant to KRS 45A.480(1)(b), the Commonwealth of Kentucky cannot award a state contract to a foreign entity that has not met the registration requirements under KRS 14A.9-010. The RFP is distinct from a previous complex litigation panel counsel contract (RFP 040 2500000106), and firms that were awarded the previous contract are not automatically included in this solicitation. Interested vendors must independently submit a bid for this specific RFP, with the understanding that the Commonwealth will evaluate submissions based on the outlined requirements.

14 Certificate of Authority to Transact Business in KY: If attorneys from another state are submitting the RFP (with the intent to pro hac in the case of litigation), do we need to have our Certificate of Authority to Transact Business application granted before the RFP submission deadline or can it be submitted and pending at the time of submission?

Pursuant to KRS 45A.480(1)(b), an agency, department, office, or political subdivision of the Commonwealth of Kentucky shall not award a state contract to a person that is a foreign entity required by KRS 14A.9-010.

2 Final RFP 040 2600000030

Our firm was awarded a contract as Complex Litigation Panel Counsel under RFP 040 2500000106, which is effective through June 30, 2026. Given that, I am inquiring whether our firm needs to respond to RFP 040 2600000030, the term of which also appears to run through June 30, 2026.

This is an active solicitation for panel counsel, it will be up to the entity if they would like to submit a bid for this specific solicitation.

Final RFP 040 2600000030

11 Written Questions: On page 11 of the RFP, it states that the written questions are due on August 15 but that the deadline for the proposal is September 17. I am not sure I have clarity on what component constitutes the written questions component. That is, what is due on August 15?

Written questions shall be provided to the RFP contact on or before August 15th. Any questions regarding the RFP after August 15th will not be answered.
