A contract, based on this RFP, may or may not be awarded. Any contract award from this RFP is invalid until properly approved and executed by the KDFWR.
1.3 Agencies to Be Served
This contract shall be for use by the KENTUCKY DEPARTMENT OF FISH AND
WILDLIFE RESOURCES.
SECTION 2 – INTRODUCTION
2.1 Purpose
The purpose of this Request for Proposal (RFP) is to solicit proposals for competitive negotiations pursuant to KRS 45A and all applicable statutes and regulations.
Application of herbicide, as specified in this bid package, shall be in accordance with all terms and provisions specified herein. The treatment areas are within a focal area in the northeastern portion of Franklin County, KY. KDFWR is currently working on identifying a maximum of 300 acres within the focal area that will be treated. The bidder will be responsible for completing aerial herbicide application within the areas designated by KDFWR based on specifications outlined in Section
3.1. Timing of application will be based on leaf fall of over story trees which will allow appropriate herbicide coverage on understory bush honeysuckle. The timing of completing is important to ensure native vegetation has become dormant and invasive bush honeysuckle is still actively growing (green). The date range of the application will be between October 15th and December 15th, 2025. KDFWR will be monitoring site conditions and will notify the contractor when the conditions are suitable for application. The contractor must be able to complete the aerial spraying project within 5 days of notice of the site being ready for application. It will be the responsibility of the bidder to examine and survey the areas on which spraying operations will take place and make their own determination for logistics of completing the herbicide treatment. KDFWR must approve all ingress and egress routes, as well as landing zones prior to the commencement of spraying activities. The bidder is responsible for following all regulations and obtaining all necessary licenses and permits associated with aerial herbicide applications in Kentucky.
SECTION 3 – SCOPE OF WORK
PROPOSALS THAT DO NOT MEET MANDATORY REQUIREMENTS WILL BE
DEEMED NON-RESPONSIVE AND WILL NOT BE CONSIDERED.
Mandatory Requirement means a condition set out in the specifications or statement of work that must be met without exception.”
3.1 Scope of Work/Technical Requirements
The project will use the following herbicide, 41% concentrate aquatic safe glyphosate.
The herbicide will be applied at a rate of 4 quarts per acre at a volume of 5 gallons per acre (which is a solution containing 8.7% active ingredient applied at 5 gallons an acre).
The project will also require an LI-700 surfactant at a rate of 3.2 ounces per acre.
The bidder is required to use the appropriate equipment for herbicide application in a forested setting. The bidder will be required to specify the equipment that they will use, their methods for tracking spray coverage, and will be required to provide an explanation as to the methods they will use to ensure adequate coverage over the spray area (this will need to be included in 5.8-A Executive Summary portion of the bid).
The contractor will also be responsible for providing a shape file reflecting the areas that were treated upon completion of the project.
KDFWR is in the process of identifying private landowners for the project. The actual treatment acres will be determined no later than October 10th, 2026. The goal is to treat up to 300 acres within the projected area. Herbicide and surfactants will be provided by the Franklin County Conservation District.
All operations being carried out by the bidder for spray application under this contract may be suspended by KDFWR if the conditions and requirements contained in this license are disregarded. Continued failure to comply with any one of the stated conditions and/or requirements shall be sufficient cause for cancelation of the contract.
Complaints or disagreements by the bidder as to any actions taken by KDFWR respecting this license shall not be considered unless made in writing within thirty (30) days of such action causing a complaint or disagreement by the bidder to the Director of KDFWR. The decision of the Director shall be final in the settling of complaints and disagreements on the part of the bidder as they pertain to the interpretation of the regulations and provisions of this bid package.
The bidder shall have no right or license to use any part of the area outside the boundary of the area herein described unless the bidder shall have obtained special written permission from KDFWR describing the limitations of such use.
KDFWR, nor any licensee, nor successor, nor assignee of it shall be liable to the bidder for any damages because of the exercise of their rights, however, or by whomever conducted, and that the bidder agrees to hold KDFWR harmless from any claims for such damages on the part of the bidder. KDFWR does not undertake to furnish to the bidder right-of-way over lands belonging to others.

The KDFWR reserves the right not to exercise any or all renewal options. The KDFWR reserves the right to extend the contract for a period less than the length of the above-referenced renewal period if such an extension is determined by the KDFWR Buyer to be in the best interest of the KDFWR.
The KDFWR reserves the right to renegotiate any terms and/or conditions as may be necessary to meet requirements for the extended period.
