About this file

This document is a sample Mock Jury Request Form template that the Securities and Exchange Commission (SEC) intends to use for submitting official requests to the contract awardee. The form captures key information needed to request four types of services: Mock Jury (MJ) exercises, Jury Consultant (JC) tasks, Focus Groups (FG), and Community Attitude Surveys (CAS).

The template includes fields for SEC attorney information, case details, and specific service requirements. For Mock Jury exercises, the default configuration is three panels of 12 jurors each, though this can be adjusted. The form covers scheduling details for up to two MJ exercises, includes options for jury consultant tasks (voir dire assistance, jury selection, and juror research), and allows for scheduling of focus groups and community attitude surveys. All MJ/JC services include up to 4 hours of consultation billable in 15-minute increments. The form concludes with an acknowledgment section regarding contractor-government relationship boundaries and non-personal services requirements.

ACKNOWLEDGEMENT

As an SEC user of the Mock Jury / Jury Consultant Program, please acknowledge you have read and will comply with the following by selecting “I agree” below:

I understand that contractor employees are not SEC government employees, and the contractor vendor is solely responsible for the contractor duty hours, performance evaluations, and leave requests, contractors may not perform certain inherently governmental functions and personal services as described in SEC Regulation 10-24 Management and Administration of Service Contracts and its associated Operating Procedure (OP) and Checklist. Further, I understand that stipulating the contractor employee’s duty hours, requiring the contractor employee to report to a government person for administrative / personal / personnel matters, requiring the contractor employee to complete certain inherently governmental functions, maintaining contractor personnel records, and granting the contractor employee’s leave requests are examples of actions that are grounds for the non-personal services contractor to initiate a claim against the Government. Therefore, I will not exercise relatively continuous supervision or control over the activities of the contractor employee.

Please Note: the CLS EnforceNET Webpage is a resource for managing SEC information concerning contractors. All CLS forms, contact information, contract-related information, frequently asked questions and more can be accessed at EnforceNET/Operations/Legal Services/Contractor Litigation Support Program Office.
