Single Source Justification
(FAR 13.106)
This is a single source acquisition, pursuant to the requirements of 13.106-1(b)(1): Soliciting from a single source for purchases not exceeding the simplified acquisition threshold, in accordance with 41 U.S.C.1901.
1. Agency: U.S. Office of Personnel Management (OPM) Contracting Activity: Office of Procurement Operations Contractor: Lutron Services CO., Inc.
2. Nature and/or description of the action:
Annual preventative maintenance, programming, repair, and provide replacement parts for the Lutron Lighting System, in the Theodore Roosevelt Building (TRB), located at 1900 E Street NW, Washington, DC 20415.
3. Description of the Supplies or Services: Annual preventative maintenance, programming, repair, and provide replacement parts for the Lutron Lighting System. Due to certain programming aspects within the Lutron Lighting System, OPM is looking to establish an annual maintenance and support services contract for onsite services. The contract will help provide further assistance for facilities maintenance in keeping the Lutron Lighting System functional and operational during normal working hours.
Estimated total value: Total value estimated to be $248,350.00
4. Authority: [Check appropriate exception.]
Exception (* = abbreviated) FAR Cite [X] Single Source FAR 13.106-1(b) [ ] Exclusive Licensing Agreement FAR 13.106-1(b)(1)(i) [ ] Urgency FAR 13.106-1(b)(1)(i) [ ] Brand Name FAR 13.106-1(b)(1)(i)
5. Describe how the contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: Due to the proprietary nature of the Lutron Lighting System, Lutron Services is the only contractor that can supply parts and software and has the ability to complete annual preventative maintenance and unforeseen repairs on this equipment.
No other contractors are authorized to contract and deliver these services for Lutron products.
6. Describe the efforts made to ensure that offers are solicited from as many potential sources as practicable: A Request for Information (RFI) was posted, by GSA/Market Research as a Service (MRAS), on 1/28/2022 and 2/7/2022 to verify if any vendor other than Lutron Services can provide the required preventative maintenance, service, and repairs. Only LG Construction responded and stated that it could provide the services if they subcontract to Lutron Services.
The determination was made that only Lutron Services could meet the agency requirement. The Program Office contacted Lutron Services sales representative to provide a market research estimate, and the sales representative confirmed that there were no third-party vendors capable of providing the service.
7. The contracting officer determines that the anticipated cost to the Government will be fair and reasonable because a complete analysis of all costs using audits, commerciality, previous history, or other appropriate means will be fully utilized prior to award.
8. Description of the market research conducted (see FAR Part 10). If no market research was conducted, state the reasons: Lutron Services CO., Inc. provided an estimate for http://uscode.house.gov/browse.xhtml%3Bjsessionid%3D114A3287C7B3359E597506A31FC855B3 http://uscode.house.gov/browse.xhtml%3Bjsessionid%3D114A3287C7B3359E597506A31FC855B3 preventative maintenance and unforeseen repairs of the Lutron Lighting System. In addition, GSA/MRAS posted RFIs that did not identify additional vendors that can complete the required annual preventative maintenance and unforeseen repairs.
9. Other facts supporting the use of other than full and open competition.
None
10. List sources that expressed, in writing, an interest in the acquisition. If no sources expressed an interest in writing, indicate such.
LG Construction expressed an interest, however, was deemed incapable of providing the required services. Lutron Services Company, Inc., is the only source that can provide the required services to OPM’s Lutron Lighting System.
11. Include a statement of the actions, if any, the Agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Market research will be conducted in the future to attempt to remove barriers to competition. This will include verifying strategic sources and ensuring there are not additional vendors capable of providing future preventative maintenance and repairs.
Technical Officer’s Certification: I Timothy Allman, certify that the facts and representations stated in this justification are complete and accurate which form the basis to award this requirement.
