About this file

This is a Justification for Other Than Full and Open Competition document for Solicitation 75H70426Q00025, issued by the Indian Health Service (IHS), Division of Acquisition Policy.

The Indian Health Service seeks to procure Grammarly Business Enterprise Licenses (Base + 4) to support approximately 600 IHS employees with a firm-fixed price contract. The requirement is for an online English writing assistance software tool that provides advanced functionalities including paragraph rewriting for improved readability, comprehensive proofreading for grammatical and typographical errors, and seamless integration across multiple desktop and laptop applications and websites. The Government projects award in September 2026 using fiscal year 2026 funds. The justification notes that IHS currently uses Grammarly through individually acquired licenses and seeks to consolidate these decentralized purchases into an enterprise-managed solution with standardized functionality, governance, and security controls. The acquisition is conducted under RFO FAR 12.201-1 simplified procedures for commercial products and services over the simplified acquisition threshold ($9 million) pursuant to 41 U.S.C. 1901.

During market research conducted in compliance with the Buy Indian Act, the Contracting Officer posted a sources sought notice from May 1-11, 2026, and identified three Indian Small Business Economic Enterprises (ISBEEs) capable of providing the service: FedTribe LLC, JTM Enterprises LLC, and Tek Annoa LLC, each holding valid Grammarly reseller authorization letters. The acquisition will be competed as an ISBEE set-aside. The Contracting Officer evaluated Microsoft Copilot as an alternative but determined Grammarly Business Enterprise provides superior value through specialized writing-assistance functionality, enterprise administration capabilities, and more cost-effective pricing relative to Microsoft's tiered licensing structure.

Rev. 11/14/2025

As part of its consideration of available alternatives, IHS considered Microsoft Copilot as a potential solution. OIT leadership determined that Copilot was not a cost-effective alternative for this requirement due to Microsoft's tiered licensing and pricing structure relative to the writing-assistance capabilities required by IHS. The Government's requirement is specifically focused on enterprise writing assistance rather than procurement of a broader productivity or artificial-intelligence platform. Based on the Government's requirements and market research, Grammarly Business Enterprise was determined to provide the required combination of specialized writing-assistance functionality, enterprise administration, security and privacy controls, and organizational standardization while meeting the Government's operational needs in a more cost-effective manner.
