About this file

This document is a Justification for Other Than Full and Open Competition (Below SAT) for the Indian Health Service (IHS), solicitation number 75H70426Q00004. The procurement is for IBM Server Software Subscription and Support for the National Patient Information Reporting System (NPIRS), which hosts the National Data Warehouse (NDW). The justification emphasizes the criticality of IBM software and hardware for maintaining the existing data infrastructure, with significant software-based algorithms and microcode integrated into the NDW applications and reporting systems.

The document details that IHS already has a substantial investment in IBM products, and changing to another platform would require a major re-write of core applications, potentially causing service disruptions. Market research was conducted under the Buy Indian Act, seeking Indian Small Business Economic Enterprises (ISBEE) who are IBM resellers. Three ISBEEs were found capable of providing the service. The procurement will be competed as an ISBEE set-aside under FAR Part 12, with the estimated contract value redacted. The Contracting Officer certified the justification as accurate and complete, recommending continuation of the IBM software and support to ensure uninterrupted operations of the critical reporting systems.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (Below SAT)

***THIS ONLY JUSTIFIES THE BRAND NAME DESCRIBED AS FOLLOWS ***

Pursuant to Revolutionary FAR Overhaul (RFO) 12.102, for acquisitions valued at or below the simplified acquisition threshold (SAT) using RFO 12.201-1 Simplified Procedures for commercial products and services, the Contracting Officer (CO) hereby documents the decision that only one source is reasonably available.

1. Agency and Contracting Activity.

U.S. Department of Health and Human Services Indian Health Service (IHS), Division of Acquisition Policy (DAP)

2. Description of Action.

Brand Name Justification: IBM Server Software Subscription and Support

3. Description of Supplies/Services and Estimated Cost.

The National Patient Information Reporting System (NPIRS) hosts the National Data Warehouse (NDW) and additional data marts for the Indian Health Service (IHS). IBM DB2 is the foundation that the NDW and its marts are built upon. In addition, NPIRS relies on other crucial IBM software products to fulfill its services. NPIRS provides critical reporting systems that are used in Congressional funding determination. In addition, NPIRS provides specialized data marts for numerous IHS program offices. Access to the services provided by the NDW are available to authorized users 24/7. Overall, the services provided rely upon the IBM family of software products.

Estimated Value (Base + 4):

4. Basis for Decision:

IHS already has a significant number of IBM products, both software and hardware. The use of IBM branded servers and storage maintains the significant past development investment.

The IBM branded hardware is the only known hardware that is compatible with the existing National Data Warehouse (NDW) and its components. Including the operating system, backup and database software. Significant software-based algorithms that rely on the hardware microcode are incorporated in all levels of the NDW applications and reporting. No other applications and database. To change to another platform would require significant development process with a loss of service capability. There is a continuous need for the Server Software Subscription and Support. The renewal and maintenance support are only available from the Original Software Manufacturer, IBM.

5. Market Research

Buy Indian Act Focused Market Research: Pursuant to 48 CFR Part 326, Subpart 326.603-3 and IHM 5.5-6, Indian Health Service must use the negotiation authority of the Buy Indian Act, 25 U.S.C. 47, to give preference to Indian Economic Enterprises (IEE) whenever the use of that authority is authorized and practicable. Therefore, the Contracting Officer used the
