About this file
This document is an Immigration and Nationality Act Certification that the Contractor must complete for a federal contract opportunity. It certifies that the Contractor will comply with all legal provisions related to employing non-immigrant foreign nationals to provide services to the Department of Veterans Affairs (VA) under the contract. The Contractor must ensure that all foreign nationals working on the contract are legally authorized to work in the United States and comply with E-Verify requirements. Failure to comply may result in termination of the contract and the foreign national being prohibited from working on the contract or other VA services.
The related federal contract opportunity is for VISN 23 Laboratory Referral Testing Services. The Department of Veterans Affairs is seeking a single-award, fixed-price, indefinite delivery/indefinite quantity contract for medical laboratory and testing analysis services to be provided to 11 participating VA facilities within the VISN 23 Midwest Healthcare System. The procurement will be conducted using a tiered evaluation process that prioritizes service-disabled veteran-owned small businesses (SDVOSBs), veteran-owned small businesses (VOSBs), and other small businesses including 8(a) and HubZone firms, before evaluating large businesses. The solicitation is anticipated to be posted on or about May 21, 2024, with questions due by May 24, 2024.

Immigration and Nationality Act Certification
The Contractor certifies that they shall comply with all legal provisions contained in the Immigration and Nationality Act of 1952, as amended; its related laws and regulations that are enforced by Homeland Security, Immigration and Customs Enforcement, and the U.S Department of Labor, as these may relate to non-immigrant foreign nationals working under contract or subcontract for the Contractor while providing services to Department of Veterans Affairs (VA). While performing services for the Department of Veterans Affairs, the Contractor shall not knowingly employ, contract, or subcontract with an illegal alien or any foreign national non-immigrant who is in violation their status for any reason.
Additionally, the Contractor is required to comply with all “E-Verify” requirements consistent with “Executive Order 12989” and any related Amendments, as well as applicable Federal Acquisition Regulations.
Any failure by the Contractor to comply with any requirements outlined above will provide the VA with grounds for termination for breach of the contract and the VA may, at its discretion, require that the foreign national who failed to maintain their legal status in the United States or otherwise failed to comply with the requirements of the laws administered by Homeland Security, Immigration and Customs Enforcement, or the U.S Department of Labor, shall be prohibited from working at the Contractor’s place of business that provides the VA services as well as from any other place where the Contractor provides services to Veterans who have been referred by the VA.
The Contractor agrees to obtain a similar certification from its subcontractors.
