ATTACHMENT 3 – Basis of Award & Proposal Instructions W9127Q-23-R-0021 Audio / Visual Equipment

I. BASIS of AWARD

A. Lowest Price Technically Acceptable (LPTA).

The award will be made to the lowest priced technically acceptable proposal in accordance with FAR part 13, Simplified Acquisition Procedures. Proposals will be evaluated for technical acceptability but will not be ranked using the non-price Factors (and Subfactors). In order for an Offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price Factor. A proposal receiving a rating of “Unacceptable” in any non-price Factor will not be eligible for award.

The evaluation criteria detailing the Factors and Subfactors for Audio / Visual Equipment & Installation are detailed below and incorporated in this RFP by reference. Each technical sub-factor within each factor is of equal importance.

B. Evaluation Criteria Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and sub-factors described. Proposals shall be clear, concise and include sufficient detail for effective evaluation. Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the Offeror’s proposal. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet these requirements.

The following evaluation factors and sub-factors should be in each proposal section as described below; each section will be used to evaluate each proposal: Government intends to make award without discussions.

II. PROPOSAL INSTRUCTIONS

A. PROPOSAL FORMAT

Purpose: These instructions prescribe the format of proposals and describe the approach for the development and presentation of the proposed data. The proposal shall include all the information requested in the specific instructions. Failure to include all information requested may adversely affect the evaluation.

A proposal that merely reiterates or promises to accomplish the requirements of the RFP will be considered unacceptable. A proposal that is orderly and sufficiently documented will be easy for the Government to understand and will enable the Government to perform a thorough and fair evaluation.

Offerors are cautioned to submit enough information to enable the evaluation committee to fully ascertain each offeror’s capability to perform all the requirements contemplated by this solicitation. All commitments made in the proposal may become a part of the resultant contract.

The data submitted with each proposal should be complete and concise, but not overly elaborate.

Excessive reliance on promotional brochures is discouraged.

B. Proposal Package Contents shall be structured according to:

Section I – Combined Synopsis/Solicitation and Pro Forma Documents, including Certifications and Representations as necessary – All potential offerors are required to be registered in the System for Award Management and be publicly visible prior to proposal submission. See FAR Provision 52.204-7 System for Award Management at http://www.sam.gov.

Further, all Offeror representations and certifications must be current and accurate in the System for Award Management at the time your proposal is submitted in response to this combined synopsis/solicitation.

This section shall provide an introductory page to include offeror’s demographic information, SAM.gov Entity Unique Identifier (EUI), Tax Identification Number (TIN), points of contact, authorized negotiators, contact phone, and email addresses. Also, include business socioeconomic status, e.g., small business, woman-owned small business, HUBZone small business, etc. As well as overall required office certifications that indicate authorization to operate as a medical clinic.

Representations and Certifications located in Attachment 1-Provisions and Clauses W9127Q-23- R-0021 are required in FAR 52.212-3 with Alternate I. Return/Include this Clause with this Section I, whether from SAM.gov or completed for this purpose. All other required representations and certifications are to be completed on line in the System for Award Management (SAM) www.sam.gov.

All potential offerors must be register in the System for Award Management and be publicly visible prior to proposal submission. See FAR Provision 52.204-7 System for Award Management.

Section II - Price Offering The resulting award will be a Firm-Fixed Price contract awarded based on competition and price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort Adjectival ratings shall not be used for offerors’ Price proposals.

In accordance with Federal Acquisition Regulation (FAR) 15.402 and 15.403-1, certified cost or pricing data are not required since adequate competition is expected for this procurement. If adequate competition is not obtained, the Contracting Officer may incorporate FAR 52.215-20 entitled, “Requirements for Cost or Pricing Data or Information Other Than Cost or Pricing Data,” into the solicitation and request a Certificate of Current Cost or Pricing Data.

This Section shall be organized as follows: Offeror shall provide a Firm Fixed Price (FFP), for each CLIN on Attachment 2 - PROPOSAL FORM Audio Visual Equipment & Installation in the Combined Synopsis/ Solicitation package. Each CLIN is broke out by multiple classrooms.

Offeror shall provide individual classroom price and total the classrooms associate with the specific CLIN for a total Building price.

Note Attachment 2A - PROPOSAL WORKSHEET- Audio Visual Equipment & Installation with tab for each building with details for each classroom is provided for your assistance. Individual material pricing is not required for submission; only classroom total and building total. The Price Offering shall include all costs of all labor, materials, mailing/shipping, etc. Offeror must submit the Proposal Form; the Proposal Worksheet is not required for submission.

Failure to comply with the RFP requirements for Pricing information may result in an adverse assessment of an Offeror’s proposal and reduce or eliminate its chance of being selected for award. Offerors shall ensure that the information presented in this part is consistent and correlates with the information contained in other proposal documents from the Offeror.

Section III – Technical Capabilities The offeror's technical proposal shall be evaluated on an Acceptable/Unacceptable basis. Offerors who rate unacceptable in Technical will be removed from further consideration for award. Price will be evaluated to determine reasonableness of the proposed price. Unreasonable, Offers shall not be selected for award.

TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS

Rating Definition

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

Subfactor 1: Organizational Chart and Key Personnel to be utilized for this project.

Subfactor 2: Summary of Technical Approach for installation for this Project. 1 or 2 pages is sufficient. Include material acquisition lead time, installation lead time and potential challenges. Should offeror deviate from the material list provided on the worksheet & PWS, Offeror must provide their listing and a reasoning for the change. It is understood the material list provided takes into account existing Audio Video equipment and connections already in place in some of the classrooms.

Past Performance Information Though Past Performance information is not requested for this requirement, Offerors are advised that the Government may use all data obtained from other sources available to the Government to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program/Project Managers and Contracting Officers or rely upon personal business experience with the offeror. The Government reserves the right to obtain and evaluate past performance information from any source it deems appropriate.

C. Proposal Packages Submission: Packages should be EMAILED. However, mailed or hand delivered is acceptable, but emailed is preferred. Facsimile proposals WILL NOT be accepted.

1. Emailed proposal submissions should be divided into one attachment per “Section” Proposals must be received in the office as provided in the solicitation NLT.

If offeror is submitting proposal package via delivery method, they must submit one (1) original & one (1) printed copy and one (1) CD to be mailed, or hand delivered. E-Mailed notification of mailed or hand delivered proposal submission must also be provided.

2. Mailed or hand delivered submissions shall be bound in one binder; have one (1) original Binder and one (1) copy binder and one (1) CD. Each Section shall be tabbed and labeled at a minimum, according to Sections listed above.

Hand delivered proposals MUST include a Compact Disc (CD), USB thumb drives ARE NOT authorized. Envelope must read:

Proposals may be received early; however, they will not be accepted after 2:00 PM on Friday, September 8th. Contractor is responsible for following up to ensure proposals are received in the USPFO P&C Office by the due date/time stated above. Proposals must include a statement that pricing is valid for at least 60 days after proposal’s closing date/time.

D. Request for Information All questions must be submitted in writing (email preferred) to the e-mail address identified for receipt of proposals. Questions can be submitted no later than 4:30 p.m. local (CST) time on Thursday 14 September 2023 (3 business days prior to close date/time).

Interested offerors must be registered and visible in the System for Award Management (SAM) prior to proposal submission. To register go to: https://www.sam.gov/portal/public/SAM.

E. DISCUSSIONS

GENERAL INFORMATION. In accordance with FAR 15.306(a), it is the government’s intent to make award without discussions.

FAR 15.306 - Exchanges with offerors after receipt of proposals.

(a) Clarifications and award without discussions.

(1) Clarifications are limited exchanges, between the Government and offerors, that may occur when award without discussions is contemplated.

(2) If award will be made without conducting discussions, offerors may be given the opportunity to clarify certain aspects of proposals (e.g., the relevance of an offeror’s past performance information and adverse past performance information to which the offeror has not previously had an opportunity to respond) or to resolve minor or clerical errors.

(3) Award may be made without discussions if the solicitation states that the Government intends to evaluate proposals and make award without discussions. If the solicitation contains such a notice and the Government determines it is necessary to conduct discussions, the rationale for doing so shall be documented in the contract file (see the provision at 52.215-1) (10 U.S.C.2305(b)(4)(A)(ii) and 41 U.S.C. 3703(a)(2)).
