Information on these hazards can be found in Occupational Safety and Health Standards 1910.1025 (lead), 1910.1026 (Hexavalent Chromium) and 1910.1027 (Cadmium).

6.4 Test and Evaluation/No Fault Found/Beyond Economical Repair (BER)

6.4.1 Test and Evaluation /No Fault Found. If, after visual and functional inspections, an item is discovered to meet manufacturer’s minimum performance specifications as designated by the CMM or OEM’s ATP and requires no parts or labor, the Contractor shall be allowed the firm-fixed price for Test and Evaluation/No Fault Found Fee in the Schedule. The Contractor shall prepare and include a Failure Data Report as described in paragraph 6.1, with all returned components, including the USCG’s reported failure and the fact that no fault was discover.

The Contractor shall prepare and include a Failure Data Report as described in paragraph 6.1. When the determination that the assembly shall be BER, the part and the accompanying paperwork must be clearly marked BER and returned to the USCG ALC for proper disposition.

Note: The USCG typically considers an item BER when the cost to repair exceeds 65 percent of the price of a new unit; however, the USCG is not bound with this percentage and will make all final BER determination.

6.5 Scrap Items. When an item is determined to be scrap, the Contractor shall provide written notification to the KO. The notification shall list the Task Order Number, CLIN, NSN, PN and S/N with a brief description supporting the determination. 6.8 Separately Priced Replacement Parts. Pricing for other repair components and supply material, yet unspecified by part number at contract award, will be incorporated as firm fixed prices after negotiation of the first-time replacement. The Government reserves the right to provide separately priced replacement parts as Government furnished property on an as-needed basis as determined by the KO. The KO will either issue a modification to the task order authorizing use of the separately priced replacement part(s) or provide disposition instructions.

The delivery schedule will be adjusted accordingly for any delay associated with requesting and obtaining the approval to utilize the specified separately priced replacement part(s).

7.0 Pricing Exclusions – Unusual Damage.

7.1.1 General.

The USCG intends that all components specified in the schedule of supplies/services will be shipped for the repair within the firm-fixed prices established in the Schedule of Supplies/Services. Those components may be determined unusually damaged. To be determined unusually damaged, a component must be received for routine repair and upon evaluation any one of the following conditions are discover:

Obvious misuse Crash damage Acts of God

Only components meeting one or more of the above criteria may be consider as Unusually Damaged. Missing piece parts does not include the parts that are to be systematically change out per the CMM; the USCG shall not be charged for these parts. All other components shall be repaired IAW the firm fixed repaired prices established in the Schedule of Supplies/Services.

7.1.2 Unusual Damage Evaluation.

When a component is process for Unusual Damage Evaluation, the Contractor shall immediately notify the KO in writing. The Government may request the Contractor to submit an inspection condition report, pictures of the damage, and a repair quote listing all parts and labor cost needed to return the component to satisfactory condition that meets OEM CMM specifications. The quote shall include the Task Order Number, Line Item, NSN, P/N, and S/N of the component.

The Contractor’s delivery obligation shall stop from the date of notification that an item has been determined to be a candidate for “Unusual Damage Evaluation.” The delivery obligation will be specified in the Task Order modification and will apply only to those items specifically addressed by the modification. The Contractor is obligated to deliver all other components not individually addressed by the modification under the original delivery date specified on the Task Order. The quote shall not include the work involved in the teardown and inspection, which will have already occurred, as this is cover by the firm-fixed price specified under Contract Line Item Number (CLIN) 0001 and subsequent CLINs for each contract period of performance.

Within thirty (30) days after receipt of the Contractor’s written proposal, the KO will make a written determination (Subject to the Disputes clause) as to whether the component is determined to be “Unusually Damaged”. If the KO determines that an excluded items is considered BER, no Unusual Damage charges will apply. The KO will either initiate negotiations for a firm-fixed price with the Contractor or deny authorization for the repair based on the information in the report and any other information which may be available. Upon mutual agreement as to the price and delivery, a Task Order modification will be issued authorizing the repair at the agreed upon terms. The labor rate shall be at the Firm-Fixed Labor Rates priced in Schedule for Supplies/Services at the contract base/option period associated with the request starting with CLIN 0003 and subsequent option period CLINs. If repair is not desired, the KO will provide the Contractor with disposition instructions for the un-repaired components.

7.2 Technical Support Services. The Contractor shall maintain a permanent presence in the United States, staffed with qualified, English speaking technical support personnel.
