5.2 Place of Performance

The work specified in the SOW shall be performed at USCG, ALC, Elizabeth City, North

Carolina. Under special circumstances, additional locations may be identified by the COR.

5.2.1

The Government reserves the right to require contractor personnel to “sign-in” upon entry and

“sign-out” upon departure from the Government facilities. Certain Government agencies may have security requirements, which necessitate the use of building access passes. No direct charges to any order or order issued under the contract may be made for personnel or facility security clearances.

5.3 Work Hours

The work hours under this contract are Monday through Friday from 0645 to 1515 Eastern Time

(ET). However (and at COR discretion), in order to support the USCG’s operational schedule and aircraft availability, the work hours for the contractor employees may fall outside of the standard eight (8) hour day, Monday through Friday or may include weekends, alternate work schedules and occasionally night work.

5.3.1

Contractor employees may choose to work additional hours to complete tasks, with COR approval, as long as Government oversight is available. Hours over forty hours in a week are not considered overtime for employees under this contract.

5.3.2

Contractors may choose to make up hours missed due to leave, plant closures, delays, or other reason, with COR approval, as long as Government oversight is available. This time will not constitute overtime for employees or anyway obligate the Government to additional costs.

5.3.3

The COR will attempt to notify the contractor a minimum of fourteen (14) days prior to changes in the contractor employees standard work schedule. However, due to the USCG’s ever changing operational schedule, the fourteen (14) day notice may not be possible.

5.3.4

The Government may opt to change the work schedule to make up for time lost due to Federal

Holidays or Plant Shutdowns. The COR will notify the contractor as soon as possible of any schedule changes for Federal Holidays or Plant Shutdowns.

5.3.5

The Government’s expectation is that the employees under this contract will work a minimum of

240 days per period of performance (defined in section 5.1) under this contract. When any contractor employee is excessively absent (more than 20 days during any period of performance or a position is vacant, the USCG will subtract a daily rate for each day the employee was absent from the monthly invoice. Any deviations to this policy will require Contracting Officer approval. The daily rates for each task order period of performance will be established at time of task order award by dividing the monthly firm-fixed price by twenty-one (21).

5.3.6

The contractor shall notify the COR of any planned vacation or other scheduled leave two (2) weeks prior to the scheduled leave. The contractor shall notify the COR as soon as possible of any other absences.

5.3.7

Contractor employees are not authorized early release (often called 59 minute time off awards).

When early release is authorized for Government employees, every effort will be made to provide Government oversight so the contractor employees can continue work. However, if this is not possible, the contractor employees shall follow their employer’s procedures for time not at work.

5.4 Contractor Visits

The contractor shall not make any unannounced visits to the ALC. The contractor shall submit a request through the Contract Specialist and COR. Once approved, the COR will submit a Visitor

Request IAW the security requirements of the complex.

5.5 Federal Holidays

Contractor personnel shall not perform work on observed Federal holidays. Government holidays are: New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Juneteenth

National Independence Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Day, and/or any other day designated by the President’s

Proclamation/Executive Order.

5.6 Closures and Delays

Closures or delays may be planned or unplanned. Plant shutdown/delay, plant closure/delay, base shutdown/delay, or base closure/delay are all treated the same for contractor employees under this contract.

5.6.1

During a closure ALC is closed for business and contractors are not allowed to be onsite.

Planned closures will be determined in advance by the ALC Command and could include the day after Thanksgiving and other days immediately preceding or following other holidays.

Unplanned closures (i.e. inclement weather, etc.), not normally exceeding twenty (20) hours per employee per year, may occur on an as needed basis.

The contractor will be notified as soon as possible of any unplanned closures; however during times of inclement weather, contractors will be advised to monitor the inclement weather number at (252) 335-6188 option 2, for information on closures.

5.6.2

During a delay, contractor employees shall follow the directions given on the weather line. The message will typically either say there is a delay of x amount of hours or that ALC will open at a certain time. ALC’s normal start time is 0645, so if the message states that there is a delay of x amount of hours, the employee shall arrive that many hours after 0645. (For example a two hour delay would result in employees arriving at 0845). If the message states that ALC will open at a given time (For example 1000), then they should arrive at that time (or their normal work time if later). Contractor employees SHALL NOT arrive before these times as no Government oversight will be available. Contractor employees will not be allowed to stay late to make up these hours, unless prior Government concurrence is obtained to ensure Government oversight is available.

5.7 Contractor Sponsored Functions

All contractor company functions (training, social gatherings, etc.) shall be conducted outside business working hours, at the contractor’s expense and off the Elizabeth City USCG Complex.

5.8 Government Sponsored Functions

Government sponsored functions (to include ALC and USCG sponsored functions) are not deemed to be part of the contractor’s normal duties (i.e. holiday gatherings, USCG Day, ALC ceremonies, etc.). The USCG will make every effort to give the contractor employee the option to work in lieu of attending the function. In the event that the Government is unable to continue normal operations or if the contractor employee attends the Government sponsored function, they shall follow their employer’s procedures for time not at work.

5.8.1

Meetings required for the performance of duties scheduled in the assigned work center on an as required basis are acceptable during the work day.

5.9 Inspection and Acceptance

All work is subject to Government Quality Assurance (QA) review in process and upon completion for compliance with requirements, instructions, specifications, shop practices and procedures. Any work that is considered unsatisfactory shall be corrected at no additional cost to the USCG. Work will not be accepted by the Government until the COR considers all work complete and acceptable.

5.10 Delivery Schedule

Services and reports shall be delivered in accordance with section 2.0 or as specified by individual task orders.
