The contractor must properly complete Uniform Hazardous Waste Manifests (EPA Form 8700-22) and submit them to both the HWC and EPA eManifest system. Certificates of Disposal must be forwarded to the HWC within three months of waste receipt at the disposal facility and include container details, treatment/disposal dates and methods, EPA Treatment Code Numbers, and facility location information. The contractor is responsible for correcting any errors in packing, labeling, or shipping, including associated costs, and for cleanup of any spills or accidental releases resulting from contractor negligence.

Statement of Work

2026 Hazardous Waste Removals for:

U.S. Horticultural Research Laboratory

2001 South Rock Road

Fort Pierce, FL 34945

Project:

Removal of hazardous, universal, and selected non-hazardous waste from U.S. Horticultural Research Laboratory (USHRL), Fort Pierce, FL

General Information

1.0 Scope of Work:

The Contractor shall properly profile, manifest, stabilize, remove, and transport all hazardous, non-hazardous, and universal waste materials listed on the provided inventories from U.S. Horticultural Research Laboratory (USHRL) to a federally approved hazardous waste or universal waste disposal site.

Place of Performance: USDA/ARS U.S. Horticultural Research Laboratory, 2001 South Rock Road, Fort Pierce, Florida 34945

Period of Performance: Disposal to be completed by June 30, 2026.

2.0 Background

As a research facility, the U.S. Horticultural Research Laboratory produces a varying amount of hazardous waste and maintains a Small Quantity Generator (SQG) status as defined by the Resource Conservation and Recovery Act (RCRA) of 1976. The USHRL must remain in compliance with all federal and state hazardous waste regulations described in Title 40, Code of Federal Regulations Parts 260-268, adopted and incorporated by reference in Rule 62-730 of the Florida Administrative Code. Per the facilities’ hazardous waste generator status, the USHRL is required to have any hazardous waste that has accumulated in the Marshalling Area, disposed of every 180 days.

The Agricultural Research Service (ARS) recognizes its responsibilities to ensure that its facilities comply with existing regulations imposed upon entities which generate, transport, store, treat, and dispose of hazardous chemical wastes. The Agency has a need to contract for hazardous, non-hazardous, and universal waste disposal services, from the private sector. The Agency acknowledges that the field of hazardous waste disposal is a dynamic and ever-changing industry which is significantly impacted upon by Federal, State, and Local regulations and by the influx of new technological developments. It is, therefore, mandatory that the successful Contractor demonstrate a high level of competence and technical expertise comparable to that obtained through extensive experience and aggressive compliance with appropriate hazardous waste management regulations as well as complying with Federal procurement regulations. The contractor must comply with all applicable Federal, State, and Local regulations governing the handling, characterizing, stabilizing, packaging, labeling storing, transportation, and disposal of hazardous waste chemicals and other nonregulated materials.

Contractor Requirements

3.0 Technical Requirements / Tasks

The contractor shall furnish all properly trained labor, materials, safety equipment, stabilization of chemicals, containers, transportation, licenses, special permits, and supervision (including a high-hazard chemist if required) to properly remove and dispose of any Hazardous, Non-Hazardous, and Universal waste and their containers from the USDA, U.S. Horticultural Research Laboratory, 2001 South Rock Road, Fort Pierce, FL 34945 Hazardous Waste Marshaling Area. The contracted company provides all shipping containers (meeting Department of Transportation shipping specifications), stickers, packing material, and transport manifests. Quotes must indicate the price for the labpack of all items including cost of appropriate personnel to stabilize any chemicals, including high hazard chemicals, for transport.

The Contractor shall monitor, maintain, and remove any materials, waste (by-products), etc., generated as a result of work performed in accordance with this contract. All such activities must be performed in accordance with applicable Federal, State, and local regulations. The Government will not be liable to the Contractor for the cleanup of spills or any accidental releases to the environment occasioned through the fault of the Contractor or their Subcontractor.

Pickup Procedures: Before arriving, Contractor personnel shall receive a list of waste to be removed.

Contractor personnel shall determine if each waste listed is identified to meet transportation and disposal requirements. Once onsite work begins, transport shall be completed within three Federal workdays. The Contractor's personnel shall wear all protective clothing and equipment necessary to handle and move waste safely. The Contractor shall sort waste by hazardous properties, pack, label, and transport the waste materials to a disposal site approved by the receiving State and EPA, in DOT-approved shipping vehicles in accordance with applicable Federal and State regulations for such shipments. Each container for shipment shall be labeled clearly.

4.0 Government Furnished

The Contractor shall be provided a list (in MS Excel) of all materials to be removed from the U.S.

Horticultural Research Laboratory, and their bid will represent the total cost of disposal of the listed materials.

5.0 Deliverables / Schedule

7.0 Contractor’s Key Personnel

The contractor shall supply qualified staff for the safe removal of all listed wastes. Personnel shall be trained in Hazardous Waste Operations and Emergency Response procedures should a spill occur.

8.0 Security Requirements and Work Schedule

Contractor staff will be required to coordinate with USHRL Hazardous Waste Coordinator on pick-up times and schedules, Monday-Friday (7:30am to 4:00pm are anticipated) excluding federal holidays.

9.0 Data Rights and Dissemination

Manifest Preparation and Shipping Data: The Contractor shall provide all data required for waste transportation, treatment, or disposal, and for completion of annual hazardous waste generator reports if required by the regulatory agency or jurisdiction. Uniform Hazardous Waste Manifests (EPA Form 8700-22 or latest revision thereof) shall be properly completed by the Contractor for each waste and shall list each transportation container including any nonhazardous waste or hazardous materials shipped. All manifest information shall be neatly printed or typed and minimally contain that information required by applicable Federal, State, and local hazardous chemical waste regulations.

Waste manifests shall be submitted to Hazardous Waste Coordinator HWC) for review and signatures during routine operating hours and prior to the shipment of waste off-site. The manifest shall be signed by the Contractor's transporter in the presence of the USHRL HWC. Correction of errors in packing, labeling, or shipping shall be the responsibility of the Contractor. Costs associated with these errors shall also be the responsibility of the Contractor. All manifests shall also be submitted to the EPA eManifest system.

Certificates of Disposal: The Certificates of Disposal shall be forwarded to the HWC within three (3) months of the date the waste was received at the disposal facility. The Certificate of Disposal shall: list each container received at the treatment or disposal facility; document the date and method of treatment or disposal and include the appropriate EPA Treatment Code Number if available; and list the name and location of the treatment/disposal facility. The Government recognizes that Certificates of Disposal may take up to twelve (12) months to be received due to the lack of incineration capacity. The Contractor is expected to make every effort to provide certificates as quickly as possible, and shall report to the HWC, on a quarterly basis, the status of pending certificates of disposals. If waste is disposed of in a secured chemical landfill facility, the Certificate of Disposal shall also indicate the location within the landfill where the waste container was buried through the use of cell numbers, coordinates, or other appropriate identifiers. All certificates shall also be submitted to the EPA eManifest system.
