Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C776-24-AP-2097

Contracting Activity: The Department of Veterans Affairs (VA), Veterans Health Administration (VHA) Program Contracting Activity Center (PCAC), is conducting this acquisition for the VHA Office of Healthcare Engineering (HEFP).

Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Schneider Electric’s Power Monitoring Expert (PME) with Enterprise Energy Manager (EEM) and Advanced Visualization Module software (most current verions) and advanced utility meter data hosting services (hereafter referred to within this document as metering software and data hosting services). The expected period of performance is ten months. However, the contract will include FAR clause 52.217-8 – Option to Extend Services which allows services to be extended for a period not to exceed six months.

Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

VHA is required to maintain an Advanced Utility Metering System (AUMS) in accordance with the Energy Independence and Security Act (EISA) of 2007 and the Energy Act of 2020. EPA’s Federal Energy Management Program (FEMP) has been delegated the responsibility to provide metering guidance to Federal facilities.

VA Directive 0055, requires VHA Medical Centers with significant electricity, water, chilled water, steam, and natural gas loads as defined in VA’s Metering Implementation Plan to be sub-metered.

VHA began using Schneider Electric’s metering software and advanced utility meters during its metering pilot project which concluded in 2010. It has been using Schneider Electric’s advanced utility meters and the most current version of Schneider Electric’s metering software since the metering pilot project. The meters and software meet VA’s Office of Construction and Facilities Management master specification requirements Section 25-10-10

– Advanced Utility Metering System (AUMS).

d. The nature of an AUMS requires the advanced utility meters and the metering software to be compatible. VHA currently has approximately 4,100 Schneider Electric advanced utility meters installed in VHA facilities across the United States.

e. VHA is required to maintain historic metering data to track utility consumption over time.

VHA’s historic metering data resides on Schneider Electric’s hosting server.

f. Because of VHA’s long-term use of Schneider Electric’s meters and its metering software, and the need to maintain the historic metering data that resides on Schneider Electric’s server, VHA is only considering metering software and data hosting services specific to Schneider Electric. No other metering software and data hosting services will meet VHA’s needs for this requirement.

4. Description of market research conducted and results or statement why it was not conducted:

a. The market research conducted found that this acquisition is suitable for an open market unrestricted brand-name solicitation using FAR part 13 simplified acquisition procedures.

b. Historically, the metering software and data hosting services were provided under a wider-scope AUMS Support Services Contract. VHA is conducting a comprehensive assessment of its AUMS. During the comprehensive assessment and metering support services contract is not required. However, VHA must continue to pay for the software and data hosting services while it conducts the comprehensive assessment to avoid losing historic and current metering data, and to remain in compliance with EISA 2007 and the Energy Act of 2020, as well as VA Directive 0055.

c. Schneider Electric has licensing agreements with small business firms that allow them to sell the required metering software and data hosting services. However, the limited scope of work in this requirement makes it unsuitable for any type of small business set-aside as there are insufficient non-proprietary services to enable a small business to meet the limitations on subcontracting requirements of FAR Part 19 and VAAR Part 819. Accordingly, no type of small business set-aside is appropriate for this acquisition. Any firm authorized by Schneider Electric to provide the required metering software and data hosting services may compete on this requirement.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

Contract award is contingent on a determination of price reasonableness in accordance with FAR 13.106-3.
