SOLE SOURCE JUSTIFICATION FOR
ACQUISITIONS WITHIN THE SIMPLIFIED ACQUISITION THRESHOLD ($250K)
UP TO FAR 13.5 THRESHOLD ($7 MIL)
1. In accordance with Federal Acquisition Regulation 13.106-1(b)(1) – actions up to $250k or 13.501(a) – actions up to $7million, I hereby determine that the Cummins Diesel Engine Parts and Service listed on MAPR617-522000024 is available from only one source, and competition is precluded for the reasons indicated below. There are no substitutes available.
2. This acquisition is restricted to the following source:
Cummins Sales and Service 14775 Wicks Blvd.
Attn: Tom O’Connor, Marine Account Manager, Pacific Region San Leandro, CA 94577 Phone: 510-347-6614 Email: tom.j.o’connor@cummins.com Alternate email: salesandservice.cummins.com
3. The Original Equipment Manufacturer (OEM) spare parts and certified technician for service calls for maintaining the diesel engines aboard the Suisun Bay Reserve Fleet watercraft is estimated to cost $XXXXX and is required to begin 6/28/2022 for a 1 year base period and four option years to conclude, if all option period are exercised, on 6/27/2027.
4. Market research was conducted by searching the Internet for potential suppliers of genuine OEM Cummins marine diesel engine parts and contacting Cummins Inc. directly.
• Cummins Inc. is the only company that supplies all engine parts and service for all six of our engine models.
• Two other companies (Svendsens Bay Marine and J&H Marine) do provide genuine parts and manufacturer-authorized service, however, only for the smaller engines in our watercraft fleet.
• Other potential providers found on the Internet were found lacking because they:
o specialize in truck parts, not marine diesel engine parts, o do not serve all six of our engine models, o can only provide basic parts that are mostly after-market, like starters and filters, and not the full line of OEM parts required.
Since a turn-key solution is sought for this procurement, only one source was found that meets the requirements of providing a full line of OEM marine diesel engine parts and service for all SBRF’s watercraft engines - Cummins Inc.
5. Check and fill in all that are applicable:
The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment is various watercraft vessels with diesel engines manufactured by Cummins Inc.as follows:
QSK19-M-T3 (FS-65 MARY ANN)
QSL9 (PG-615, PG-616)
QSB6.7 (PF-612, PF-613)
QSB5.9 (PF-610, PF-611)
QSB4.5-C110 T4i (crane aboard FS-65) Onan 27.5MDKBT (diesel genset aboard FS-65)
For warranty and reliability reasons, only OEM parts and manufacturer-qualified service technicians have been used for the maintenance of these engines. Marine diesel engines are more specialized than motor vehicle and land-based commercial engines, therefore, a manufacturer-supplied solution for engine maintenance and repair is the most prudent course.
CERTIFICATION
I certify that statements checked, and information provided above are complete and correct to the best of my knowledge. In accordance with FAR 13.106-1(b)(1). The facts of this acquisition preclude the use of full and open competition.
