1. AUTHORITY FOR SOLE SOURCE PROCUREMENT

This sole source justification is prepared in accordance with **FAR 8.002 - Priorities for Use of Government Supply Sources** and **FAR 6.302-5 - Authorized or Required by Statute.**

- FAR 8.7 - Acquisition from Nonprofit Agencies Employing People Who Are Blind or Have Other Severe Disabilities

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED

Comprehensive floor care services including cleaning, stripping, waxing, buffing, and maintenance for several buildings at WPAFB, AREA A.

3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED

The Government requires professional floor care services to maintain federal facilities in accordance with established cleanliness and safety standards. Services include:

- Routine floor cleaning and maintenance

- Periodic deep cleaning, stripping, and refinishing

- Emergency cleaning services as required

- Supply of cleaning materials and equipment

- Quality control and supervision

4. STATUTORY REQUIREMENT FOR SOLE SOURCE

**FAR 8.002** establishes a mandatory priority system for Government supply sources:

*"Except as required by law or as otherwise specified in this part, agencies shall satisfy requirements for supplies and services from or through the sources and publications listed below in descending order of priority: (a) Supplies: (1) Agency inventories; (2) Excess from other agencies...; (3) Federal Prison Industries, Inc.; (4) **Supplies which are on the Procurement List maintained by the Committee for Purchase From People Who Are Blind or Have Other Severe Disabilities.**"*

**Legal Mandate:** The Javits-Wagner-O'Day Act (41 U.S.C. § 8504) requires that floor care services, when available through the AbilityOne Program, **must** be purchased from participating nonprofit agencies.

5. RATIONALE FOR SOLE SOURCE

A. Mandatory Source Requirement

- Floor care services are included on the AbilityOne Procurement List

- NIB Participating Agency is an authorized AbilityOne contractor

- No competitive procurement is authorized when mandatory sources can satisfy requirements

- Failure to use AbilityOne would violate statutory requirements

Contracting Officer Determination: The proposed sole source award to Ability One AKA NIB Agency is legally required and justified under FAR 6.302-5 and FAR 8.002.
