PERFORMANCE WORK STATEMENT (PWS)
SNOW REMOVAL AND ICE CONTROL SERVICES AT PEWARS AND WESTVIEW SITES
1.0 General Information.
1.1 Scope of Work. This is a non-personal services contract to provide snow removal and ice control services at the following locations: 1) Pittsburgh Engineer Warehouse and Repair Station (PEWARS), 3500 Grand Avenue, Pittsburgh, PA 15225; and 2) The West View COOP Site, 100 Valley Hi Drive, West View, PA 15229.
The contractor shall furnish all supervision, material, equipment, labor, and other items and services necessary to perform snow removal, ice removal and ice control services for the PEWARS installation, which encompasses approximately 50,000 square feet of parking area, 2,500 feet of roadway, and approximately 5,500 square feet of sidewalks, loading docks, exterior stairs, building entrances, emergency exit doors, handicap ramps, flagpole area, fire hydrants and Security Guard area, and the West View COOP Site, which encompasses approximately 3,500 square feet of parking area and 2,750 feet of roadway. The contractor shall also provide on-site pretreatment prior to each storm event as requested by the COR, and must be prepared to start work and provide continuous services until each storm event has ended and all areas are clean and free of snow and ice.
Note that any drawings or maps provided to the Contractor, either before or after the contract is awarded, are for reference purposes only and may not be to scale. Any square footage, or other measurement provided, may be an approximation. It is the sole responsibility of the Contractor to determine or verify the actual site conditions and measurements.
This work includes, but is not limited to, the following tasks to be performed for each storm event as requested and may require multiple applications of de-icing agents to maintain melting or refreezing ice to ensure safety conditions at all locations noted:
Snow/ice removal/ice control from all building entrances, sidewalks, ramps, loading docks, fire hydrants, flagpole area, emergency exit doors, dumpster, handicap ramps, parking areas to each building and all structures on the installation (guard house, warehouses, etc.).
Snow/ice removal/ice control from main roadways, and access roads leading to loading docks and parking lot structures.
Snow/ice removal/ice control access to all parking lots Continuous ice control services to all entrances, exits, sidewalks, ramps, decks, docks, steps, parking lots, etc. (may require multiple applications of de-icing agents to maintain safety conditions at all locations).
Removal of snow to on-site locations approved by the COR.
Completion of services before the start of normal working hours, if applicable.
The government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the government. This is a fixed priced, performance based service contract where the government defines and measures desired outcomes, while contractor methods are generally not constrained or directed.
1.2 Period of Performance. The period of performance shall be from contract award through 30 April 2021.
1.2.1 Hours of Operation. The government’s regular working hours for PEWARS are from 5:30 A.M. to 5:30 P.M. Monday through Friday. The government’s regular working hours for West View are from 8:00 A.M. to 4:30 P.M. Monday through Friday.
During inclement weather/storm emergencies, regardless of hour or holiday, the Contractor shall be onsite to perform services as directed by the COR or designated representative and shall continue without interruption until the storm emergency is complete and the installation is clean and free of snow and ice.
1.2.2 Recognized Holidays. Any reference to holidays shall be construed to mean the Government holidays listed below:

When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the proceeding Friday will be observed as a legal holiday.
1.3 Contractor Personnel
1.3.1 The contractor shall perform all work under this contract using its own forces except as provided in Paragraph
1.4.2 Subcontracting. Employees who perform this work shall be qualified persons on the contractor’s own payroll.
1.3.2 Subcontracting. The contractor shall not subcontract any work without written approval of the Contracting Officer. Compliance with the provisions of this contract by subcontractors shall be the responsibility of the contractor.
1.4 Quality Control
1.4.1 The contractor shall designate, in writing, an on-site representative who shall serve as the contact for matters involving quality and performance or nonperformance of the required work stated in this PWS. The employee(s) shall be qualified and fully competent with full authority to act for, and on behalf of, the contractor as necessary to insure that the required work is performed in accordance with the standards contained herein. The contractor shall furnish the above written designation, along with an alternate, to the COR no later than the first day of work. The contractor shall include the name(s), address(s), and telephone number(s) of the responsible individual(s).
1.4.2 The Contracting Officer reserves the right to disapprove any individual whom he considers incompetent to perform the work required. The Contracting Officer will provide a written notice of any disapproval to the contractor.
1.4.3 The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this SOW. The contractor shall also implement procedures to identify, prevent, and ensure non-recurrence of defective services. The final Quality Control Plan (QCP) shall be submitted to the COR within ten (10) days after the contract award. If the government finds the QCP “unacceptable” whenever the contractor’s procedures do not accomplish the quality control objectives the contractor shall revise the QCP within ten (10) working days from receipt of notice that the QCP is found “unacceptable”. The contractor shall perform inspections prior to requesting acceptance of the work by the government.
1.5 Quality Assurance. The government will use a Quality Assurance Surveillance Plan (QASP) to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government may use Quality Assurance Evaluators (QAE(s)) to provide assistance with the quality assurance methods.
1.5.1 The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.
1.5.2 If any of the services do not conform to contract requirements, the government may require the contractor to perform the services in conformity with contract requirements and at no increase in cost. If the contract requirements are not met after a second attempt the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
1.5.2.1 Upon verification of a validated customer complaint or contract discrepancy report (CDR), the COR will notify the contractor that they are required to re-perform specific services.
1.5.3 The government may take action, if the contractor fails to perform the services again or to take the necessary action to ensure future performance is in conformity with the contract requirements. The government may (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that related to the performance of such service or (2) terminate the contract in whole or in part
1.5.4 The contractor is responsible to replace/repair any damage to government property due to negligence, at his or her own cost. The government may take action, if the contractor fails to replace/repair any damage to government property. The government may (1) by contract, or otherwise, replace/repair damaged government property and charge to the contractor any cost incurred by the government to replace/repair any damage.
1.6 Hours of Operation. 1.7 Key Personnel. The contractor shall notify the COR of significant personnel changes along with the steps the contractor is taking to ensure impacts to task order schedules are minimized and security requirements are adhered
to. The contractor shall notify the COR in writing of any proposed changes to key personnel at least ten (10) working days prior to need for a replacement. Within the ten days, the contractor shall provide the qualifications for replacement for review and approval.
1.7.1 Identification of Contractor Employees. All contract personnel working in situations where their contractor status is not obvious to third parties are required to identify themselves. This may be accomplished by wearing clothing bearing the name of the company or by wearing clearly written and visible nametags which contain the company name and employee name at all times, as such to avoid creating an impression in the minds of members of the public that they are Government officials.
1.7.2 Vehicle Operation. Contractor personnel operating motor vehicles used in performance of this contract shall have a valid state operator’s license. The contractor’s vehicles shall have an identification tag clearly visible while on site.

1.10 Pre-Work Meeting. Prior to commencing any activities, the contractor shall arrange a Pre-work Meeting with the COR. The Meeting shall discuss the work requirements, scheduling, submittal process, review of the Activity Hazard Analysis (AHA), and Abbreviated Accident Prevention Plan (AAP). At least three (3) days prior to commencing work, the Contractor shall coordinate their proposed work schedule with the COR.
1.11. Submittals. Prior to commencement of services, the Contractor shall submit the following documents to the COR for review and approval:
Snow Removal/Ice Control Plan – Due within 30 days after contract award Quality Control Plan – Due within 10 days after contract award Activity Hazard Analysis – Due prior to beginning work onsite Accident Prevention Plan – Due prior to beginning work onsite List of who will perform work on this contract Proof of Insurance for contractor and subcontractors
1.12 Standards and Regulations. The Contractor shall perform to the standards in the contract and comply with all Local, State, and Federal Regulations during the services performed. The Contractor is responsible for ascertaining the extent to which these regulations affect the operations resulting from this contract. The Contractor shall comply will all applicable regulations. Applicable regulations include, but are not limited to the following:

Occupational Safety and Health Standards (29 CFR 1910);
1.12.1 Activity Hazard Analysis (AHA). The contractor shall prepare the AHA in accordance with Paragraph 01.A.14 or 01.A.15 of the EM 385-1-1. If using Paragraph 01.A.15, prepare the AHA IAW Figure 1-2.
Note: Contractors and other individual employer’s typically use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools. The government considers equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA, commensurate with the type of services the contractor is performing.
1.12.2 Abbreviated Accident Prevention Plan (APP). EM 385-1-1 in its entirety may be too complex for the type of work performed under these contracts; contractors may reference Appendix A, for abbreviated Accident Prevention Plan (APP). The contractor shall only need to submit items in Appendix A that are pertinent to the contract. The contractor shall use a qualified person to prepare the site-specific abbreviated Accident Prevention Plan (APP). The contractor shall prepare the APP in accordance with the format and requirements of the EM 385-1- 1 and supplemented herein. The contractor shall sign and submit the APP for approval prior to the start of work onsite.
1.13 Physical Security
1.13.1 The contractor shall be responsible for safeguarding all government facilities, property, and materials provided for contractor use. The contractor shall secure at all times all government facilities, property, and materials.
Specific security conditions may change based on threats to national defense, and based on the risk of specific facilities to these threats. The contractor shall abide by these changing conditions at all times, as applicable.
1.13.2 The Contractor will be provided a combination code and security badge for access to the site gates. If the Contractor is required to unlock and open a gate to plow, then the contractor will be required to secure the gate when the plowing is completed unless project personnel are present. The Contractor may have to use a warming device to thaw frozen locks to gain access to areas in this contract. Upon the completion of this contract, the Contractor will return the badge to COR or his designee before final payment is made. The Contractor shall immediately report to the COR any occurrences of lost or stolen badges.
1.14 Antiterrorism/Operation Security Requirements
1.14.1 Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or Security Office.
Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes. The contractor must submit the full name, Social Security Number/or/ valid driver's license number with state of issue, Date of Birth, and Place of Birth/Citizenship for all associated contractor or subcontractor employees to the USACE Security Office, Stephen Davidson, 412-395-7504, stephen.davidson@usace.army.mil, or Joseph M. Bali, 412-395-7162, joseph.m.bali@usace.army.mil. The email name check request must contain the USACE Pittsburgh District contract number and location, plus the USACE COR. The required information maybe fax to 412-395-7173 or a coversheet which identified the USACE Pittsburgh District contract number/location, USACE COR, and an email address for the requesting contractor. The District retains the right to deny any contractor and subcontractor employee from working on one of its contracts based on final background investigation results.
1.14.2 For contractors who do not require Common Access Card (CAC), but require access to a DoD facility or installation. Contractor and all associated sub-contractor employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
1.14.3 Pre-screen candidates using E-Verify Program. The Contractor must pre‐screen candidates using the E‐verify Program (http://www.dhs.gov/E‐Verify) website to meet the established employment eligibility requirements. The vendor must ensure that the candidate has two valid forms of government issued identification to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the COR no later than three (3) business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.
1.15 Administrative Information
1.15.1 The government will make payment monthly, after the government has inspected and accepted the services, and the government has reviewed, approved, and processed the contractor’s invoice. The contractor shall submit the invoice to the COR and/or any other person that has been designated in the contract to receive the invoice.
1.15.2 Contractor Invoices. The contractor must provide the contractor’s name, address, contract number, period of services completed (i.e., for the month of January or for the period of performance of January 1 through February 23), CLIN number and specific quantities of work performed (i.e., 1 Month, 40 days, 100 acres, etc.), and total requested, for an invoice to be considered proper. The contractor shall submit the invoice by the fifth (5th) of the month for services completed the previous month or submit the invoice upon completion of all services, in accordance with the period of performance stated in the CLIN.
1.15.3 Quantities. The quantities listed in the Price Schedule are the estimated number of services that will be provided during the period of performance and are subject to an increase or decrease at the discretion of the
Contracting Officer by modification. The Contractor will be paid the quoted unit price on the basis of actual work performed.
2.0 Contractor Furnished Items and Responsibilities
2.1 The contractor shall provide a sufficient number of trained and competent personnel to accomplish the work of the PWS in a manner that complies with all regulations, and consistent with the highest professional standard.
2.2 The contractor shall manage the total work effort associated with snow removal services to ensure fully adequate and timely completion of these services. The contractor shall provide an on-site supervisor with the necessary expertise to ensure the performance of the work in accordance with sound and efficient management practices. All workmanship shall meet the standards specified and shall be accomplished in conformance with approved and accepted standards of the industry.
2.3 The contractor shall schedule and arrange work so as to cause the least interference with the normal occurrence of government business and mission. In those cases where some interference may be essentially unavoidable, the Contractor shall make every effort to minimize the impact of the interference, inconvenience, equipment downtime, interrupted service, customer discomfort, etc.
2.4 The contractor shall take special care to protect government property including sidewalks, curbs, improved/semi-improved grounds, roadways, signs, light poles and lighting accessories, planting accessories, building structures and other surfaces from damage. Accidental damage shall be reported immediately to the COR with a timeline for repair. The contractor shall, at no cost to the government, return to their original condition, any property or areas damaged as a result of work under this contract, making repairs or replacements as necessary.
2.5 The contractor shall possess all licenses required by the Local, State and Federal government.
2.6 The contractor shall submit a list of proposed chemicals and substances to be used in performance of this contract to the COR within fifteen (15) days after contract start. The list shall include: trade name, chemical composition, formulation, concentration, and application rate of active ingredients, method of application, EPA registration number, and the Safety Data Sheets (SDS) for each chemical or substance. All chemicals must be approved by the COR prior to use. When any chemicals are planned for use that have not been approved, the contractor shall submit the required information prior to ordering or bringing the materials onto the installation.
2.7 The contractor shall establish an accident and safety program that shall provide safety, health protection, and personnel medical maintenance as required by the Occupational Safety and Health Administration (OSHA) and all Code of Federal Regulation (CFR) segments implementing OSHA. The government reserves the right to conduct unannounced safety inspections at any time.
2.8 During and at completion of work, debris shall not be allowed to spread unnecessarily into adjacent areas nor accumulated in the work area itself. All such debris, excess material, and parts shall be cleaned up and removed at the completion of the job and/or at the end of each day work is in progress.
2.9 The contractor shall immediately report to the COR any bodily injury or death of contractor personnel while in performance of official duties, damage to government property, or loss of government property resulting from activities of the contractor, its agents, or employees. The government reserves the right to investigate accidents involving contractor personnel.
2.10 The contractor shall provide employees with protection against health hazards by furnishing all industry standard protective equipment required for performance of this contract. Such equipment shall be National Institute of Occupational Safety and Health (NIOSH) or Mine Safety and Health Administration (MSHA) approved for the usage intended, whichever is the most stringent. Conflicting instructions shall be brought to the COR for resolution.
2.11 The contractor shall ensure that all operating equipment and tools have guards which conform to the provisions of OSHA regulations specified at 29 CFR 1910, Subparts O and P.
2.12 The contractor shall ensure that any signs, equipment, machinery, and hazards are marked or painted to identify the hazard. The colors and marking used shall conform to OSHA regulations specified at 29 CFR 1910.144 (Safety Color Code for Marking Physical Hazards), and other State and Local statutes as applicable.
2.13 All waste materials defined at 40 CFR 251.20 which could affect the environment must be disposed of in accordance with directions provided by the Safety Officer.
2.14 The project manager shall meet with the COR before or at the beginning of the contract. Meetings shall be held thereafter as determined necessary by the COR. The contractor shall provide management representatives at the meetings above the level of Project Manager at the COR’s request to resolve performance issues.
3.0 Specific Tasks
3.1 Snow and Ice Removal. The contractor shall remove all snow and ice, curb to curb from all sidewalks, loading docks, exterior stairs, building entrances, emergency exit doors, handicapped ramps, flagpole areas and the Security Guard booth at the Main Entrance and main roads. As part of the snow/ice removal operation all areas mentioned shall be treated with a compound to enhance melting when needed.
3.2 Specific Tasks for Snow and Ice Removal. The contractor shall provide snow and ice removal services to ensure that the operational mission of the Pittsburgh District is not impaired in the event of a snow/ice storm. The contractor shall remove and control snow and ice from all roads, parking areas, sidewalks, steps and other areas inside the compound of the installation. The contractor shall ensure that snow is removed so that refuse containers are accessible for deposit of trash and pick-up of containers in areas where snow removal has been directed. The contractor shall haul snow to an on-site location and deposit it as directed by the COR. No substances other than those specified herein shall be applied prior to receipt of the COR’s approval.
3.3 Snow Accumulation. All snow accumulation measures shall be in accordance with the records of the National Weather Service, Pittsburgh Office. Storm classification will be determined upon receipt of snowfall accumulation data. Storms will be classified for any continuous or intermittent snowfall or ice storm for any period when frozen or freezing precipitation has fallen. Storms are considered for individual classification only when separated by a period of not less than 12 hours with no precipitation. Any pretreatment before a storm or treatment of refreezing and/or drifting that may occur within 12 hours after a storm will be covered under the same event. For the purposes of this contract, snow/ice storms will be classified as follows:
Class A: Pretreatment and treatment of refreezing and/or drifting.
Class B: Storms with snow accumulations up to 1 inch or ice up to ¼ inch.
Class C: Storms with snow accumulations 1 inch up to 3 inches or ice between ¼ and ½ inch.
Class D: Storms with snow accumulations of 3 inches up to 6 inches or ice ½ inch or more.
Class E: Storms with snow accumulations of 6 inches up to 12 inches.
Class F: Storms with snow accumulations of 12 inches or more.
3.4 Work Commencement. Response is considered satisfactory when the contractor is actively performing snow removal/ice control services within the specified work commencement criteria. The contractor shall begin snow removal/ice control activities within two hours of notification by the COR or Primary/Alternate POC during regular working hours. Advanced noticed may be given by the COR, up to 48 hours in advance if severe weather is predicted. In which case, pre-treatment is to be done within 12 hours of predicted snow and/or ice events and snow removal/ice control activities are to begin such that the maximum accumulation is not exceeded in any area.
During storm emergencies, regardless of hour or holiday, the Contractor shall be onsite within one hour to perform services as directed by the COR, and shall continue without interruption until the storm emergency is complete and the installation is clean and free of snow and ice.
3.5 Maximum Accumulations. Once work has commenced, the contractor shall continue snow removal operations in order to ensure that during the course of the snowstorm the snow accumulation does not exceed one inch on primary roads.
3.6 Completion Times. During normal working hours, the contractor shall cease snow removal activities no earlier than when the snowfall has ended and all areas for which the contractor is responsible have been cleared and salted.
If the snowfall begins outside of the facilities regular working hours, snow removal/ice control services are to commence such that the maximum accumulation does not exceed one inch in any area at the start of the normal working hours. If the snowfall ends outside of the facilities regular working hours, snow removal/ice control services are to be completed before the start of the next regular working hours.
3.7 Completion Criteria. Snow removal will be considered complete, for streets, parking areas, and sidewalk areas, when the following conditions have been met:
Removed shall constitute a bare surface with no trailing snow. For hard packed areas, less than ¼ inch of snow and/or ice remains on the entire area and salt has been placed.
Snow is removed from the full width of streets, sidewalks, and steps with no intervening snow at street intersections, parking areas, or entrances to all buildings.
Snow has been removed from the full width of parking areas and pushed to designated locations.
Salt has been applied to all roads, parking areas, sidewalks, and steps.
3.8 Operational Priorities. Order of precedence is as follows: There may be times the COR will need to change the order of precedence and the contractor shall conform to those requests.
1) Main Roads
2) Entrances, roadways, handicap parking areas and sidewalks leading to each building structure
3) Access roads to loading docks
4) All parking lots
3.9 Ice Control. The contractor shall apply abrasives for ice control as directed by the COR. Pre-treatment will be done within 12 hours of predicted snow and/or ice events. The contractor will be responsible for providing all labor, materials, and equipment to ensure that all roads, parking lots, and sidewalks are pre-treated before a snow or ice event. Abrasives shall consist of treated salt which shall be treated with an Environmentally Preferred Product (EPP). If applying salt brine pre-treatment, mixed in a brine mixing tank, the brine solution should reduce environmental impact and lower the working temperature of the salt solution. This mixture is to be applied per the manufacturer’s recommendations for concentration and ambient conditions.
