By purchasing the items defined herein, the USSS ensures the maximizing of operational lifecycle of existing weapons inventory, and ensures commonality of specialized USSS CDU training relative to this specialty weapon system’s design; users maintain familiarity and consistency with existing weapons orientation and deployment, and the USSS mitigates against potential warrantee violations with upgrades and parts integration with existing/legacy FN America, LLC – FN 303 Launchers. The total value of this one-time acquisition is anticipated to be .
4. Statutory Authority:
ONLY ONE RESPONSIBLE SOURCE and no other supplies or services will satisfy agency requirements in accordance with Federal Acquisition Regulation (FAR) Subpart 13.501.
5. Rationale Supporting Use of Exception Cited Above:
The equipment requested via this requisition is required to be compatible with the currently issued B&T GL06 Launcher Systems, and corresponding accessories (carrying cases, munitions, etc), already within use by the USSS CDU. The B&T GL06 Launcher Systems have been identified as a known compliant system, and are compatible with the existing USSS-owned FN America – FN 303 Less Lethal Launcher Systems.
These ‘Less lethal’ law enforcement devices have completed extensive testing, evaluation, and validation by this Service, conform to all OEM nomenclature items, as well as the specific USSS requirements relative to materials, design, and features, and commonality of design and usage with currently issued items, to minimize the burden of training multiple systems deployment.
The use of alternate or non-OEM (FN) parts and/or components would yield less practical and predictable results when contemplating normal maintenance and parts replacement cycles, versus using strictly approved FN brand-name brand parts. The use of non-OEM parts, components, and assemblies also subjects the government to voided warranties as well as diminished operational weapons reliability, accuracy, and effectiveness - which carry grave law enforcemement consequences and increased liability concerns.
6. Efforts to Obtain Competition:
No comparable competitors’ designs have been identified as suitable, without subjecting the government to significant delayed deliveries, voided warranties on existing systems, as well as potentially diminished operational weapons accuracy and effectiveness related to existing specialty munitions in USSS inventory. The issuance of a USSS-specific competitive solicitation, as well as the continued testing, use, or fielding of alternate non-OEM parts and/or components would incur a substantial added financial burden to the Government, as well as significant delays in delivery of critical law-enforcment equipment.
7. Actions to Increase Competition:
This acquisition is intended to be a singular, one-time award, designed to refresh the lifecycle of existing weapons systems, and meet critical operational need to expand the inventory of systems. The USSS-UD-CDU and RTC Armory staff identified an urgent ‘in-line’ refresh and expansion of existing systems (vs acquisition of new, complete launcher systems and munitions) as the most fiscally conscious and operationally efficient means of urgently updating and expanding the existing FN launcher systems.
Alternative 303 ‘less lethal’ launcher systems and munitions types remain in active development - though have not yet been validated as suitable for operational USSS use.
8. Market Research:
Since 2018, market research has been conducted with known vendors for comparable equipment - specifically for a 303 Less-Lethal Launcher system and corresponding compatible munitions. No non-OEM competitors have been identified that meet all the USSS requirements without requiring specific manufacturer customization and/or extensive durability and compatibility testing.
The procurement of a competitor’s system for use, or fielding of alternate non-OEM parts and/or components would incur a substantial added financial expense (materials and labor for Armory and operational training) and time (manhours and diversion of operational resources) burden on behalf of the government.
9. Other Facts: Not Applicable
