Contracting Officer:

1. Contracting Activity: AFRL/RIKO, 26 Electronic Pkwy, Rome NY 13441

Contracting Officer:

Purchase Request: F4HBC10219A102

2. Nature and/or Description of the Action Being Processed

The Government requires the purchase of two (2) reconditioned (tanks will be provided by Government) and installation of Siemens Sinorix 227 Waterless Extinguishing Agent Tanks, removal and recycle of two (2) additional tanks and recover any reimbursement associated with agents in two (2) tanks.

3. Description of Supplies/Services Required to Meet the Agency’s Needs

This requirement’s estimated value is and it's for the purchase of reconditioned and installation of two (2) Siemens Sinorix 227 Waterless Extinguishing Agent Tanks, removal and recycling of two (2) additional tanks and reimbursement associated with agents in tanks being removed. Vendor will be responsible for providing transportation of the tanks from the building into their truck and then also transportation of reconditioned tanks from their truck to the appropriate building for installation.

4. Authority Permitting a Brand Name

10 USC 2304(c)(1) Only one responsible source and no other supplies or services will satisfy the agency requirement.

5. Applicability of Authority

The Government requires the removal of four (4) 1200 pounds tanks filled with Siemens Sinorix 227 agent.

Two of the tanks will need to be reconditioned, certified and return to the facility for installation. The other two tanks will be removed and recycled. Before being recycled, the agents in the tanks will be recovered and the Government will receive reimbursement for the gas in the tanks.

The agents being used by the current extinguishing system is Siemens brand. As such, another type of agents cannot be used because of performance issues. Building 3 have four (4) primary tanks and four (4) tanks for secondary operation, which are all required to have the same type of agent. The Siemens Sinorix 227 is patent for the Dupont type FM 200 agent, which is currently in all existing tanks. Since the existing tanks are filled with the Sinorix 227 agent, AFRL have to stay with the Siemens 227 agent to keep the system functioning and to prevent any issues. Purchasing a different brand tank will not be compatible with the current system. The Government needs to remain compliant with its fire suppression systems and currently two (2) tanks are at an inadequate level. This purchase is necessary for AFRL to remain in accordance with its fire suppression regulations. Given this information, AFRL would experience substantial duplication of cost that could not be recovered and incur unacceptable delays trying to fulfill this requirement through a different source.

6. Fair and Reasonable Cost Determination by the Contracting Officer

The Government anticipates receipt of competitive proposals from through a beta.SAM.gov solicitation.

7. Description of Market Research Conducted Among All Awardees

The Government estimate is based on an IGE provided by the Government. AFRL Market research concluded that the required brand name products are available through Open Market vendors.

8. Other Facts Supporting the Justification

There are no other facts supporting this justification.

9. List of Any Awardee That Expressed Interest in the Acquisition

10. Actions to Remove/Overcome Barriers to Increasing Fair Opportunity

The Government will continue to monitor the market in order to identify opportunities to maximize competition in potential future requirements and in the event that the research and development activity changes, other products will once again be evaluated to determine their capability to support future projects.
