About this file

This document is a Sole Source (Including Brand Name) Justification for a federal contract opportunity. The justification explains the requirement for a brand name "Fat Truck" Utility Terrain Vehicle (UTV) with specific capabilities to support the 354th Range Squadron's (354 RANS) mission in an arctic and amphibious environment. The planned contract will be a firm-fixed price contract awarded under FAR Subpart 13.5 Simplified Acquisition Procedures, as a 100% small business set-aside. The estimated contract cost is redacted. The justification cites the lack of commercially available alternatives that meet the required salient characteristics, and confirms that at least 3 small business vendors can provide the brand name Fat Truck. Market research was conducted via sources sought, internet searches, and vendor outreach. Quotes will be evaluated on best value/lowest priced, technically accepted. The related federal contract opportunity is Solicitation Number FA500424Q0042 for the procurement of 2 Fat Trucks, with a response due date of September 12, 2024.

I. Contracting Activity.

354th Contracting Squadron

II. Nature and/or description of the action being processed.

This action will be awarded as a new contract as a firm-fixed price contract IAW FAR 13.5

III. Description of supplies/services required to meet agency needs.

1 (One) with the option of buying 2 (two) "Fat Truck" brand name Utility Terrain Vehicles with 8 passenger capacity, >6500 lbs, and hydrostatic steering/transmission w/ ability to traverse all environments and weather conditions.

The Fat Truck should include, Hatz Diesel Engine, 74 hp (No DEF), 2 hydrostatic motors (one per side) with carbon fiber synchronous belts, LED Street lights, 4-corner LED beacon lights, Front & Rear LED light bar, 4-way camera system, Electronic Inclinometer, Roof Hatch, Roof Rack with ladder, Brush Guard, Exterior Mirrors, D-ring tie downs, Wheel Pods, Air Conditioning Cold Weather Kit, Auxiliary cab hydronic heaters, 110V block heater, Webasto engine coolant heater (diesel fired), Webasto cab air heater (diesel fired), 4x in cab ventilation fans, Backup Alarm, Side LED works lights (4ea total), LED Direction search light 6x center facing rear seats, 8ea total capacity (1 driver + 1 front passenger + 6 rear passenger), Front bumper 8k lb winch, Blue tooth radio, Studded Tires, Tow Package.

IV. Statutory authority permitting other than full and open competition.

The Government's mission needs require the use of a brand-name description of products to procure the aforementioned equipment.

Subsequently, IAW FAR 13.501(a) this justification is prepared according to the instructions illustrated in FAR 6.303-2, modified to reflect the use of procedures from FAR Subpart 13.5.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Research showed no other comparable products (Sherp, SUSVs, Rolligons,Tuckers, etc.) are identified as either equipment in compliance with the signed Other Government Motor Vehicle Conveyance (OGMVC), or able to meet the customer's needs because of the lack the following combination of all required capabilities: capability to traverse zero - two feet of the snowy tundra, muskeg, forested areas, and the open/frozen streams from Salcha to Blair Lakes. Ability to travel up to speeds of 25 mph, not weighing more than 6500 lbs. Capable of pulling light drags, able to operate in an all environments (traverse in water or on ice bridges, wetlands, etc) and use diesel fuel. Additionally, the comparable products are too heavy to be supported on the ice bridges, too wide to fit on the trail/ice bridge, too long making the vehicles impractical in the dense forest. Lastly, the comparable products do not contain the environmentally friendly features that Fat Trucks possess, such as ability to float in streams/lakes and containing a fluid belly pan. 354 RANS is required to not disturb certain Alaska terrain such as wetlands, so the environmentally-friendly features of Fat Truck will help ensure they remain compliant by mitigating environmental damage.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Previous market research for brand name acquisition FA500423P0022 - RANS: Fat Truck Rentals concluded that Fat Trucks were the only brand of equipment capable of meeting the specialized performance needs in an arctic and amphibious environment. Internet searches conducted during current market research confirmed Fat Trucks remain the only brand of equipment that are capable of meeting the specific and specialized needs of the 354 RANS mission.

Furthermore, it was revealed via DSBS and confirmed via vendor outreach that there is a reasonable expectation that 3 or more small businesses are capable of providing the brand name product.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

This requirement will be competed as a 100% small business set-aside under brand name procedures. There are 3 (three) or more vendors were confirmed via vendor outreach to supply Fat Trucks. Price Analysis will be used and the received quotes will be evaluated on best value/lowest priced, technically accepted. Therefore, the competition and documented abstract of quotes will determine the price fair and reasonable.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

354 CONS posted a sources sought on SAM.gov in an effort to identify other potential UTV's other than Fat Trucks that meet the salient characteristics required by 354 RANS, which yielded zero responses. 354 CONS utilized Internet searches, vendor outreach, GSA, previous market research and Dynamic Small Business Search (DSBS) to identify vendors with the capability to provide Fat Trucks. It was confirmed that 3 or more vendors can sell the Fat Trucks and all required attachments in Alaska alone.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

No other Utility Terrain Vehicle meets the aforementioned requirements (section V) for the 354 RANS mission (I.E. no 8 passenger capacity, no ability to navigate terrain effectively enough in the desired locations, does not provide the particular equipment 354 RANS is seeking to accomplish the mission.) The Fat Truck is the only utility terrain vehicle capable of meeting all requirements and terrains.

X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

354 CONS will continue to survey the market and look for vendors that can provide comparable products capable of meeting the specific mission needs in an attempt to increase competition and eliminate the requirement for specifically Fat Trucks. Additionally, sources sought postings from other units will be monitored to identify other sources that meet future requirements since there is a broad interest DoD wide in identifying alternative UTV's with similar capabilities.

XII. Certification by the Contracting Officer.
