BASIS FOR AWARD

The Tradeoff Source Selection procedures identified in FAR Part 15.101-1 will be utilized to select the successful contractors. The contract award will be made to a single offeror whose proposal meets the requirements stated in solicitation and are determined to provide the greatest overall value to the Government.

Non-price evaluation sub-factors under Factor 1 – Technical Capability, when combined, are approximately equal to price (Factor 2).

The award will be made to the responsible offeror whose offer conforms to all the solicitation requirements and provides the best value to the Government considering all evaluation factors combined as detailed below.

There is only one (1) non-price Technical Factor, and the six (6) subfactors listed under Factor 1 – Technical Capability, and they are listed in order of importance.

FACTOR 1 – TECHNICAL CAPABILITY - The technical capability response shall clearly identify the following subfactors and provide a response that demonstrates understanding of and capability to perform to all of the requirements identified in this solicitation, including its attachments. The following sub-factors are listed in order of importance:

Sub-Factor 1 - Technical Approach and Capability (non-price): This section of the technical proposal should clearly describe the offeror's proposed approach to performing the requirement as detailed in the solicitation, scope of work, and its included attachments. It should clearly indicate which work is self-performed and which work is to be subcontracted. It should also identify which equipment will be used in performance of this project and include a draft project schedule. Offerors shall provide a sample plan for the closure of the road.

Sub-Factor 2 - Management Approach and Capability (non-price): This section of the technical proposal should describe the offeror's proposed approach to managing the offeror’s employees, as well as any subcontractors and subcontractor employees, to promote timely performance, quality of performance, and customer satisfaction throughout contract performance. In addition, proposals should identify key personnel who will serve in management positions throughout the project. Offerors may submit résumés for key personnel. Offerors shall provide a sample Quality Control Plan.

Sub-Factor 3 – Safety (non-price): The contractor shall provide an overview of their company Construction Safety Program and a narrative discussion of its assessment of the safety risks associated with the work, including any changes it would make to its company Construction Safety Program to address its assessment of the project risk on the base contract. Offerors shall provide a sample Safety Plan.

Sub-Factor 4 - Biobased Certification (non-Price): Offerors shall also identify the Biobased products to be purchased and used under this contract. For each Biobased product. the offeror shall specify the percentage of Biobased content, and for the USDA-designated Biobased content products, the offeror shall demonstrate that the products to be used under this contract will contain the percentage specified in the USDA recommendations or the highest level of Biobased material practicable, consistent with USDA's recommended percentages of Biobased content. Contractor may use Attachment 10 – Proposal Submission Package.

Offerors who fail to clearly state the utilization and/or non-utilization of Biobased products, which includes a list of products, certifications, and operation plan, may not receive further consideration for award.

Sub-Factor 5 - Past Performance (non-price):

The offeror may coordinate completion of the form entitled "Past Performance Questionnaire" in the Attachment 10 - Proposal Submission Package for construction projects of the same scope and complexity as the contemplated contract which specifically required establishment of cofferdams. Fill out Item 2 and Part I and provide to a reference, who should complete the remainder and return the form to the Contracting Officer, the forms can be submitted to contractor, and also submitted with package, and do not have to come separately. It is the contractor’s responsibility to make sure they are received. Offerors who show at least five plus (5+) years of historic masonry construction will be rated at a higher level.

Note a Contractor Performance Assessment Reporting System (CPARS) report WILL NOT be a substitute for the Past Performance Questionnaire, due to the inconsistencies, the level detail, or lack of the information entered into CPARS which makes it difficult to determine that the CPARS evaluations that may be provided are for relevant for the work described in this solicitation.

Past performance information regarding contracts with the Federal Government, other public agencies, or private organizations will be considered. The past performance information submitted may be that of the offeror's company or its proposed subcontractors. Subcontractor past performance will only be considered if the past performance relates to the work the subcontractor will be performing on the contemplated contract.

The Government reserves the right to limit the number of references it ultimately contacts and to use sources other than those provided by the offeror to obtain information related to past performance. Limited exchanges between the Government and an offeror may occur to clarify the relevance of an offeror's past performance information and adverse past performance information to which the offeror has not previously had an opportunity to respond.

Lastly, per FAR 9.104-6 (a)(1) – “Before awarding a contract in excess of the simplified acquisition threshold, the contracting officer shall review the performance and integrity information available in the Federal Awardee Performance and Integrity Information System (FAPIIS), (available at https://www.cpars.gov), including FAPIIS information from the System for Award Management (SAM) Exclusions and the Contractor Performance Assessment Reporting System (CPARS).” Those not having a favorable FAPIIS/CPARS or SAM Exclusions report WILL NOT be considered for award.

FACTOR 2 - PRICE: A price evaluation will be performed to determine the reasonableness and realism of the proposed price. Reasonableness will be determined to consider if the price is too high based other competitive prices received and comparison to the independent Government estimate. The Government reserves the right to conduct a price realism analysis but is not required to do so. Price realism will consider whether a proposed price is too low because this might indicate a lack of technical understanding on the offeror's part or a performance risk associated with the proposal that the Government may not be willing to accept. Whether a price is deemed to be too high or too low may be considered in the context of comparison to other price proposals as well as to the IGE or to any other information the Contracting Officer deems useful in his or her discretion. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether line items are unbalanced as a result of overstated and understated price line items. Offerors are cautioned to distribute costs appropriately.

J. Subcontracting Plan:

Not applicable.
