ABS Rules and SOLAS Regulations and shall not knowingly perform any action which may compromise the ship’s Certificate of Inspection (COI) and/or ABS Classification. If the

Contractor is aware of anything, within this PWS or missing from this PWS, that might compromise that compliance, they shall make it known immediately, and in writing, to the

Contracting Officer’s Representative (COR). If there are apparent differences between the requirements of the CFRs, ABS Rules and SOLAS Regulations as they relate to the work being performed, the more stringent requirement shall apply.

As a Performance Work Statement (PWS), this document does not attempt to define every detail relative to the labor and/or materials required to create the system described. Those details must be determined by the contractor.

LOCATION:

All work shall be performed at the ship’s homeport in Castine, ME.

PERIOD OF PERFORMANCE:

The period of performance for this PWS shall be August 1, 2023 through November 1, 2023.

GENERAL REQUIREMENTS:

The following general requirements apply to ALL work performed in the execution of this PWS including all work performed in accordance with the “Supplemental Labor and Material/Subs”

Item of this PWS. Additional requirements are stated within each “WORK ITEM”.

1) References: All “References” listed below, which are not publicly available, shall be provided electronically by the Contracting Officer (CO) or Contracting Officer’s

Representative (COR), if requested by the Contractor.

2) COVID-Protocols: All Contractor personnel and subcontracted personnel shall comply with whatever protocol is recommended by the Center for Disease Control (CDC) at the time of award.

3) Labor, Materials and Services: The Contractor shall provide all labor, materials, and services to accomplish this work in accordance with all applicable ABS Rules, USCG Regulations and original equipment manufacturers’ (OEM) instructions. This includes all removals and re-installations of interferences and the proper disposal of all wastes generated from the execution of this PWS. Any equipment or materials damaged during removals and/or re-installations shall be replaced at the Contractor’s expense.

12) Disturbed Areas: All areas which are disturbed in the execution of this PWS shall be returned to a condition equal to or better than originally found. All new and disturbed http://www.dtic.mil/dtic/tr/fulltext/u2/a445982.pdf areas (to include all piping, plate, foundations, brackets, etc.) shall be prepared and coated in accordance with the MARAD Standard Coatings Guidelines using coatings manufactured by International. Final top coat colors shall match the surrounding areas.

13) Regulatory Attendance Charges: All ABS Surveyor attendance charges related to the work in this PWS shall be to the Government’s account. Since TS State of Maine is a Public

Nautical School Ship, there will be no charge for USCG Inspector attendance. Repeated ABS

Surveyor attendance fees resulting from mistakes and/or failures of the Contractor shall be the Contractor’s responsibility to pay.

14) Personnel Safety: The Contractor shall adhere to all safety procedures employed aboard the ship by the Maine Maritime Academy. All persons working aboard the ship shall employ proper personnel protective equipment (PPE) for the work being accomplished. At a minimum, hard hats, safety glasses and work shoes are required.

15) Maintain Fire Boundaries: The Contractor shall not compromise fire boundaries (fire screen doors, remote-acting watertight doors, etc.) by blocking doors open or removing doors for any extended or unattended periods.

16) Maintain Unobstructed Escape Routes: The Contractor shall not obstruct egress routes

(doors, hatches, scuttles, passageways, etc.) in a manner which endangers the safe entry or evacuation of personnel.

17) Slips, Trips and Fall Hazards: The Contractor shall take all necessary precautions to ensure that:

a) Areas being worked on are well lit.

b) Ladders, rails and deck plating are not removed without sufficiently encircling the openings with both sturdy line and yellow caution tape.

c) Decks are kept free of oils and greases.

d) Welding leads, oxy-acetylene hoses, extension cords, etc., are not strung across ladders, egress paths, etc., in a manner which creates a tripping hazard.

18) Safe for Entry: All tanks and spaces which constitute a confined space shall be certified

“safe for entry” by a Contractor provided Marine Chemist. These areas shall be maintained as such by a Contractor provided, “Competent Person” using a certified gas monitor so long as work is continuing in the space.

19) Safe for Hot Work: All areas requiring hot work shall be certified “safe for hot work” by a

Contractor provided Marine Chemist. These areas shall be maintained as such by a

Contractor provided, “Competent Person” using a certified gas monitor. The Competent

Person shall hold certification for satisfactory completion of an NFPA approved course for shipyard competent persons. A copy of this certification shall be provided to the COR prior to the start of any hot work. All hot work shall require that the Contractor fill out one of the ship’s hot work permits and obtain the signature/acknowledgement of one of the ship’s officers each day that hot work is being performed. This permit is used to inform the ship’s crew of the specific hot work being done each day. Precautions shall be taken to ensure that overheads, bulkheads, decks, wiring, piping, insulation, etc. are properly protected from burning, welding, cutting or similar activities by covering them with fire retardant board or cloth as appropriate. A Contractor supplied fire watch shall be employed on each side of a bulkhead or deck where hot work is taking place. Use of the ship’s portable extinguishers is not permitted. The Contractor’s extinguishers shall be kept full and in good working condition. The fire watch must remain in place for at least ½ hour after any hot work is performed to include standing by during break and lunch periods if hot work was performed within ½ hour prior to the start of the break/lunch. All hot work must cease at least ½ hour prior to the end of the workday to provide the Contractor’s fire watch ample time to ensure that the area is safe before departing the ship. These periods are a good time to accomplish clean-up of the areas involved.

20) Oxygen and Acetylene: All oxygen and acetylene bottles shall be kept ashore and tied off along the dock. All oxygen and acetylene hoses shall be disconnected at their bottles at the end of each workday. Hoses used within the ship shall be coiled up such that no hoses are left passing through any doors at the end of the workday. Hoses shall be kept in good condition. Hoses deemed in need of replacement by the COR shall be replaced by the

Contractor at the COR’s direction.

21) Welding Leads: All welding leads shall be kept in good condition. All leads shall be disconnected from their welding machines at the end of each workday. Leads used within the ship shall be coiled up such that no leads are left passing through any doors at the end of each workday. Leads deemed in need of replacement or repair by the COR shall be replaced or repaired by the Contractor at the COR’s direction.

22) Internal Combustion Engines: All Contractor provided internal combustion engines driving welding machines, air compressors or similar equipment, shall be kept on the pier and placed in a berm large enough to contain any oils or fuels that could potentially leak from that equipment. These berms shall be kept free of rainwater in as much as is practical.

23) Job Safety Analysis (JSA): A JSA shall be performed (using the Contractor’s own forms) with all persons involved prior to the start of any work. A copy of all completed JSAs shall be retained aboard by the Contractor throughout the contract period and made available to the COR and ship’s crew upon request.

24) Energy Control Plan (Lock Out/Tag Out): All work involving systems or equipment containing stored energy (such as electricity, fluids under pressure, stowed weights, and other hazards) requires that the stored energy be isolated and locked out/tagged out prior to any work being performed. The operation of any isolation device (switch, valve, etc.) and the placement and/or removal of any locks/tags, shall only be performed in the presence of, and with the written permission of, the ship’s Chief Engineer (or a crew member assigned by him). Written permission shall be executed/recorded by way of an entry in the ship’s lock out/tag out record book. Only the individual whose name/signature appears on the lock/tag may remove the lock/tag. All locks/tags associated with the work in this PWS shall be supplied by the Contractor and shall clearly identify:

a) Contractor’s Company name.

b) Date the lock or tag was placed.

c) Name/signature of the individual who performed the lock out/tag out.

25) Working Aloft: All persons working aloft shall do so in accordance with the ship’s working aloft procedures. Permission to go aloft shall be obtained from the Chief Mate by way of a signed working aloft permit. The Contractor shall provide their own safety harnesses.

26) Smoking: Smoking is not permitted aboard the ship or on the college campus (which includes the pier adjacent to the ship and college buildings).

27) Security: The ship’s Security Plan requires that all persons aboard be in possession of a

TWIC (Transportation Worker’s Identification Card) or be escorted by a member of the ship’s crew. Given that the ship’s crew cannot afford to escort the Contractor’s workers every day throughout the execution of this PWS, the Contractor must ensure that all persons in their direct employ be in possession of a TWIC. The only exceptions to this rule are for subcontractors of the Contractor who are expected to be aboard for only a short period (less than 3 days). In those cases, an escort from one of the ship’s crew can be provided. All persons boarding the ship shall be provided a temporary access card which shall be scanned by the cadet watch at each boarding and disembarking of the ship. Quick trips to the pier for tools or the like shall not require scanning in/out providing the cadet watch is informed by the Contractor’s employee or subcontractor and they remain within sight of the watch. A list of all Contractor’s employees and subcontractors and a copy of their TWIC shall be provided to the Chief Mate via email at brendan.mcavoy@mma.edu not less than 24 hours prior to their arrival aboard the ship.

mailto:brendan.mcavoy@mma.edu

28) Work Hours: Work hours shall be Monday thru Friday, 0700 to 1600 hours not including those Holidays observed by the Maine Maritime Academy. Those Holiday periods are as follows:

a) Indigenous Peoples' Day - Monday, October 9, 2023

b) Thanksgiving Holidays - Wednesday November 22, 2023 – Friday November 24, 2023

c) See also the working day restrictions stipulated above under “PERIOD OF

PERFORMANCE”.

29) Loading/Unloading of Tools, Equipment and Materials: Contractors shall be permitted to load/unload personnel, tools, and materials at the Academy pier alongside the ship. The ship’s crew shall provide an operator for the ship’s cranes to hoist/lower tools, equipment, and materials up to 4,000 lbs. Requests for crane service shall be made to the ship’s Chief

Mate at least one day prior to needing the crane. Availability of the ship’s cranes is not guaranteed. The Contractor shall be responsible for providing all straps, shackles, etc. and for safely and adequately rigging all lifts of equipment and materials. In addition, the

Contractor shall provide the personnel required to safely direct the crane operator and to guide the hoisted tools/equipment/materials.

30) Parking: Parking of vehicles throughout the workday is typically permitted at the Castine town parking lot but only upon approval from the Town Selectman. The contractor shall be responsible for obtaining that approval to include providing the Town Selectman a list of all

Contractor and subcontractor vehicle models, license plate numbers, and driver’s license numbers prior to the start of the contract. The town parking lot is approximately 1,000 feet from the ship. Overnight parking at the town lot is not permitted. If a Contractor desires to leave a work trailer on the pier or Academy grounds, it shall be in a location agreed to by the ship’s Chief Mate (who will also coordinate with the Maine Maritime Academy Police

Department). Work trailers and other vehicles must never obstruct emergency (fire and ambulance) vehicle access to the ship.

31) Availability of Drawings and Technical Manuals: The Chief Engineer shall assist, in as much as possible, by providing access to any requested drawings or manuals. These drawings and manuals shall not leave the ship but may be copied on board with the written approval of the Chief Engineer. Most of the ship’s drawings have been electronically copied to a pdf format. CD copies of available drawings shall be provided to the Contractor upon request.

32) Hazmat Handling and Documentation: The Contractor must recognize that ships may contain hazardous materials which require special handling. These materials may include, but are not limited to; asbestos (used in heat and electrical insulation, brake linings, deck coverings, boiler refractory, joiner work and other areas), mercury, oils, bilge water and slops containing fuel, grease and lubricating oils, lead, lead-based anti-foulants, etc. This

PWS attempts to make the Contractor aware of any known HAZMAT materials and substances that may be encountered in the execution of this PWS, however, the responsibility for identifying, handling, and disposing of these materials shall be the

Contractors. Removal and disposal of all hazardous material or waste shall be in accordance with all applicable Federal, State, and local rules and regulations. The

Contractor shall submit documented evidence of that compliance, if applicable, within five working days after the end of the contract. These documents shall include the types and quantities of hazardous waste generated, the procedures followed for custody and disposal, and copies of receipts for same. Additional charges required for handling and disposing of hazardous materials after contract award shall not be permitted unless it is related to work authorized under the “Supplemental Labor and Material/Subs” ITEM of this PWS.

33) Credit for Scrap: Unless stated otherwise in this PWS, all removed and/or scrap material generated in the execution of this PWS shall be removed from the ship, become the property of the Contractor, and be disposed of in accordance with all Federal, State and local requirements. A credit to the Maritime Administration for the value of any scrap material removed shall be included in the Contractor’s pricing for each ITEM in this PWS which generates any scrap material and/or salvaged equipment.

34) Trash Removal and Clean-up: The Contractor shall remove ALL trash generated each day and sweep down each area worked on at the end of each day. Upon completion of all work in an ITEM, all affected areas shall be thoroughly cleaned to a condition equal to or better than originally found. The ship is used by the faculty and cadets of the Maine Maritime

Academy and is open to the public and prospective students for tours. For this reason, it is important that all public areas remain clean and orderly.

35) Communications: The ship may provide the Contractor with a UHF radio and charger (if requested) for locating/contacting the COR (if aboard) or ship’s crew members throughout the workday. The radio and charger shall be signed for by the Contractor and returned at the end of the contract period.

36) Equipment Information: The Contractor shall provide the COR with an electronic copy (in pdf format) of all drawings, operating manuals, repair manuals, parts manuals, cut sheets etc., for any equipment that the Contractor provides to the ship as part of this PWS. In addition, any drawings required as a deliverable in this PWS shall also be provided in

AutoCad format.

37) Accuracy of Information: Dimensions and measurements in this PWS (or referenced in this

PWS) are provided in good faith, however, their accuracy is not guaranteed. The Contractor is responsible for verifying the accuracy of dimensions, measurements, sizes, etc., provided in any sketches, drawings, plans and specifications, within this PWS prior to quoting, fabricating, ordering, etc., anything required in this PWS. All drawings provided or referenced in this PWS, whether they are considered “as builts” or not, are not guaranteed to be accurate. Furthermore, these drawings should not be scaled to determine the actual location of existing piping/wiring runs, etc. in hidden areas such as bulkheads and/or joinery. The Contractor shall be aware that numerous drawings and manuals represent the ship’s configuration prior to the conversion in 1997 and as such, may no longer accurately represent the ship’s current configuration. For this reason, it is important to determine whether a drawing or manual being reviewed represents the pre or post conversion configuration. In some instances, it may be necessary to combine information from both pre and post conversion drawings to determine the current configuration of a system or compartment. Material Lists provided in a drawing are only a guide and may not accurately reflect the full extent of materials required. The Contractor shall be responsible for determining the actual quantities/types of materials required to satisfy the “INTENT” of each ITEM.

38) Daily Meeting: Prior to the start of each workday, and for the purpose of informing the ship’s crew of the Contractor’s activities (location of hot work, etc.), the Contractor’s

Manager/Supervisor shall meet with the COR (if aboard) and the Ship’s Officers to discuss the work plan for that day. This meeting is a good time to discuss any special requirements and/or hazards as they relate to the execution of JSAs, lock outs/tag outs, etc.

39) Subcontractor Info: Contact information is provided within each ITEM of this PWS, when appropriate, to assist the Contractor in identifying sources of OEM Technicians, ABS

Recognized Specialists and/or other Subcontractors who have consistently demonstrated their ability to perform the work or supply the parts required. The absence of a company name does not preclude their use by the Contractor providing the Contractor can demonstrate, to the COR, their ability to perform the work or provide the part as an

Authorized Representative of the OEM, ABS Recognized Specialist or reliable Subcontractor, as required.

40) Scheduling/Gantt Chart: All Items shall be completed on or before their “Required

Completion Date” (as listed in each ITEM of this PWS). No system or equipment can be left in an unfinished, incomplete, or otherwise, out of service condition prior to the cruises. A

Gantt chart (in pdf format) shall be provided by the Contractor indicating the scheduled start and finish dates for each Item. Changes to the Contractor’s advertised start date or completion date requires re-issuance of an updated Gannt chart.

41) Progress Meetings and Payments: Progress meetings and progress payments shall be scheduled as necessary depending on the availability of the Contractor, COR, Chief Engineer and Chief Mate. Prior to final invoicing of an ITEM, the Contractor shall provide the COR with an electronic copy of a document containing the signature of the Chief Engineer or

Chief Mate, as appropriate, acknowledging receipt of all deliverables and/or acceptance of equipment operational tests and/or demonstrations as required by that ITEM.

42) Invoicing: The COR shall maintain a spreadsheet which documents the cost and per cent completion of each Work ITEM and Supplemental Delivery Order. The Contractor and COR shall agree to these numbers prior to invoicing.

1.9 WORK REQUIRED: The Contractor shall provide all labor, materials, equipment, and services (unless specified as “GOVERNMENT FURNISHED:”) to accomplish the “INTENT” of this ITEM. This work shall include, but not be limited to, the following:

1.9.1 Prior to disabling of the ship’s existing fire detection system or performing any rip-outs of existing system components, procure and install a temporary fire detection system which will monitor the various zones listed in the table below using the minimum number of heat and smoke detectors, and emergency call points, specified (and as required by the local USCG). In addition to the components listed below, a base/control station shall be installed at the 01 deck, port side quarterdeck, frame 96, to alert the ship’s watch of a fire/smoke and/or emergency condition.

This base/control system shall be capable of automatically sending text alerts to crew members of a fire/emergency alarm. Due to the steel construction of the ship, the temporary system installed must consider the difficulties of transmitting signals throughout the various decks and compartments requiring multiple signal boosters or other similar equipment. A possible temporary fire detection system is the

Ramtech WES3 system. All components of the temporary fire detection system shall remain aboard and become the property of the U.S. Government.
