STATEMENT OF WORK

For Preventative Maintenance, Calibration, Emergency Repair and Replacement

Parts for Mitsubishi Laser Cutting Machine

1. SCOPE: Provide preventative maintenance (PM), calibration, emergency repairs and replacement parts necessary to maintain performance and operational readiness for a Government-owned Mitsubishi ML3015LVPLUS2 Laser Cutting Machine, Serial Number: 183LVPS583. The Laser Cutting Machine is located in Building 5 on Anniston Army Depot (ANAD). Scope of work will be for a PM plan (4 visits per year). All requests for service and replacement parts placed against this contract shall be requested by the Director of Public Works and initiated by the Contracting Officer in the Directorate of Contracting at the Anniston Army Depot. The cost of materials and services preformed shall not exceed the available funding amount. The Contractor shall not proceed with any verbal or written change(s) to the scope of work from sources other than the Contracting Officer, who will provide changes in writing.

2. REQUIREMENTS: The contract shall cover the cost of providing all things necessary to perform emergency repairs and annual inspection/alignment for the laser cutting machine including labor, tools, diagnostic equipment, transportation, schematics, documentation, and any other services necessary to repair the Laser Cutting Machine. All repairs and annual inspection/alignment shall be performed by Contractor personnel experienced and highly trained in operating, maintaining, and servicing the equipment in accordance with the original equipment manufacturers (OEM) published procedures.

3. PRINCIPAL PERIOD OF MAINTENANCE (PPM): PPM shall consist of 9-1/2 hours on weekdays, Monday - Thursday, 0700 AM through 1630 PM; and 8-1/2 hours on alternating Fridays, 0700 AM through 1530 PM. No hours that will result in premium charges on Weekdays, Saturdays or Sundays, or Holidays will be worked without prior approval of the Contracting Officer.

4. EMERGENCY REPAIRS: Emergency repairs shall be performed by Contractor personnel experienced and knowledgeable in all phases of repair, service, and operations of the laser cutting machine. Emergency repairs shall consist of any work that is necessary to restore the equipment to a 100% performance level. The Contractor must be able to provide high priority repairs for the laser cutting machine.

Contractor shall respond to the Government's request for technical support within twenty-four (24) hours after notification that services are needed. A response consists of a return phone call or a part sent. Service onsite response shall be within seventy-two (72) hours after notification that services are required. Charges associated with emergency repairs including travel, labor, transportation, repair parts, mileage, etc., shall be invoiced to the Government. All quoted prices shall be consistent with the Contractor's published prices that are in effect at the time of services. Only new OEM repair parts or components, or certified replacements of equal quality, shall be used to repair the equipment. If repair parts are not available on-site, contractor shall provide all repair parts and maintenance supplies and invoice separately to the Government.

All requests for service and replacement parts placed against this contract shall be initiated by the Contracting Officer, Directorate of Contracting, Anniston Army Depot. The cost of materials and services performed shall not exceed the available funding amount. Installation of any part or parts, which exceeds $500.00, shall be approved by Contracting Officer prior to installation. All replaced parts remain property of the Government (unless a credit is given with the replacement).

5. ANNUAL INSPECTION AND ALIGNMENT:

(a) Contractor shall make all adjustments to the laser cutting machine to insure it meets alignment and tolerance requirements and provide comparisons of alignment on original date. The Contractor shall do power probe to check power loss at table, clean all optics, and document these changes. The Contractor shall make all reasonable efforts to align and adjust the laser cutting machine within the original machine design specifications. Contractor shall immediately notify the Contracting Officer if it is unable to do so.

(b) Contractor shall provide recommendations, in writing, for the Government to maintain the laser cutting machine within proper alignment and accuracy requirements.

(c) Contractor shall provide all tools, labor, transportation, repair parts, documentation, maintenance supplies, test equipment, and any other related services, to inspect, align, and adjust the laser cutting machine. The Contractor shall provide personnel that are experienced and knowledgeable of the unique laser cutting machine at ANAD. Work shall be performed in accordance with the best commercial practices without unnecessary delays. Contractor personnel shall have the expertise to perform all repairs and adjustments for this equipment.

(d) The Government reserves the rights to have Contractor perform random sample tolerance checks at various points to insure that test results are repeatable. The random sampling shall consist of 1-2 programs of 1-2 different material types chosen by the Government and shall be performed at no additional cost to the Government.

(e) Technical surveillance of services will be performed by the Contracting Officer’s Representative (COR) Correspondence or communications of contract matters will be strictly between the Contractor and the Contracting Officer, Anniston Army Depot, ATTN: AMSTA-AN-CT, 7 Frankford Avenue, Anniston, AL 36201-4199.

6. DOCUMENTING MALFUNCTIONS AND SERVICE CALLS: The Government will provide the Contractor a Maintenance Call Record, SIOAN form 698, to be used to record repairs. The record shall include number of labor hours, labor rate, list of parts, travel expenses, quantity, part number, and the price. The Maintenance Record will also be used by the Government to record date and time of notification, call number, and date and time of arrival/departure of Contractor personnel.

7. TRAVEL EXPENSES: Travel expense will be a direct charge to each individual service call under the terms of this contract and will be based on reasonable actual costs incurred and will be reimbursed IAW the allowable charges under the Joint Travel Regulations

(JTR).

8. NON-CHARGEABLE ITEMS: There shall be no additional charge to the Government for:

(a) Remedial maintenance performed during the Preventative Maintenance visit or scheduled extension thereof. Any additional service work required that is not part of the Preventative Maintenance Performed Operations List shall be quoted.

(b)Seller warrants that Goods sold Shall be free from defects in material and workmanship for a period of (30) thirty days from the date the Goods are shipped from the Purchaser’s plant.

(b) Time spent by Contractor personnel awaiting the arrival of additional technical support or delivery of parts, equipment, tools, etc. after a service call has commenced.

9. CONTRACTOR'S POINT OF CONTACT: The Contractor shall provide the Government with the name and telephone number of a designated POC and shall make arrangements to enable service personnel to receive notifications of service request.

10. GOVERNMENT POINT OF CONTACT (POC): The Government will appoint a knowledgeable COR technician as the POC with authority to schedule and coordinate emergency repairs through the Contracting Officer.

11. GOVERNMENT RESPONSIBILITIES:

(a) The Government will provide adequate storage space for spare parts, adequate working space, including telephone, heat, light, ventilation, electric current and outlets for the use of Contractor personnel. These facilities shall be within a reasonable distance of laser cutting machine and shall be provided at no extra charge to the Contractor.

(b) The COR and other Government POCs may be present at all times during equipment services.

(c) Subject to security regulations, the Government will provide the Contractor access to perform equipment services. If access cannot be provided due to security requirements, the Contractor shall have a reasonable period of time to provide personnel who can be granted access to Government facilities.

12. TECHNICAL/CONTRACT LIAISON:

The COR or KO will work with the ANAD technical liaison to schedule and survey emergency repairs. Correspondence of contract matters will be between the Contractor and the Contracting Officer, Anniston Army Depot, AMSTA-AN-CT (Bldg. 35), 7 Frankford, Avenue, Anniston, AL 36201-4199.

13. IAW 29 CFR 1910, 1926 and OSHA General Duty Clause 29 USC 654 ALL contractors and their home organizations supporting DOD/Gov't operations, regardless of any safety provisions included in or absent from the contract, are responsible for: Ensuring that their employees comply with applicable provisions of OSHA standards, and DoD, Army, AMC, Federal, State, Local and Company safety and occupational health requirements – where requirements conflict, the most stringent shall apply. Ensuring that safety, health and accident prevention for their employees is maintained in performance of contractual obligations. Establishing, conducting and maintaining a comprehensive safety program for assigned personnel commensurate with work tasks/operations performed. Performing a compliance assessment, including a Job Hazard Analysis (JHA) and ensuring training is adequate and complete.

14. Access and General Protection/Security Policy and Procedures.

A. This standard language is for contractor employees with an area of performance within an Army-controlled installation, facility, or area. The contractor and all associated subcontractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by the installation Provost Marshal Office, Director of Emergency Services, or Security office. The contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA, and/or local policy. In addition to the changes otherwise authorized by the change clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

B. For contractors that do not require CAC, but require access to a DOD facility or installation. Contractor and all associated subcontractor employees shall comply with adjudication standards and procedures using the National Crime Information Center interstate identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

C. Contractor shall acquire and need to return all issued U.S. Government Common Access Cards, installation badges, and/or access passes.
