Statement of Work Extended Range Less Lethal Pressurized Air Launcher Devices

1. BACKGROUND:

1.1. The Department of Homeland Security (DHS), Customs and Border Protection (CBP) has a requirement for the procurement of Extended Range Less Lethal Pressurized Air Launchers (LLPAL), LLPAL accessories, and projectiles for operational and training use.

2. SCOPE:

2.1. This statement of work delineates the required characteristics and performance criteria for new Extended Range Less Lethal Pressurized Air Launchers, accessories, and projectiles for U.S. Customs and Border Protection (CBP), Department of Homeland Security (DHS).

2.2. This statement of work further delineates the item requirements for compatibility with the current stock of CBP deployed FN303 MK1 LLPAL devices. Those items will be identified in the Technical Requirements section below.

3. APPLICABLE DOCUMENTS:

3.1. CBP Use of Force Policy (4500-01C).

4. TECHNICAL REQUIREMENTS:

4.1. Extended Range Less Lethal Pressurized Air Launcher: Standard configuration

4.1.1 Caliber: .68 caliber

4.1.2 Launcher shall operate on 3000 PSI High Pressure Air (HPA) bottle

4.1.3 Launcher shall be fully mechanical with no electronic controls

4.1.4 Launcher shall operate in semi-automatic mode only

4.1.5 Barrel shall be no shorter than 9 inches and no longer than

10.5 inches in length

4.1.6 Launcher shall have a two position safety with one position “SAFE” and one position “SEMI-AUTOMATIC.”

4.1.7 Trigger shall be a mechanical, semi-automatic trigger that does not require batteries.

4.1.8 Launcher shall have flip up style front and rear sights.

4.1.9 Launcher shall be distinguishable from lethal weapon platforms used in CBP law enforcement operations with a visible High Pressure Air (HPA) bottle. Launcher shall not be manufactured to accommodate simulated lethal ammunition magazines.

4.1.10 Launcher shall be set up exclusively in a rifle configuration which allows for shouldering of the device using a buttstock that is permanently attached to the receiver.

4.1.11 Launcher shall incorporate a Stanag 4694 rail on top of the receiver to accommodate optics or other accessories.

4.1.12 The HPA shall be oriented with the bonnet facing aft and shall be mounted parallel to the barrel. The mounting bracket shall allow for easy removal of the HPA with a quick release lever that does not require the use of any tools.

4.1.13 Launcher shall be 29 inches (+/- 2”) in overall length, when measured from the most rearward point of the launcher to the most forward point of the launcher.

4.1.14 Launcher shall weigh 10 pounds (+/- 3 pounds) when weighed in the following configuration: no magazine attached, full HPA attached, no sling attached

4.2. Extended Range Less-Lethal Pressurized Air Launcher: Tactical

4.2.1 Caliber: .68 caliber

4.2.2 Launcher shall operate on 3000 PSI High Pressure Air (HPA) bottle

4.2.3 Launcher shall be fully mechanical with no electronic controls

4.2.4 Launcher shall fire in semi-automatic mode only

4.2.5 Barrel shall be no shorter than 7.5 inches and no longer than 10.5 inches in length

4.2.6 Launcher shall have a two position safety with one position “SAFE” and one position “SEMI-AUTOMATIC.”

4.2.7 Trigger shall be a mechanical, semi-automatic trigger that does not require batteries.

4.2.8 Launcher shall have flip up style front and rear sights.

4.2.9 Launcher shall be distinguishable from lethal weapon platforms used in CBP law enforcement operations with a visible High Pressure Air (HPA) bottle. Launcher shall not be manufactured to accommodate simulated lethal ammunition magazines.

4.2.10 Launcher shall offer 3 different buttstock configurations: Folding, Telescopic, and Helmet-Visor compatible.

4.2.10.1. Folding buttstock configuration

4.2.10.1.1. Launcher shall offer a buttstock that positively locks into place directly behind main body of launcher, but can be disengaged via push-button release to fold buttstock alongside main launcher body for “compact” version.

4.2.10.1.2. Launcher shall be 28 inches (+/- 2”) in overall length, when measured from the most rearward point of the launcher to the most forward point of the launcher, with the folding buttstock in the non-folded position.

4.2.10.1.3. Launcher shall be 21 inches (+/- 2”) in overall length, with buttstock in “folded” position.

4.2.10.2. Telescopic buttstock configuration

4.2.10.2.1. Launcher will offer a buttstock that can extend and collapse via parallel rails along each side of the main launcher body. Buttstock will have positive locks at each position to prevent accidental collapse. These locks shall be capable of disengagement via push-button mechanism.

4.2.10.2.2. Launcher shall be 27 inches (+/- 2”) in overall length, with the buttstock fully extended

4.2.10.2.3. Launcher shall be 22.5 inches (+/- 2”) in overall length, when measured from the most rearward point of the launcher to the most forward point of the launcher, with the buttstock fully collapsed.

4.2.10.3. Helmet-visor compatible buttstock configuration

4.2.10.3.1. Launcher will offer a buttstock variation with

enhanced angling to accommodate shouldering the device while operator is wearing protective head/face equipment (i.e. face shield and/or gas mask).

Buttstock will have option to “fold” alongside main body of launcher for a “compact” version.

4.2.10.3.2. Launcher shall be 28 inches (+/- 2”) in overall length, with the buttstock in the non-folded position.

4.2.10.3.3. Launcher shall be 21 inches (+/- 2”) in overall length, launcher to the most forward point of the launcher.

4.2.11 Launcher shall incorporate a Stanag 4694 rail on top of the receiver to accommodate optics or other accessories.

4.2.13 Launcher shall weigh 10 pounds (+/- 3 pounds) when weighed in the following configuration: no magazine attached, full HPA attached, no sling attached.

4.3. Projectiles: In addition to the characteristics outlined in this section, the projectiles shall be compatible with the proposed devices as well as the

FN303 MK1.

4.3.1 PAVA Powder Projectiles:

4.3.1.1. Projectile weight: 8.5 grams + .01 grams

4.3.1.2. Formula: .5% (+ .03%) PAVA Powder

4.3.1.3. Projectile Construction: Fin-stabilized polystyrene

body

4.3.1.4. Forward payload: Non-toxic bismuth

4.3.1.5. Shelf Life: Minimum 5 years

4.3.2 Inert Projectiles:

4.3.2.1. Projectile weight: 8.5 grams + .01 grams

4.3.2.2. Formula: Inert Powder

4.3.2.3. Projectile Construction: Fin-stabilized polystyrene

4.3.2.4. Forward payload: Non-toxic bismuth

4.3.2.5. Shelf Life: Minimum 5 years

4.3.3 Washable Colorant Projectile

4.3.3.1. Projectile weight: 8.5 grams +/- .01 grams

4.3.3.2. Formula: 82% Propylene Glycol, 9% Pink Dye

Pigment

4.3.3.3. Projectile Construction: Fin-stabilized polystyrene

4.3.3.4. Forward payload: Non-toxic bismuth

4.3.3.5. Shelf Life: Minimum 5 years

4.3.4 Indelible Colorant Projectile

4.3.4.1. Projectile weight: 8.5 grams +/- .01 grams

4.3.4.2. Formula: 10% Propylene Glycol, 68% Acrylic polymer

4.3.4.3. Projectile Construction: Fin-stabilized polystyrene

4.3.4.4. Forward payload: Non-toxic bismuth

4.3.4.5. Shelf Life: Minimum 5 years

4.4. High Pressure Air Bottle (HPA): In addition to the characteristics outlined in this section, the HPA and Compact HPA shall be compatible with the proposed devices as well as the FN303 MK1.

4.4.1 High Pressure Air Bottle – Standard

4.4.1.1. PSI Rating: 3000psi

4.4.1.2. Capacity: Minimum of 45 projectile launches

4.4.1.3. Body: Department of Transportation (DOT) approved

4.4.1.4. Dimensions: 2 inches (+/- .5) in diameter and shall not exceed 14 inches in length, including fill nipple

4.4.1.5. Pressure Gauge: bottle must be equipped with pressure gauge with at least a reading of 0-3500 psi

4.4.1.6. Fill Connector: Must be equipped with fill nipple

compatible with fill adapter in section 4.5.

4.4.2 High Pressure Air Bottle – Compact:

4.4.2.1. PSI Rating: 3000psi

4.4.2.2. Capacity: Minimum of 40 projectile launches

4.4.2.3. Body: DOT approved

4.4.2.4. Dimensions: 2 inches (+/- .5) in diameter and shall not exceed 10 in length, including fill nipple

4.4.2.5. Pressure Gauge: bottle must be equipped with

pressure gauge with at least a reading of 0-3500psi

4.4.2.6. Fill Connector: Must be equipped with fill nipple

compatible with fill adapter in section 4.5

4.5. Fill Adapter: In addition to the characteristics outlined in this section, the fill adapter shall be compatible with the proposed devices as well as the

FN303 MK1.

4.5.1 Construction: Shall include relief valve to equalize pressure after charging HPA bottle

4.5.2 PSI: >3200 PSI

4.5.3 Connection: Shall include quick release fittings compatible with

HPA in section 4.4. Shall include compression knob attachment compatible with standard SCBA Tank.

4.6. Magazine: In addition to the characteristics outlined in this section, the magazine shall be compatible with the proposed devices as well as the

FN303 MK1.

4.6.1 Removable Magazine shall positively lock into the magazine well of the device to prevent dislodgement during rigorous movement.

4.6.2 Magazine shall be positioned so as not to interfere with operation of the launcher.

4.6.3 Magazine shall not require the use of batteries, nor incorporate electronic controls.

4.6.4 Magazine shall have a capacity of 15 projectiles.

4.7. Sling: In addition to the characteristics outlined in this section, the sling shall be compatible with the proposed devices as well as the FN303

MK1.

4.7.1 Two point sling shall attach to the launcher’s buttstock in the rear and shall attach to launcher’s forend.

4.7.2 Sling attachment points shall be equipped with two quick release nylon buckles to allow for the sling to be easily removed from the operator.

4.7.3 Sling shall be adjustable from lengths of no less than 40 inches to no more than 60 inches when measured from end to end.

4.7.4 The portion of the sling that contacts the operator shall be a minimum of 1” and a maximum of 2” wide.

4.8. Carrying Case

4.8.1 Shall be a waterproof, dustproof hard plastic case

4.8.2 Shall incorporate multiple easy open, double throw latches that positively secure the top and bottom of the case together.

4.8.3 Case shall accommodate launcher, HPA, sling, maintenance kit, and 1 speed loader and shall keep all items secure using a rigid foam insert.

4.8.4 Case shall be equipped with carrying handles and wheels on one end of the case.

4.8.5 Case shall be capable of accommodating a standard padlock to prevent unauthorized access to the interior.

4.9. Speed Loaders: In addition to the characteristics outlined in this section, the speed loader shall be compatible with the proposed devices as well as the FN303 MK1.

4.9.1 Speed loader shall attach to magazine to allow feed tube to feed directly into opening

4.9.2 Speed loader shall have a capacity of 15 .68 caliber projectiles

4.10. Maintenance Kit

4.10.1 Vendor shall include a maintenance kit as an item on the schedule of supplies that contains all replacement parts, gaskets and rings that are recommended for maintenance or repair.

4.11. MK1 Conversion Kit

4.11.1 Vendor shall include kit that upgrades the FN303 MK1 operating system to the MK2. This kit shall contain the following items:

4.11.1.1. Washer Bolt Spring

4.11.1.2. Buffer Spring

4.11.1.3. Cap Protective Flexible

4.11.1.4. Spring Bolt

4.11.1.5. Bumper Bolt

4.12. MK2 Tactical Conversion Kit

4.12.1 Vendor shall include kit that converts FN303 MK2 Standard to FN303 MK2 Tactical. This kit shall contain the following items:

4.12.1.1. Support, Buttstock Assembly

4.12.1.2. Standard Buttstock Module, Adjustable

4.12.1.3. Foldable Black Mechanical Front and Rear Sights

4.13. Barrel

4.13.1 MK2 Barrel: 9 inches – 10.5 inches in length and compatible with the MK2 series launcher.

4.13.2 Tactical Barrel: 7 inches – 8 inches in length and compatible with the MK2 series launcher.

5. PERFORMANCE REQUIREMENTS - The performance requirements below will be evaluated on both Standard and Tactical Model (Folding Buttstock configuration).

5.1. Muzzle Velocity: must produce a consistent muzzle velocity of 280-300 feet per second with the specified projectiles in section 4.3 and HPA specified in section 4.4. This evaluation will be conducted using the supplied weapon system with an HPA bottle, a chronograph, and a fixed launching position. The distance between the muzzle and the chronograph will be 24 inches (±2”). All projectiles will be launched with an HPA bottle pressure of 2400 – 2800psi. The weapon operator will launch 100 inert projectiles through the chronograph’s detection area. To pass, 95% of projectiles must have a minimum velocity of at least 280 feet per second (up to 5% may be below this), but no projectiles may exceed 310 feet per second.

5.2. Accuracy: must maintain accuracy to produce no greater than 9 inch group at 30 feet from target, using projectiles that meet specifications in section 4.3. This evaluation will be conducted using standard targets, the supplied device, and a fixed launching position. The weapon operator will launch 3 series of 5 projectile groups for each projectile type.

Measurements shall be taken after each group is completed, using a 9 inch circular template. All shots will be measured at the center point of the impact and must be within the template’s coverage area, and all groups must meet the accuracy specifications above to pass.

5.3. Full Capacity Operation: This evaluation will be conducted using the supplied device and supplied projectiles. The device’s magazine will be loaded with 15 inert projectiles. The device operator will shoulder the launcher with the launcher parallel to the ground and launch 15 projectiles at a rate of 1 projectile per second. This process will be repeated an additional 9 times for a total of 10 full magazines expended. To pass, the launcher must launch 150 projectiles with no more than a total of 20 malfunctions and no more than 2 malfunctions per string of 15.

6. ADMINISTRATIVE REQUIREMENTS

6.1. Quality Control (QC) and Quality Assurance (QA)

6.1.1 No changes in design of any device or accessory shall take place without the prior approval of the COR and the CO.

6.1.2 Devices and accessories which fail any portion of the vendor’s

(including manufacturers) QC processes shall be rejected and not shipped. No further attempts shall be made to correct or otherwise remediate a device or accessory which has failed any portion of the QC testing, for purposes of delivery.

6.1.3 The Government may conduct periodic random QA testing of devices and/or accessories produced, to ensure items meet performance requirements for which the contract was awarded.

6.1.4 QA may or may not be conducted by Government personnel at a

Government owned facility.

6.1.5 Devices and/or accessories which fail QA testing may be sent back to the vendor, at no cost to the Government, and replaced with an equal amount of new supplies. If a second or subsequent failure (for the same test) occurs within the same batch, this will be considered a batch failure. The vendor shall be notified by the COR, in writing, of the nature of the failure, defect, or deficiency and the vendor shall replace the entire batch at no cost to the government.

6.1.6 Vendor shall take corrective action within seven (7) calendar days of written notification of any non-conformance. Corrective action shall include shipping of replacements for all defective, deficient, or suspect devices and/or accessories. The vendor shall also provide a written failure analysis plan to the COR within 7 calendar days of written notification. A completed failure analysis report, to include preventative measures, shall be submitted to the COR within 60 calendar days of notification of non-conformance.

6.2. Warranties

6.2.1 Vendor shall warrant all products contained in this contract to be free of defects. Vendor further warrants that the product conforms to all applicable requirements as outlined within this Statement of Work, and guarantees that the product will maintain useful shelf life under reasonable storage conditions (both CONUS and OCONUS) for a period of five (5) years from the date of product acceptance.

6.2.2 The vendor shall provide to the COR a single point of contact

(including name, phone number, and email address) who will handle all warranty claims occurring under this contract.

6.2.3 The vendor shall utilize FEDEX, UPS overnight, or other trackable next day service for all warranty shipments to the government.

Ground service may be used for return shipping. Exemptions may be authorized by the COR on a case by case basis. All shipping charges associated with warranty claims (both to and from the Government) shall be the vendor’s responsibility.

6.3. An Owner’s manual for the specific make and model of the launcher should be submitted in English, which details at a minimum:

6.3.1 Rules of launcher safety (safe handling)

6.3.2 Operation of the launcher

6.3.3 Loading and unloading procedures

6.3.4 Disassembly and re-assembly procedures

6.3.5 Cleaning and maintenance

6.3.6 Technical specifications

6.3.7 Exploded view of the device with parts nomenclature

6.4. Government Access of Contractor’s Facility

6.4.1 The vendor shall permit the Government to conduct quality control inspections of the vendor’s facility (including production facility) to ensure consistency of manufacture and quality of products ordered and delivered.

6.4.2 The authorized inspection team shall be identified in writing by the

COR or the CO.

6.4.3 The minimum advance notice of inspection shall be three business days.

6.4.4 Inspections may include all aspects of manufacturing, testing, quality control, and packaging.

6.5. Production Capacity

6.5.1 The Government requires that a vendor have the capacity to manufacture a minimum of 300 launchers per quarter.

6.5.2 The Government reserves the right to verify the company’s ability to produce at an acceptable level in accordance with the requirements. This may include a pre-award site visit.

6.5.3 Orders for devices and/or accessories in excess of the minimum production capacity indicated above shall be shipped in accordance with instructions in any resultant delivery order.

6.6. Distribution Authorization

6.6.1 With proposal submission, the vendor (if not the manufacturer) shall provide a letter from the manufacturer indicating it is an authorized distributor/retailer of the device and its accompanying accessories.

Unauthorized distributors and retailers are unacceptable and will not be considered.

6.7. Shipping: All items are to be shipped Freight on Board (FOB) destination.

6.7.1 Shipping locations may be centralized or may include individual locations throughout CONUS, Alaska, Hawaii, and Puerto Rico, and Canada.

6.7.2 Shipping methods for each location may be specified by CBP at the delivery order level and may vary depending on location, quantity of items, and receiver’s ability to handle freight shipments.

6.7.3 All shipments shall be trackable. Tracking information shall be provided to the COR (or designate) upon request.

6.7.4 The vendor shall provide advanced notice of shipping via email 2 business days prior to each shipment. Notification shall be sent to the COR or the designate, and to the local recipient for each shipping location. The local recipient’s name and contact information will be included on the delivery location spreadsheet that will be provided at the award of the contract/delivery order.

6.8. Packaging

6.8.1 Material shall be packaged, packed and marked for shipment in such a manner that will ensure acceptance by common carriers and safe delivery at destination.

6.8.2 Packages shall be clearly identified on the outer wrapping with the contract number and delivery/task order number, if applicable.

6.8.3 Pallets and associated packaging, when used for shipping, shall be fully enclosed and shall be stackable, allowing for a second complete pallet to be placed on top of a first complete pallet, without structural problems or damage to the contents of either pallet.

6.9. Vendor Performance Conferences

6.9.1 Within 30 days of contract award, the vendor shall host a pre-production meeting telephonically.

6.9.2 CBP and the vendor may meet via video conferencing once per year, commencing six months after production begins and continuing approximately every year thereafter. These performance conferences are to discuss contract issues, review technical and financial status of the contract, discuss vendor and Government performance, and to resolve any issues or problems as they may arise.

6.9.3 Government attendees may include the Contracting Officer, Contract Specialist, COR, representatives from the CBP components, and LESC subject matter experts.

6.10. Reporting Requirements

6.10.1 A delivery order report should be sent to the COR of the contract on a quarterly basis. The report should include a cumulative line item Excel spreadsheet of all delivery orders and include the following:

6.10.1.1. Name of purchasing agency/group

6.10.1.2. Delivery order number

6.10.1.3. Unit cost

6.10.1.4. Quantity of units on the delivery order

6.10.1.5. Value of delivery order

6.10.1.6. Current quantity of units shipped

6.10.1.7. Remaining number of units to be shipped; and

6.10.1.8. Total dollar amount spent against the contract to date

6.10.2 Warranty Work Report should be sent to the COR of the contract on a quarterly basis (31 December, 31 March, 30 June, 30 September). The report should include a line item summary of all warranty activity, as well as, the numerical totals of claims received, total completed, and the average number of days required for completion. It shall be categorized by agency, purchasing group, or ordered chronologically by the date the vendor received notification.

Each line in the report shall contain the following information:

6.10.2.1. Return merchandise authorization (RMA) #

6.10.2.2. Date vendor was notified

6.10.2.3. Date corrected item was shipped to vendor

6.10.2.4. Brief statement of problem

6.10.2.5. Brief statement of solution; and

6.10.2.6. Date shipped back to the Government

6.11. Media Statements

6.11.1 All press statements and releases related to the contract must receive advanced written approval by the Contracting Officer and

COR.

7. DELIVERABLES AND DELIVERY SCHEDULE

7.1. Orders shall be delivered to the addresses per the delivery location spreadsheet that will be provided at the award of the contract/delivery order. Items are to be received at the delivery locations within 60 days after award is received.

7.2. All orders placed for the Extended Range Less Lethal Pressurized Air Launcher and kit shall specify at time of order which buttstock configuration should accompany the device.

8. PERIOD OF PERFORMANCE

8.1. The ensuing contract will have a five (5) year period of performance from date of award of contract.

9. SECURITY

9.1. All work under this SOW is unclassified, but may require secure handling of information designated as “For Official Use Only” (FOUO) and/or personally identifiable information (PII).

9.2. Vendor personnel who will perform work on the contract may be required to execute a non-disclosure agreement which must be delivered to the COR prior to commencing work in accordance with DHS policy for safeguarding FOUO information.

10. SPECIAL CONSIDERATIONS

10.1. Any future formula changes or deviations from awarded items must be approved by CBP Law Enforcement Safety and Compliance.

10.2. No changes in design of any delivery item shall take place without the prior approval of the COR and CO.

10.3. For accountability purposes, the vendor shall provide a list of serial numbers with barcodes for each delivery order in which less lethal pressurized air launchers are shipped. This list shall be in numerical order and shall include vendor’s name and address, delivery order number, invoice number, sales order number (if separate), make and model of the launchers, unit cost, quantity, and total cost.
