Boston National Historical Park Snow Removal Contract
Statement of Work April 17, 2020
1. BACKGROUND
1.1 Mission of Boston National Historical Park:
Boston National Historical Park preserves, protects, and interprets for the benefit and inspiration of all people the historic structures and properties of outstanding national significance located in Boston and associated with the American Revolution and the defense and growth of the United States.
1.2 Description of Boston National Historical Park:
Boston National Historical Park is a unique collaboration of federally, municipally and privately owned and operated historic sites associated with the colonial struggle for independence and the birth and growth of the nation. These nationally significant attractions include the Old South Meeting House, the Old State House, Faneuil Hall, the Old North Church, the Paul Revere House, the Bunker Hill Monument, the Bunker Hill Museum, Dorchester Heights, and the Charlestown Navy Yard including USS Constitution, the USS Constitution Museum, and USS Cassin Young.
2. SCOPE
The Contractor shall provide all management, supervision, labor, transportation, tools, supplies, and equipment for snow, slush and ice removal services, during the period of performance for the Boston National Historical Park.
Specific site locations subject to this statement of work and listed in order of priority are as follows:
1. The Charlestown Navy Yard
2. The Bunker Hill Monument/Museum
3. The Dorchester Heights Monument
Snow, slush and ice removal services will be performed in a manner to assure park areas are open for operation. Contractor shall plan, schedule, coordinate and assure that snow, slush and ice removal services result in a satisfactory, safe, clean, neat and professional appearance 24/7.
2.1 Objectives:
2.1.1 The Contractor shall maintain clear and make for safe travel all roadways, sidewalks, walkways, stairways, ramps, cross walk entrances, and living quarter entrances. A list of areas and descriptions are located in section four “Facility Information”.

3. SNOW REMOVAL
The guidelines outlined in this document are for achieving the maximum vehicle and pedestrian safety relative to snow, slush and ice conditions on these properties and as outlined within the Scope.
NOTE: The Contractor will sign in at the Telecommunications Operations Center (TOC) Bldg-109 at the head of pier 1at the Boston National Historical Park, Charlestown Navy Yard, Boston, MA. Completed work is subject to review and inspection by the Contracting Officer Representative (COR).
3.1 General Requirements
The Contractor will take full responsibility for plowing, removal of snow, slush and ice and salting as needed, in order to have pavement as bare as the weather will permit and ensuring all hazardous conditions are eliminated. The Contractor must supply a lead/supervisor contact name and 24 hour on-call contact number(s). The Contractor must have the equipment necessary to perform these tasks.
Contractor will meet with the Contracting Officer Representative (COR) to receive information on snow piling points.
Snow removal will be completed prior to first shift time of 8:00 am local prevailing time. The Park Service will provide a detailed map (Attachments A, B & C) of each park area to assist with the snow removal process.
3.2 Snow, Slush and Ice Removal Service
The Contractor shall perform snow, ice and slush removal when accumulation reaches two (2) inches or more on a level surface, or if conditions warrant treatment for the safety of pedestrians and vehicles. Ice and all other hazardous conditions shall be treated with environmentally preferable approved products only. The Contractor shall immediately remove ice to provide secure footing and safe driving conditions by the snow removal operation, or by applying approved ice melting materials. The Contractor will perform snow removal services during a continuous snowfall. The Contractor shall remove snow, ice and slush from streets from curb to curb, or edge of street to edge of street, leaving no rows in intersections, and all service areas. The Contractor shall avoid depositing plowed snow in the front of, or in driveways, on sidewalks, walkways or street corners. Safety for the employees and public will determine the need for specific follow-up services.
The Contractor shall be responsible for monitoring snow, slush and ice conditions and responding with the appropriate manpower and equipment to ensure the areas are clear of ice, slush and snow accumulations. With a snowfall deep enough to cause drifting of six (6) inches or more, areas shall be automatically plowed, blown and/or pushed to the extent necessary to provide essential pedestrian and vehicle traffic safety.
Road salt and approved environmentally preferable ice melts shall be used to reduce safety hazards resulting from ice, slush and snow. Material Safety Data
Sheets (MSDS) will be provided by the Contractor on all materials utilized and approved by the COR via a submittal process approval. Only approved ice-melts are to be used on all concrete and asphalt sidewalks. Calcium chlorides or other acceptable methods can only be used as approved by the COR.
3.2.1. Submittals: All supplies utilized under contract are to be submitted for approval by the contractor within five calendar days after award. The government shall review submittals within three calendar days from date of contractor submission. Should re-submission be required from the contractor, all re-submissions are due three calendar days from receipt of initial government comments. The government shall provide comments on re-submissions within three calendar days of re-submission.
Snow, slush and ice shall be removed as needed from all on-site catch basins to allow adequate run off of melting ice and snow. No snow, slush or ice will be dumped on or near trees, shrubs and flower beds or in any waterways.
Snow, slush and ice must be removed when there is insufficient space in the designated approved pile areas (as determined by the COR) on the property to accommodate the piling of snow, ice or slush, or when it interferes with the operations safety, line of traffic or parking of the property. Snow, slush and ice must be removed and hauled off site by the Contractor to an appropriate snow dump area in compliance with all Federal, State and local laws and within all OSHA laws and regulations.
Work shall be performed in a manner so as not to encumber walkways, entrances, exits, or streets. All leftover debris from snow, slush and ice removal shall be carefully removed by the Contractor from all landscape and grass areas at the close of winter season and prior to landscape maintenance services.
3.3 Service Areas
Service areas include entrances, steps, landings, sidewalks, crosswalk entrances, roadways, parking areas and any other hard surface areas subject to vehicle or pedestrian traffic.
The Contractor shall be legally and financially responsible for all plowing conducted on unapproved streets, lots and drives not specifically identified in this contract.
3.4 Special Removal Areas
Snow, slush and ice shall be removed from fronts of pedestrian and garage doors.
Hand shovel areas around the dumpsters; recycle totes, and entrance and exit gates. Areas around security access points shall also be kept clear of snow, slush and ice to allow for full access by either a vehicle or pedestrians, based on intended type of access.
3.5 Administrative
A separate snow removal log shall be maintained by the Contractor to record actual hours expended on snow removal for each piece of equipment per location.
A copy of the log will be given to the COR at the end of services for each removal event.
3.6 Damage Repair/Replacement
The Contractor is responsible for the repair or replacement of any damage caused by the snow, ice and slush removal activities to include, but not limited to:
Buildings, lawns, landscaping (i.e. trees shrubs hedges), fencing, gates, doors, light poles, pavement, curbs, sidewalks, etc.
The Contractor shall make immediate, temporary repairs to damages that cause a safety hazard. Temporary repairs of such damages shall be made within 24 hours of when the damage occurred, and shall be coordinated through the COR.
3.7 Equipment and Labor Requirements
The Contractor shall furnish the necessary labor and supervision to clear snow, slush and ice from the facility. The Contractor shall furnish trucks and equipment as required to complete the snow plowing or snow, slush and ice removal process in a timely manner. The Contractor shall furnish with each separate piece of equipment capable licensed drivers in sufficient numbers to ensure that all equipment is being operated safely and efficiently. The Contractor shall furnish relief drivers, when extended periods of work require it, in accordance with all Federal, State, local and OSHA laws.
The equipment, before being accepted for actual work, must be in proper mechanical condition, fully equipped as required for efficient operation, properly registered and insured in accordance with Federal, State and local laws. The equipment must be equipped with accessories to meet the existing traffic and traction conditions. Equipment should be equipped with safety features including a rotating amber light on the top of the vehicle, back up warning sounding and tripping devices to protect manholes, bricks and other protrusions above the surface of the pavement.
In the event that the Contractor’s equipment fails during a plowing operation, the Contractor or his representative must notify the COR and must have the area covered with a replacement vehicle or other snow, slush or ice removal equipment within one hour.
The Contractor must report immediately to the COR the following: An inability to start snow removal services at appointed time, if any location cannot be serviced and reason.
One way streets shall be plowed to each curb. At no time shall the Contractor plow a one-way street in the wrong direction or against the traffic pattern without permission from the COR.
If a street is blocked, the Contractor shall make every effort to attempt to bypass the blockage. If unable to bypass the blockage, the Contractor shall immediately inform the COR of the blockage. The Contractor will plow the blocked area as soon as the blockage is removed.
Snow left at intersection corners is to be no higher than the normal residual on the side of the road.
4. Facility Information:
4.1 Charlestown Navy Yard: See Location specifics under item 5.1 o 1st Avenue & 2nd Avenue o 3rd Street, 4th Street and sidewalks along 5th street o Pier 1 roadway’s and parking areas o Pier 2 access road and access around Building 24 o Navy secured area including security gate area o Baxter Road east side of building 24 parking area and Baxter Road traffic lane closest to building (Be aware of Blue Bike area) o Building I loop driveway, all sidewalks, stairs and entrances o Quarters G (Commandant’s House) driveway, all walkways, stairs and entrances o Capstan area and Constitution Museum entrances, walkways and crosswalk entrances o Sidewalks and walkways including Gate 1, Gate 2, & Gate 4 areas o Building 32 sidewalks, entrances and cross walk access points o Sidewalk to end of Hoosac storage lot from Gate 1 (City will clear bike lane o Door entrances, stairways and all crosswalk access points
4.2 Bunker Hill Monument/Museum: See Location specifics under item 5.2 o Exterior sidewalks around Monument Square and all cross walk access points o Handicap ramp o All stairways and walkways located on the property require clean-up o Sidewalks abutting Museum o Door entrances
4.3 Dorchester Heights Monument: See Location specifics under item 5.3 o Exterior sidewalks around Monument and cross walk access points o Handicap ramps o All stairways and walkways located on the property require snow and/or ice removal services
5. Tasks for Facility Specifics/Order of Park Cleaning Priorities:
5.1 Priority of Service
5.1.1. Charlestown Navy Yard (Priority One)
Snow, slush and ice removal of the Charlestown Navy Yard property will be the highest priority property on the Contractor's snow removal commitment list. Performance shall begin automatically and immediately without request or call from the government, when snow accumulations reach two (2) inches. The Contractor is responsible for monitoring each individual site for accumulations and conditions and for responding with the appropriate manpower and equipment to ensure the areas are clear of ice, slush and snow accumulations. Snow, ice and slush shall be removed prior to 8:00 am EST. Contractor shall maintain all service areas, walkways and parking areas from accumulations.
During times of extended storm durations, this may result in the Contractor having to service the areas multiple times throughout the day/night.
Priority areas are as follows: All roads within the Charlestown Navy Yard and sidewalks along 1st Ave. Ice melting to be performed upon completion.
The Navy Yard roadways will be plowed with trucks throughout the storm to maintain continuous vehicular access. Any area not at bare ground condition will be SALTED after final plowing or other snow, ice and slush removal service and to ensure safety of pedestrians and vehicle travel. All roadways are to be handled via truck with snow plow. 1st Ave sidewalks, Gate 1, Gate 2, & Gate 4 areas, 5th Street walkways, and Marine Society are to be cleared utilizing a Bobcat. Other areas at this site may use a Bobcat for clearing as long as no damage will be done to Park resources.
Clarification with COR must be discussed prior to using a machine in any area that is not designated on maps. (See Attachment A.)
Areas requiring snow blowing include: The Row Houses (Building 265 B, C, D, E and F) stairs and walkways, 2nd Ave sidewalks, the walkways and stairs at the cannon and flagpole area, all cross walk locations, Building I stairs and walkways, and Quarters G stairs and walkways. The Contractor shall ensure a pathway of three feet wide is free of snow accumulations, piles, or drifts by removing all snow, slush and ice from sidewalks, steps, landings and entrance ramps. The Contractor will determine the best practice on how to utilize their crew to provide periodic service to prevent excessive buildup of snow.
5.1.2. Bunker Hill Monument/Museum (Priority 2)
This location does not require continuous service throughout the storm.
Focus is to have the areas identified cleared to the pavement prior to the opening of the Park at 8:00 am EST. The Contractor will determine the best practice on how to utilize their crew to provide periodic service to prevent excessive buildup of snow. This will be done in order to provide sufficient time for all areas to be cleared of snow, slush and ice and for ice melt to be applied before the scheduled opening of the Park. No trucks with plows are to be used at this site. Bobcats, shoveling and snow blowing are allowed (See Attachment B).
5.1.3. Dorchester Heights: (Priority 3)
This location does not require continuous service throughout the storm.
Focus is to have the areas identified cleared to the pavement following a snow, slush or ice event, and after Navy Yard and Bunker Hill areas are complete. No plows are permitted at this site. Bobcats, shoveling and snow blowing are allowed. Ice melt is to be applied on finished product.
(See Attachment C).
6. Restrictions
6.1 Use of SAND is strictly prohibited. Contractor will be responsible for cleanup if sand is inadvertently used.
6.2 Only SALT products will be used on the roadways. Only
environmentally-preferable ice melt for walkways and stairs is allowed for use. Coordinate approvals of products used with COR. The National Park Service has requirements to maintain the use of environmentally preferable (GREEN) products.
6.3 Minimal and specific storage areas will be available for contractor supplies and small tools subject to approval by COR and based on availability.
a. Storage is approximately 12 x 20 feet in size and located in Building
269. The Contractor will keep the provided storage area clean and organized, in accordance with all OSHA safety protocols. No flammable or explosive liquids such as gasoline will be stored in the building. All stored materials require COR approval. Contractor is responsible to ensure that the storage area is clear of all debris, supplies and tools at end of snow removal season.
6.4 Requests to store equipment on site shall be made to the COR 24 hours in advance. Equipment will not be stored on site without approval from Contracting Officer Representative.
6.5 Contracting Officer Representative will monitor the Contractor for compliance with Facility Specifics defined in Section five.
6.6 Contractor will be responsible for any damages arising from work performed to Park resources. Contracting Officer Representative will monitor and conduct site inspections during contract performance period.
7. Site Specific Other Items
7.1 Contractor will be solely responsible for all environmental mitigations that may become necessary as a result of work performed under this contract.
8. Contractor Furnished Items
8.1 Contractor Item Responsibilities
8.1.1 Permits/Licenses
In performing the work hereunder, the Contractor shall obtain and maintain in effect all necessary permits and licenses required by Federal, State or Local government or subdivisions thereof, or of any other duly constituted public authority. Further, the Contractor shall obey and abide by all applicable laws and ordinances.
8.1.2 Supervision, Supplies, Materials, Transportation and Equipment This contract calls for the Contractor to furnish all supervision, labor, supplies, materials, transportation and equipment necessary for the completion of the work of this contract unless otherwise specified herein.
Contractor must provide the MSDS sheets for all chemicals approved for use.
8.1.3 Safety and Equipment Condition
The Contractor shall use only ice-melts which are environmentally preferable in accordance with all Federal, State and Local laws. All equipment must have all required safety features in accordance with the manufacture’s operation manuals.
9. Supervision Responsibilities- Management Contact
9.1 Policy and Procedure
9.1.1 Supervision
The Contractor shall be responsible for the supervision of his/her employees while performing work under this contract. The COR will perform periodic inspections in order to ensure compliance with requirements of this Contract.
9.1.2 Verbal Correspondence
The Contractor shall designate a representative who shall be the point of contact on behalf of the Contractor. Representative must speak English fluently, read and comprehend written English and compose coherent written reports in English.
9.1.3 Contact Information
The Contractor must provide the name(s), addresses, and phone numbers of persons representing the Contractor to the COR five (5) days prior to beginning the work under this contract.
9.1.4 Inspection Reviews
The Contractor is required to have their representatives review the work being performed to ensure compliance with the terms and requirements of this contract. These inspection reviews shall be completed at least once per week throughout the duration of the contract. The representatives may also serve in a supervisory capacity if the Contractor so desires. The COR retains the right to call back the Contractor for additional clean up, if not completed in accordance with statement of work requirements.
9.1.5 Contract Authority
The Contractor's representatives designated in writing by the Contractor shall have complete authority to act for the Contractor during the duration of this contract. The representatives shall be contacted by the COR in the event of any problems or special circumstances.
10. Other Contractor Considerations
10.1 Loss of Equipment
The Government cannot and shall not be held responsible for loss of vehicles, machinery, tools, equipment, or materials sustained by the Contractor.
11. Accident Report Procedures
11.1 Personnel or Property Accident Reporting.
Accidents should be reported immediately to the COR and to the TOC at 617- 242-5678. In the event of an accident involving Government personnel or property, the Contractor shall submit a report within one workday after an accident to the Contracting Officer in letter form that will include the following: Time and date of occurrence; the place of occurrence; a list of personnel directly involved; a narrative description of the accident that includes a chronological order of the accident and circumstances; and witnesses names and contact information.
12. Use of Government Premises
12.1 Government Premises
12.1.1 Operation Compliance of Premises
The Contractor shall comply with all regulations and security requirements governing the operation of the premises, which are occupied, or the area in which the contract work is to be done.
12.1.2 Interruption/Interference with Government business
The Contractor shall perform the contract in such a manner as to not interrupt or interfere with the conduct of Government business.
12.1.3 Orientation of Facility
The Contractor and his employees shall become familiar with and obey all government facility regulations, including fire, traffic and security regulations.
13. Contractor Legal Requirements, Permits/Code Compliance
13.1 Federal, State, Local Licenses, and Permits
The Contractor shall obtain at his own expense, all necessary Federal, state and local licenses and permits and shall conform to all laws, regulations, ordinances and code requirements applicable to satisfactory completion of this contract. Full responsibility for compliance with this clause shall rest with the Contractor and the Government shall assume no liability for failure.
14. Hazardous Materials
14.1 Disposal and chain of disposal
Hazardous materials, waste, or dangerous materials generated by the contactor will be properly disposed of by the Contractor and the chain of disposal given to the COR prior to final invoicing.
The contractor is responsible for all clean-up resulting from spills and leaks of equipment. The contractor is to notify the COR immediately upon any spill or leak occurrence.
14. Physical Security
14.1 Security Requirements
14.1.1 Sign-in and Sign-out at Facility
The Government reserves the right to require Contractor personnel to "sign-in" upon entry and "sign-out" upon departure from the facilities in accordance to Section 3. Snow Removal, refer to “NOTE”
15. Quality Control Program
15.1 Quality Control Plan
The Contractor must submit two copies of a detailed Quality Control Plan.
The plan will be site specific and will inform the COR how the work, supervision, project management and follow up will be performed under this contract to insure compliance with all requirements. The QCP is intended to provide a structured process and detailed plan that will help the Contractor manage the services and identify any deficiencies before the service execution becomes unacceptable.
The QCP must be kept current at all times to reflect all contract modifications and changes in plan. If anything in the plan is revised, the plan must be physically updated, and the changes are to be reported to the COR and approved by the Contracting Officer.
16. Surveillance by Customer Complaint
16.1 Investigation/Validation/Notification and Record Archive When a complaint is received, the COR will investigate, validate the complaint, notify the Contractor of the defect and maintain a record of the complaint. The contractor is to respond within one to four hours of receiving the complaint and provide the COR information on next course of action to rectify the complaint.
17. Contracting Officer Authority
17.1 Issuing Modifications and Change Orders
The Contracting Officer retains the sole right to issue modifications and change orders. In no event shall any understanding or agreement, contract modification, change orders or other matter in deviation from the terms of this contract, between the Contractor and a person other than the Contracting Officer, be effective or binding upon the Government. All such actions must be formalized by a proper contractual document executed by the Contracting Officer.
18. Contracting Officer Representative (COR)
18.1 CO/COR/Government Authorized Representative Responsibilities
18.1.1 Technical Contact/Technical Representative
This will be the Boston National Historical Park’s technical contact person or Contracting Officer's Representative. The (COR) information will be provided upon award of the contract.
18.1.2 COR Responsibilities
The Contracting Officer will designate the COR or Government Authorized Representative at time of contract award. The responsibilities of the COR include, but are not limited to determining the adequacy of Contractor completion efforts in accordance with the conditions of this contract.
17.1.3 Inspection and Monitoring of the Contractor's Work
The COR is responsible for the inspection and monitoring of the Contractor's work. The responsibilities of the COR include, but are not limited to: Inspecting the work to ensure compliance with the contract requirements; documenting through written inspections reports conferring with representative of the Contractor regarding any problems encountered in the successful execution of the work.
18. Definitions/Acronyms As used throughout this contract, the following definitions/acronyms shall have the meaning set forth below:
CO- Contracting Officer - The National Park Service person for the Boston National Historical Park with the authority to enter into contracts, administer and terminate contracts and make related determinations and findings.
Contractor - The entity that provides the services described in the Statement of Work.
Contractor Manager - That person, or designated alternate, responsible for insuring that required services are performed properly, and who is the one point of contact responsible for interaction with government personnel. They are also responsible for supervising the Contractor's employees.
COR- Contracting Officer’s Representative - An employee who is designated and authorized by the Contracting Officer to answer technical questions, provide for inspections, certify invoices for payment and assist in administering the contract.
Defective Service - A service output that does not meet the standard of work established by this contract.
Emergency - Any significant disruption of normal facility procedure, policy or activity caused by riot, strike, fire, medical emergency, natural disaster or other serious incident.
MSDS - Material Safety Data Sheet - The MSDS is a detailed informational document prepared by the manufacturer or importer of a hazardous chemical. It describes the physical and chemical properties of the product. Material Safety Data Sheets contain useful information such as flash point, toxicity, procedures for spills and leaks, and storage guidelines. Information included in a Material Safety Data Sheet aids in the selection of safe products, helps you understand the potential health and physical hazards of a chemical and describes how to respond effectively to exposure situations
QA - Quality Assurance - A method used by the Government to provide control over the quality of purchased goods and services.
QC - Quality Control - Those actions taken by a Contractor to control the execution of required services so that the standards of the contract are met.
QCP - Quality Control Plan - The plan will be site specific and will inform the Contracting Officer’s Representative how the work, supervision, project management and follow up will be performed in this contract to insure compliance with all requirements.
SOW- Statement of Work- This Statement of Work (SOW) describes the contract requirements and is intended to support the facility services at Boston National Historical Park sites identified herein specifically.
