Section A - Statement of Work

1.0 INTRODUCTION

The Casper Field office is contracting for the installation and permitting of 18-22 Beaver Dam Analogs within Bolton Creek using Low Tech Restoration Techniques as described in Low-Tech Process Based Restoration of Riverscapes: Design Manual. Locations of BDAs on map are approximations and offeror can move structures with approval of the COR as well as add up to four additional structures as needed to best suit the riverscape.

Bolton Creek in this location is an intermittent channel with some riparian vegetation including Cottonwoods and Willows. Bolton Creek is incised and in places water no longer reaches the floodplain except at extreme high flow events. A riparian exclosure and a 16’ bottomless culvert are in the project area. Monitoring within the exclosure has shown an increase in riparian vegetation but cross sections has shown the channel continuing to incise within the lower portion of the reach. Woody species are showing heat stress later in the season. Several woody debris jams have increased the bed elevation and riparian vegetation has increased in these sections.

PERFORMANCE TIME:

The Contractor shall begin performance within 10 calendar days after receiving the notice to proceed and complete all tasks within 60 days.

ESTIMATED START WORK DATE:

June 15, 2024

3.0 Contractor Furnished Items

The Contractor shall:

• Provide a full Work Plan (including work schedule) as specified in Section 6.0 Schedule.

• Provide all labor and supervision necessary to implement all Task Items in this Contract.

• Provide all equipment, materials, supplies, and all incidentals necessary to implement all Task Items in the project area. Contractor-provided equipment shall include but not be limited to the following:

o Access vehicles.

o Any equipment needed for construction.

4.0 Government Furnished Items

Government will furnish Wyoming State Engineers Office permits and signed NEPA documents.

5.0 Specific Tasks

All work will only use hand tools and all vehicles must stay on designated roads. Atv’s or UTVs may be used to shuttle material to the drainages but must stay out of the drainages and only when conditions are dry.

Offeror will follow all mitigation measures as described below.

• This action occurs within 1 mile of a constructed artificial nesting structure (ANS) for raptors.

Surface disturbing and/or disruptive activity will not be allowed from February 1st – July 31st within these areas. The duration of this annual seasonal restriction may be shortened or lengthened based on the fledging chronology of the chicks in an active nest. This seasonal restriction would be in effect annually for the duration of the life of this action or any subsequent activities associated with the approval of this action. This stipulation in no way relieves the operator from their responsibility to comply with all aspects of Federal Laws such as the Migratory Bird Treaty Act and the Bald and Golden Eagle Protection Act.

• This action occurs within ½ mile of a designated Bald eagle Feeding Concentration Area. A Timing Limit Stipulation (TLS) from November 1st- March 31st prohibiting surface disturbing and/or disruptive activities to protect foraging eagles will be enforced.

• This action is within an area designated by the Wyoming Game and Fish Department as crucial winter range for pronghorn antelope. Surface disturbing and/or disruptive activity will not be allowed from November 15th – April 30th within these areas.

• Vehicles will stay on established roads and all material will be hand carried into the site.

• Work will be carried out when the channel is dry or low flow, usually later in the summer/ early fall.

• No vehicle traffic will be allowed off-road except in case of emergency.

• All staging locations will be located immediately next to existing two-tracks or roads.

• All construction material will be hand carried to the individual BDA locations.

• No local soil or rocks will be used in the construction of the BDAs; digging or other modification of soil will only be allowed within the creek bed.

• All activities associated with this undertaking will take place only in the survey boundaries; further Section 106 analysis will be required for any additions/extensions of the project outside the current survey area. A redacted map and or shapefiles will be provided to the CFO hydrologist and WGFD showing the area in which they can access Bolton Creek and where they can construct BDAs.

• Dead and down vegetation can be used for construction of BDAs but can only be picked up or cut off existing vegetation; no digging to obtain additional vegetation will be allowed.

• If any archeological materials are found during construction, work will cease within a 100’ of the find and the BLM CFO will be contacted.

Standard Cultural Heritage Stipulations The operator is responsible for informing all persons in the area who are associated with this project that they will be subject to prosecution for knowingly disturbing historic or archaeological sites, or for collecting artifacts. If historic or archaeological materials are uncovered during construction, the operator is to immediately stop work that might further disturb such materials and contact the authorized officer (AO) of the BLM Casper Field Office. Within five working days the AO will inform the operator as to: (1) whether the materials appear eligible for the National Register of Historic Places; (2) the mitigation measures the operator will likely have to undertake before the site can be used (assuming in situ preservation is not necessary); and, (3) a timeframe for the AO to complete an expedited review under 36 CFR 800.11 to confirm, through the State Historic Preservation Officer, that the finds of the AO are correct and that mitigation is appropriate. The AO will provide technical and procedural guidelines for the conduct of mitigation. Upon verification from the AO that the required mitigation has been completed, the operator will then be allowed to resume construction measures.

6.0 Work Plan

Offerors shall provide a Work Plan as part of application for this contract. Offeror submittals will be ranked partially on the quality and feasibility of Contractor Work Plan (Section 13). Inspection and acceptance (Section 10.0) will be based on Contractor following of Contractor Work Plan. Contractor Work Plan shall include, at a minimum and separately for each task:

• Labor. Number and specialties of all Contractor staff used. Resumes/Work experience must be provided for all technical specialists producing deliverables for this contract.

Work Schedule: At the prework conference, the Contractor shall provide a work progress plan that details the proposed Contractor work force and schedule to provide for orderly completion of the work within the contract performance time. This work schedule must be acceptable to the Government. The Work Schedule must reflect a work progress rate equal to the available amount of contract performance time.
