About this file

This Sole Source Justification (SSJ) document details FEMA/OCCPO's procurement of 25 3M Scott Self-Contained Breathing Apparatus (SCBA) Model 804722-01, 4500 PSI Air Tanks for the Center for Domestic Preparedness (CDP). The procurement is being conducted as a brand name acquisition due to the existing inventory of 3M Scott SCBA equipment in CDP's training facilities. The current stock contains 67 air tanks over 15 years old, and safety guidance requires lifecycle replacement after 15 years.

The justification emphasizes that switching to alternative SCBA brands would be cost-prohibitive, requiring wholesale replacement of respiratory protection equipment, retraining of staff, developing new protocols, and rewriting training curricula. Since 2015, CDP has purchased hundreds of 3M Scott SCBA valued over $450,000. The procurement will be posted on SAM.gov, with DHS/FEMA anticipating multiple quotes in response to the Request for Quote (RFQ). The total quantity requested is 25 air tanks, with unit pricing and total cost redacted in the document.

Sole Source Justification (SSJ) For Simplified Acquisitions (over $10,000 and up to $250,000) pursuant to FAR 13.106, including Brand

Name

Sole Source Justification for Simplified Acquisitions (over $10,000 up to $250,000) Template which is wholly cost prohibitive to the Government.

CDP presently owns and has implemented into training hundreds of 3M Scott NIOSH CBRN-approved SCBA. Repairs and maintenance will ultimately be conducted on the CDP campus through utilization of 3M Scott equipment and CDP contracted support staff trained by 3M Scott technicians. A reliance on 3M Scott to conduct cleaning, maintenance and reconstitution after decontamination will be high in cost if not altogether cost prohibitive. This would be the case if CDP were to purchase competing brands of SCBA; of course, CDP would also be required to procure the competing brand of cleaning and maintenance equipment for that SCBA.

Procuring and implementing competing brands at this juncture will entail a wholesale replacement of 3M Scott respiratory protection equipment already implemented in unique fashion throughout technician-level training. Since 2015, CDP has purchased and implemented into training hundreds of 3M Scott SCBA with a value over $450,000.00.

Because of associated risks and certainty of cost duplication to the Government, a brand name acquisition represents the best value consistent with FAR 8.404(d).

Utilization of alternative sources will require the Government to procure hundreds of NIOSH CBRN-approved SCBA with accompanying equipment, retrain instructor and training support staff, develop alternate protocols and usage procedures and then rewrite curriculums associated with the training. Following this action, the Government will nonetheless remain burdened with the necessity of replacing and/or supplementing this respiratory equipment through the lifecycle replacement processes. Such cost prohibitive options are neither fiscally prudent nor economically reasoned. As regards the subject requirement, the Program Office asserts that utilization of alternative sources is wholly cost prohibitive.
