Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: Department of Veterans Affairs, VISN 9, Tennessee Valley Veterans Affair Medical Center PR# 626-24-3-2995-0152

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The TVHS VAMC is requesting five (5) De Mayo Adapt2fit Modular Knee Positioner Kits to replace the unserviceable ones, they currently have on hand, that have met the end of their life cycle. The kits are used to stabilize and position Veterans during surgery and are critical for optimal outcomes.

Estimate amount is $45,653.65.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: This knee holder is specific to orthopedic surgery needs and is able to be maneuvered in multiple positions for optimal outcomes during knee surgery.

This brand name item is available from one original equipment manufacturer

(OEM), Innovative Medical Products (IMP). In addition, this particular brand name product features are essential to the Government’s requirements for multiple positions and ability to separate for easy storage. While there is one similar product, it doesn’t not include the needed feature of two separate base plates and cannot be modified to meet the agency’s current need.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was conducted, reviewing previous solicitations/contracts for the same item in the past year. There were three (3) noted VA purchases for the same item since January 2023.

36C25623P1558, was sole sourced to IMP around Aug 2023. 36C24423P0194, was sole sourced to IMP and awarded in January 2023. 36C24623P1684, was solicited as full and open, however the similar product (Steris) emailed that they did not meet the salient characteristics for 32” long and two separate base plates to accommodate minimal storage by break down in size. So with their full and open posting with no set-aside, they still only received the 1 quote from IMP and awarded to IMP. (Market research also showed other sole sourced contracts to IMP in 2018 and 2019 36C25619P1059, 36C25619P1020, 36C25618P6254)

IMP is a small business, USA owned company, based in Plainville, CT. They have also agreed to provide a credit on the return of the currently used, D1 De Mayo Knee Positioners.

As a result of all market research conducted and reviewed, the CO recommends moving forward with this procurement as a brand name only, sole source to the OEM. The SBA/VA rule of two is unattainable. This requirement will be procured IAW FAR 13.106-1 procedures.
