In order to have a complete package, as a minimum, the return package must contain the following items (and any amendments). Quotes submitted without completion of items 1 – 8 listed here may be considered nonresponsive and ineligible for award.
1. Online Registration of Government System for Award Management (SAM) at http://sam.gov Anyone interested in doing business with the USDA must also be listed in the government’s System for Award Management known as SAM. You may register on line with http://sam.gov A prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation.

STATEMENT OF WORK
1.0 Requirements
• The purpose of this project is to procure Wheat Germ Meal product. The work to be performed under this contract consists of furnishing all materials, equipment, supplies, labor and transportation as required by the Pricing Schedule and in accordance with these specifications. All work materials and services not expressly called for in these specifications but are necessary for completion of the contract requirements shall be performed and furnished by the Contractor at no additional cost to the Government.
• Contract Delivery Order Set Up
USDA/APHIS/MRPBS will issue delivery orders shortly after award of the base contract#. They will be numbered with an 126395 YY F-NNNN . Orders may be issued by any USDA/APHIS/MRPBS Acquisition personnel with sufficient warrant authority . Upon delivery and acceptance of the products for any orders, the vendor will be responsible for submitting the invoice for payment against the contract delivery order number, referencing the individual call number in the IPP system at https://www.ipp.gov.
1.2 Product Specifications.

B. 15% Moisture content (maximum)
C. Free of contaminants such as, but not limited to, parasitic worms or nematodes, parasites, fungi, bacteria, and yeast documented as harmful to insect rearing or associated with human disease
D. Free of pesticide/chemical residues that will adversely affect fruit fly production
2.0 Quantity
• Estimated quantities is 5 or 6 deliveries per year The Contract Minimum is 1 Delivery of 800 (50lb) Bags per year and the Maximum is 8 Deliveries of 800 (50lb) bags per year. Delivery orders shall be placed against this contract for shipments. The delivery schedule will usually be 800 bags every 76 days but vendor must be flexible due to unpredictable temporary changes at the facility.
• The first order will be for 3 Deliveries if 800 (50lb) bags = 2,400 bags total. First delivery of 800 bags is needed as soon as possible and remaining two deliveries will be 76 days for each.
3.0 Bioassay and First Article Testing
• The contractor shall supply a 5-pound sample bag (First Article) of the Wheat Germ Meal for testing by the Government. The sample shall be received three weeks prior to issuing contract or Delivery Order (When Requested).
• First article testing shall be performed in accordance with contract clause 52.209-4 First Article Approval – Government Testing. The sample will be tested for compliance with Product Specifications (Section 1.2). Samples will be evaluated by the Government within 5 working days from the date received. See Pages for more instructions.

4.0 Packaging and Delivery.
• Product shall be packaged in 50-pound paper bags. Each shipment shall be palletized and shrink wrapped on the pallet. The shrink-wrapped pallets shall have not more than 40 bags per pallet. The product must be identified at the minimum with the batch number, manufacturing and expiration date, net weight on the shipping containers.

IPP is a secure, web-based system that manages government invoicing.
The contractor must follow the instruction on how to register and submit invoices via IPP as prescribed in the previous communications from USDA and Treasury. All invoices are to be submitted via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury

6.0 Warranty
• The contractor shall provide the Government at least the same warranty terms offered to the general public in customary commercial practice. At minimum, the contractor shall guarantee product quality for full compliance with contract specifications, terms and conditions for 60 days from the date of delivery, inspection, and acceptance.
• The USDA reserves the right to preform follow up testing for the above contaminants on any shipment received for at least 60 days from the date of delivery, inspection, and acceptance and can return the shipment to the vendor for credit if found contaminated.
• In the event the shipment is rejected, it is the contractor’s responsibility to replace the product in a timely manner in accordance with contract clause 52.212-4.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definitions.
As used in this clause—
Covered article, as defined in 41 U.S.C. 4713(k), means—
(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;
(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.S.C. 153);
(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or
(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.
