About this file

This is a Justification and Approval (J&A) document for a sole source contract award to a Service-Disabled Veteran-Owned Small Business (SDVOSB) under VAAR 819.7008.

The Department of Veterans Affairs, Veterans Health Administration, Regional Procurement Office West, Network Contracting Office 20, seeks to award a new contract to Global Engineering Services (GES), an SBA-certified SDVOSB, for repairs of underground sewer lines at Vancouver VA Medical Center. Approximately 40 feet of sewer line requires immediate repair to ensure continued functionality of the medical center's sanitary sewer system. The contracting officer posted a Sources Sought notice to SAM.gov on April 14, 2026, for 14 days, during which GES was the only SDVOSB vendor to submit a response. GES has demonstrated adequate technical capability, positive past performance including contract 36C26026C0014, and is expected to provide fair and reasonable pricing based on previous project experience. The award is justified under 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), and FAR 6.302-5, with authority for non-competitive procedures up to $5,000,000. The acquisition plan action ID is 36C260-26-AP-2844 with RPOW tracking number FY26. The justification was certified by Alejandro Munoz, Chief of P&O FMS at Portland VA Medical Center, and approved by Meredith Valentine, Contracting Officer at Network Contracting Office 20, and Sandra Snediker, Branch Chief of CON II at Network Contracting Office 20, with all signatures dated April 28 and June 5, 2026, respectively.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition

Acquisition Plan Action ID: 36C260-26-AP-2844 RPOW Tracking #: FY26

1. Contracting Activity: Department of Veterans Affairs (VA), Veterans Health Administration, Regional

Procurement Office West, Network Contracting Office 20, in support of the Veterans Integrated Service Network 20, Vancouver VA Medical Center.

2. Nature and/or Description of the Action Being Approved: This is a new contract for repairs of underground sewer lines at the Vancouver VA Medical Center. Approximately 40 feet of sewer line requires immediate repair. This is a critical service to ensure continued functionality of the sewer system at the Vancouver VA Medical Center. The vendor, Global Engineering Services (GES), can reply within the required time frame to conduct these repairs and there is every expectation based on previous projects that the price quoted will be fair and reasonable.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: GES was the only SDVOSB vendor to reply to a posted Sources Sought for this requirement. GES, an SBA certified SDVOSB vendor, provided necessary documents to demonstrate their capability and understanding of the required work. Based on previous project pricing, GES is known to provide fair and reasonable pricing and is typically the lowest price submitted. There is every expectation that the price quoted will be fair and reasonable. Based off the above and the need to ensure continued operations at the medical center, a sole source SDVOSB award to GES under VAAR 819.7008 has been found to be in the Government’s best interest.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.

Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR

819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:

(X) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business; or ( ) 819.7009 Sole source awards to a certified veteran-owned small business

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): GES has provided adequate documentation demonstrating technical capability to meet the VA need, positive past performance information (to include contract 36C26026C0014), and the CO anticipates receiving fair and reasonable pricing. This is a critical requirement necessary to be performed as soon as possible, in order to keep the medical center in compliance and ensure necessary operations of their sanitary sewer system.

This SDVOSB award will be based on 38 U.S.C. 8127(c) and the SDVOSB in concern, GES has been determined to be a responsible source with respect to performance. Additionally, the CO has determined the vendor meets eligibility requirements outlined in 819.7003(DEVIATION).

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies: Upon receipt of this requirements package, the CO posted a Sources Sought notice to SAM.gov on 4/14/2026 for 14 days. Global Engineering Services (GES) is the only SDVOSB that submitted a response to the Sources Sought. It is understood there may be additional SDVOSB or small business vendors and several known large business vendors that can meet this VA requirement, however GES is expected to submit pricing considered fair and reasonable, can respond quickly and has demonstrated positive past performance. This has been determined by the contracting officer, to be a best value to the VA.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Based on previous project pricing, GES is known to provide fair and reasonable pricing and is typically the lowest price submitted. There is every expectation that the price quoted will be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted. The CO posted a Sources Sought notice to SAM.gov on 4/14/2026 for 14 days. Global Engineering Services (GES) is the only SDVOSB that submitted a response to the Sources Sought. The CO verified through SAM.gov and SBA Small Business Search that GES was eligible for award and capable of meeting the VA needs.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: No other facts utilized, this award will be under 38 USC 8127(c).

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: As stated above, The CO posted a Sources Sought notice to SAM.gov on 4/14/2026 for 14 days. Global Engineering Services (GES) is the only SDVOSB that submitted a response to the Sources Sought.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: It is not anticipated to have any follow-on work that would need to be competed.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.

Alejandro Munoz Chief, P&O FMS Portland VA Medical Center
