About this file
This is a draft Division 01 specification document for construction projects procured through Other Transaction Authority (OTA), issued by the U.S. Army Corps of Engineers Fort Worth District. The document establishes administrative and procedural requirements for design-build construction agreements and serves as a template for standardizing contracting practices across the district's OTA projects.
The specification covers comprehensive project management requirements including: construction schedules with liquidated damages provisions (amount to be determined per project); time extension procedures for unusually severe weather based on National Oceanic and Atmospheric Administration data; working hours typically 0700-1700 hours Monday through Friday; security requirements including installation entrance procedures, background checks, and employee identification badges; utility coordination with mandatory 14-21 day advance written notice for outages limited to 4-hour maximum duration on weekends/holidays; submittal procedures using primarily digital methods (RMS system preferred, followed by secure web-based systems or email); payroll documentation requirements using electronic systems capable of tracking certified labor payrolls, apprentice/journeyman ratios, and compliance with wage rate requirements; superintendent qualifications requiring minimum 10 years construction experience with 5 years as superintendent on similar projects; field office overhead accounting practices using either per diem or percentage markup basis; and closeout requirements including Operation and Maintenance Manuals, Record Drawings, and high-resolution panoramic photographs. The document includes multiple location-specific variations for installations such as Fort Hood, Fort Bliss, Lackland Air Force Base, and Dyess Air Force Base. Industry feedback is requested via ProjNet Bidder Inquiry (Key: HDR42I-G8MAJ9) by 1700 CT on November 19, 2026.

][1.3.2 Completion Date Extension
The completion date is based on the assumption that the successful offeror will receive the notice to proceed by [____________]. The completion date will be extended by the number of calendar days after the above date that the [Design-Builder] receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the [Design-Builder] to execute the [Agreement] and give the required performance and payment bonds within the time specified in the offer.
]1.4 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (OCT 1989)
(ER 415-1-15)(52.0001-4038 1/96)
a. This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the [Agreement Articles, including Article 16 FORCE MAJEURE] In order for the [Agreements] Officer to award a time extension under this clause, the following conditions must be satisfied:
(2) The weather experienced at the project site during the [Agreement] period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the [Design-Builder].
SECTION 01 00 00.00 44 Page 4
b. The following schedule of monthly anticipated adverse weather delays due to precipitation and temperature is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the [Design-Builder] 's scheduled work day.
d. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days.
If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph "b", above, the [Agreements] Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the [procedures of Agreement Article 5 "CHANGES TO THE AGREEMENT" and Agreement Article 16 "FORCE
