About this file
This is a Justification and Approval (J&A) document for a sole-source procurement of extended warranty and maintenance support services for Army Land Mobile Radio (LMR) systems.
The United States Army, through the Product Director Base Emergency Communications Systems (PD BECS) and contracting activity Defense Information Systems Agency (DISA), is procuring 24 months of OEM extended warranty and maintenance support from Motorola Solutions, Inc. for existing Motorola LMR subsystems located at Fort Novosel, Alabama, and Holston Army Ammunition Plant (HAAP), Tennessee. The period of performance runs from September 30, 2026, through September 29, 2027, with one one-year option. The contract type is Firm Fixed Price under the statutory authority of 10 U.S.C. 3204(c)(1) and FAR 6.103-1, permitting sole-source procurement when only one responsible source can satisfy agency requirements. Services include warranty administration, OEM technical support, equipment diagnosis and repair, Return Material Authorization processing, software and firmware updates, cybersecurity patches, applicable licensing, transportation, and warranty claim tracking. The justification establishes that Motorola is the only capable source due to its proprietary control over system hardware, software, firmware, diagnostic tools, cybersecurity configurations, and technical data essential to maintain Army mission-critical communications for first responders, emergency personnel, and installation operations. Extensive market research conducted between December 1, 2025, and February 13, 2026, including a formal RFI issued December 9, 2025, with responses due January 9, 2026, evaluated eleven commercial sources but confirmed no alternative vendor possesses independent access to required Motorola proprietary resources. Price reasonableness will be determined through comparison to historical prices, commercial pricing, prior Government contracts, and the Independent Government Cost Estimate using FAR 15.404-1 analysis techniques.

J&A: Army CONUS Enterprise Land Mobile Radio (LMR) - Motorola Maintenance and
Warranty Support Services
Page 2 of 9 Pages
The purpose of this acquisition is not to purchase new equipment or modernize the system, but to ensure the continued operation and maintenance of the current Motorola LMR subsystems through manufacturer-backed support.
The requirement will provide OEM extended warranty and associated maintenance support at an estimated total value of with a period of performance of September 30, 2026, through September 29, 2027, with one,1 year option. This support will allow Army PD BECS to sustain mission-critical LMR communications supporting first responders, emergency services, public safety personnel, and installation operations without interruption or degradation of the existing Motorola LMR capability.
4. IDENTIFICATION OF STATUTORY AUTHORITY:
The United States Code (U.S.C.) and FAR reference permitting other than full and open competition: 10 U.S.C. 3204(a)(1), FAR 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE
NATURE OF THE ACQUISITION REQUIRED:
1. UNIQUE QUALIFICATIONS:
Motorola is the OEM of the installed LMR system and is the only source capable of providing the full scope of OEM maintenance and extended warranty support required by the Government.
The existing Army LMR environment incorporates Motorola proprietary hardware, software, firmware, system-management functions, cybersecurity configurations, diagnostic tools, and technical data. While the LMR system is compliant with APCO Project 25 (P25) interoperability standards these standards do not grant third-party contractors unrestricted access to the proprietary functions and resources necessary to maintain, diagnose, update, secure, and provide extended warranty support for the Motorola system.
The performance of the required maintenance and extended warranty services depends on access to the following OEM controlled capabilities:
Proprietary software and firmware updates.
Cybersecurity patches.
Diagnostic tools.
Engineering and technical support Technical data Equipment repair capabilities Manufacturer warranty administration.
Page 3 of 9 Pages
A non-OEM contractor without access to these Motorola proprietary resources would be unable to independently execute the full scope of this requirement. This includes but is not limited to, performing OEM authorized software and firmware updates, applying required cybersecurity patches, diagnosing and resolving faults, administering warranty claims, and providing OEM backed lifecycle support.
Given the proprietary nature of the existing LMR system and the critical dependence on Motorola-controlled resources and expertise, Motorola. is the only responsible source capable of fulfilling the extended maintenance and warranty requirements. Awarding this requirement to any entity other than Motorola would compromise the operational readiness, cybersecurity integrity, and manufacturer-supported status of the Army’s mission-critical LMR system.
2. IMPACT:
Failure to obtain uninterrupted OEM maintenance and extended warranty support would significantly increase the risk of extended system outages, unresolved equipment or software faults, delayed repairs, inability to apply critical manufacturer updates and cybersecurity patches, loss of manufacturer warranty coverage, and overall degradation of mission-critical LMR communications.
The LMR system is vital to support first responders, emergency services, law enforcement, fire protection, public works, and other installation personnel. Any degradation or extended interruption of the LMR functionality could severely impact emergency response, force protection, public safety, and installation operations.
Awarding this requirement to a source that lacks the ability to provide OEM-level support would therefore introduce unacceptable risks; including:
Technical Risk: Inability to resolve manufacturer-specific faults or maintain the system in an operational condition.
Cybersecurity Risk: Delays or failures in applying critical OEM cybersecurity patches and updates, increasing system vulnerability.
Schedule Risk: Prolonged downtime due to delays in obtaining proprietary parts, tools, or technical support.
Operational Risk: Degraded or unavailable communications during emergencies, compromising the safety of personnel and the effectiveness of mission-critical operations.
Given these risks, pursuing an alternative to the exception for full and open competition would jeopardize the Government’s ability to maintain reliable, secure, and operational LMR communications, which are essential for supporting emergency response and installation operations.

6. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY SOURCES AS POSSIBLE:
In accordance with FAR Part 10, the Government conducted extensive market research between December 1, 2025, and February 13, 2026, to assess the commercial marketplace and identify sources capable of supporting the Army Enterprise LMR requirement. This research was designed to evaluate capabilities related to sustainment, maintenance, cybersecurity, configuration management, OEM support, lifecycle authority, continuity of operations, and long-term system support.
As part of this effort, the Government issued a formal Request for Information (RFI) on December 9, 2025, via SAM.gov, with responses due January 9, 2026. The RFI was intended to gather information regarding commercial capabilities, technical approaches to maintenance and warranty support, and overall capacity to fulfill the Army's LMR requirements. This solicitation provided an opportunity for industry to demonstrate its ability to meet the LMR requirements and to identify potential sources.
The Government received and evaluated eleven written responses from a cross-section of the commercial LMR marketplace. Detailed market research methods, sources reviewed, vendor capabilities, and evaluation results are documented in the Market Research Report included with the acquisition package.
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer will ensure that the final negotiated price for the extended Motorola LMR maintenance and warranty support requirement is fair and reasonable in accordance with FAR 15.404-1, which provides guidance on price analysis techniques.
To determine price reasonableness, a price analysis will be conducted using one or more of the following methods, as appropriate:
Comparison to historical prices: Review prices paid by the Government for the same or similar Motorola LMR maintenance and sustainment services under previous contracts.
Comparison to commercial pricing: Evaluate available commercial pricing or published OEM support price lists for similar services.
Comparison to prior Government contracts: Analyze pricing from existing or prior Government contracts for Motorola LMR support to identify any relevant trends or benchmarks.
Comparison to the Independent Government Cost Estimate (IGCE): Evaluate the proposed pricing against the IGCE, which was developed based on historical data, known cost drivers, and market trends.
Page 5 of 9 Pages
The final fair and reasonable price determination will be based on the results of this comprehensive price analysis, along with the outcome of negotiations with Motorola Solutions, Inc. The Contracting Officer will ensure the negotiated price represents the best value to the Government and is consistent with the required level of OEM maintenance and warranty support.
8. MARKET RESEARCH:
Market research was conducted in accordance with FAR Part 10 to evaluate commercial capabilities supporting Army Enterprise Land Mobile Radio (LMR) requirements at Fort Novosel and HAAP. Research focused specifically on Original Equipment Manufacturer (OEM) extended warranty support, proprietary software/firmware licensing, cybersecurity sustainment, Return Material Authorization (RMA) processing, and repair/replacement services. The specific techniques utilized are summarized below:
Contact with Knowledgeable Persons in Government and Industry: The Government consulted technical subject matter experts from Product Director Base Emergency Communications Systems (PD BECS) and local installation technical personnel familiar with existing Motorola LMR subsystem configurations. In addition, the Government engaged industry by posting a Request for Information (RFI) on December 9, 2025, evaluating responses from OEMs, systems integrators, authorized service providers, and small businesses.
Review of Recent Market Research Results: The Government reviewed recent market research documentation and acquisition histories for similar Army and DoD LMR sustainment requirements to evaluate market maturity and capability baselines.
Review of Government and Commercial Databases: The Government queried SAM.gov, USAspending.gov, the Federal Procurement Data System (FPDS), and commercial technical/catalog databases to evaluate entity registrations, business size standards, historical pricing, and commercial warranty availability.
Review of Source Lists: The Government evaluated Motorola-authorized service provider directories, vendor capabilities lists, and historical contract files to identify qualified sources capable of providing certified OEM maintenance, proprietary software access, and hardware support.
Review of DISA-wide and Government-wide Acquisition Contracts: The Government analyzed available DISA-wide and other Government-wide Acquisition Contracts (GWACs). No existing vehicle was identified that could satisfy the full scope of Motorola OEM extended warranty and associated subsystem maintenance requirements.
9. ANY OTHER SUPPORTING FACTS:
The Army has made a significant investment in the existing Motorola LMR infrastructure, which supports mission-critical public safety and installation communications. This infrastructure includes Motorola-controlled hardware, software, firmware, system-management applications, cybersecurity configurations, engineering tools, and lifecycle support mechanisms.
The current requirement is limited to maintaining and warranting the existing Motorola LMR capability for a one 1 year base period and one 1 year option period. Utilizing a non-OEM source that lacks independent access to the required Motorola proprietary technologies and lifecycle
Page 6 of 9 Pages authority would not eliminate the Government's dependency upon Motorola. Any non-OEM source would still need to obtain essential OEM-controlled products, software, technical support, licensing, cybersecurity updates, or other lifecycle resources from Motorola in order to perform critical portions of the maintenance requirement.
Transitioning to an alternate source to replace, re-engineer, or transition the existing Motorola system solely for purposes of obtaining two years of maintenance and warranty support would result in unnecessary duplication of Government investment, increased cost, technical and cybersecurity risk, and potential disruption to mission-critical LMR services.
By directly awarding this requirement to Motorola Solutions, Inc., the Government ensures that the existing LMR system remains fully operational and within its OEM-supported technical and cybersecurity configuration. This approach avoids unnecessary duplication of costs, eliminates transition risks, and prevents potential disruptions to mission-critical LMR services.
10. LISTING OF INTERESTED SOURCES:
The Government received eleven written responses to the RFI published through SAM.gov on December 9, 2025. The following sources expressed written interest in the procurement:
Motorola Solutions, Inc.
L3Harris Technologies, Inc.
Tyto Athene, LLC Tribalco, LLC Dattatron LLC Superior Communications Inc. (SCI) Frequentis USA, Inc.
Etherstack Inc.
RV Global Solutions Inc.
Intrastellar Solutions LLC Jenesia1 Inc.
11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS
THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:
The reviewing officials and approval authority have reviewed the previous Justification and Approval (J&A), which was routed with this J&A, and evaluated the planned actions to remove barriers to competition identified in the prior justification. As required, the Government conducted extensive market research to assess whether any new sources could independently fulfill the requirement and whether the proprietary nature of the existing Motorola LMR system could be mitigated.
The market research included issuing a formal RFI, analyzing vendor capabilities, and consulting with subject matter experts. Despite these efforts, the research confirmed that the Army
Page 7 of 9 Pages
Enterprise LMR environment remains highly dependent on Motorola’s proprietary hardware, software, firmware, and lifecycle support. Non-OEM sources lack the independent authority and access to the proprietary resources necessary to provide the complete maintenance and warranty support required.
Based on this evaluation, it is determined that a sole-source or brand-name environment still exists, and Motorola Solutions, Inc., as the OEM, remains the only responsible source capable of fulfilling the Government’s requirements without introducing unacceptable risks or costs.
11a. Procurement History:

Business Type: Other than Small Period of Performance: June 7, 2024, through September 30, 2026 Contract Type: Firm-Fixed Price Competition: Sole Source Contract Vehicle: Open Market
11b. Actions to Remove or Overcome Barriers:
During the base year and option period of performance, PD BECS will conduct market research and monitor changes in the commercial LMR marketplace to identify whether additional sources obtain the OEM authorization, proprietary system access, technical capabilities, cybersecurity support authority, warranty authority, and lifecycle support capabilities necessary to independently satisfy future maintenance requirements.
Prior to the next LMR maintenance and sustainment acquisition, the Government will reassess available acquisition alternatives, including the capabilities of OEM-authorized service providers, systems integrators, small businesses, and other commercial sources. This reassessment will include evaluating whether portions of the requirement that do not require proprietary OEM access or lifecycle authority can be structured to increase competition.
The Government will also examine opportunities to separate competitively supportable service from proprietary OEM-specific requirements, where such separation is technically feasible, operationally acceptable, and in the best interest of the Government. For functions where proprietary system access, cybersecurity authority, warranty administration, or lifecycle support remains necessary, the Government will maintain OEM-specific acquisition approaches to ensure mission-critical requirements are met.
