PERFORMANCE WORK STATEMENT

FOR

MAINTAINING AIRCRAFT & STRUCTURAL LIVE FIRE TRAINER

AT

MINOT AFB, ND

1. Description of Services. The contractor shall provide all supplies, materials, tools, equipment, and qualified labor necessary to inspect, test, and maintain the Aircraft Fire Training Facility (AFTF), Structural Training Facility (SFTF) and Helicopter live Prop at Minot AFB in a manner that will ensure its serviceability and prevent deterioration in operational effectiveness. The contractor shall comply with manufacturer’s recommendations and procedures, Air Force Technical Order (TO) 35E1-2-13-1 Operation and Maintenance Instructions for Aircraft Fire Training Facilities, and local, state, and federal guidelines as applicable to the work involved. Installation, testing and replacement of gas piping, gas utilization equipment or accessories, repair and servicing of equipment, shall be performed only by qualified personnel. In the interest of safety, all persons employed in handling Liquefied Petroleum Gases (LPG) shall be trained in proper handling and operating procedures, which the Contractor shall document.

1.1. Inspection and Preventive Maintenance Services for Air Force Standard Design AFTF. The Contractor shall maintain the Air Force standard design and constructed aircraft LP-Gas trainer at Minot AFB, North Dakota. The Contractor shall perform all required inspections, and preventive maintenance in accordance TO 35El -2-13-1, this Performance Work Statement (PWS), National Fire Protection Association (NFPA) Standards, and commercial standards along with USAF AFTF Inspection & Testing requirements. The inspections shall be in accordance with Table 1 WP 006 and Table 3 WP 007 of the T.O. The contractor shall maintain the AFTF by scheduling and conducting two (2) semi-annual inspections in conjunction with winterization/de-winterization activities. The contractor shall provide a written report of the conditions found during the inspection. The contractor shall provide a written cost estimate to repair/replace all items identified as discrepancies and submit to the Contracting Officer (CO) or designated representative (names provided after award).

1.1.1. Winterization on AFTF. The Contractor shall perform winterization services in accordance with TO 35El -2-13-l, to occur between the 20th and 29th of September. The Contractor shall schedule the maintenance with the Government technical representative at least two weeks prior to anticipated maintenance. (CLINs X001)

1.1.2. De-winterization on AFTF. The Contractor shall perform de-winterization services in accordance with TO 35E 1-2-13-1, to occur between the 15th of April and the 1st of May. The Contractor shall schedule the maintenance with the Government technical representative at least two weeks prior to anticipated maintenance.

1.2. Inspection and Preventive Maintenance Services for SFTF. The structural integrity of the live fire training structure shall be evaluated and documented by a licensed professional engineer with live fire training structure experience and expertise or by another competent professional as determined by the Fire Chief once every 5 years. Next 5 year inspection is due in the year 2024. This inspection shall be IAW NFPA 1403. (CLIN X006)

1.3. Minor Repair. The Contractor shall perform minor repairs and provide all parts for such servicing as needed and approved by the Government technical representative at Minot AFB to return each trainer to its full operating capability. Minor repairs are defined as preventive inspection and maintenance measures to restore each trainer to its full operating capability without replacement of major parts. The labor price provided by the Contractor shall be at the entire crew rate. (CLINs X004 & X005)

1.4. Reimbursable Parts. Materials, supplies, and parts needed for maintenance or repairs shall be reimbursed at cost under the Reimbursable Parts CLIN. The Contractor shall not purchase or install any replacement parts without appropriate Government approval. Replacement Parts Ordering Procedures: The contractor shall use appropriate sources to obtain competitive quotes from a minimum of three different sources of supply. The lowest competitive quote shall be compared to the Government’s estimate. The Contractor shall receive approval for minor repairs under $3,499.99 from the Government technical representative prior to conducting any work or ordering parts. If the total of the minor repair is $3,500 or higher the Contractor shall first receive approval from the Contracting Officer prior to conducting any work or ordering parts. The Contractor shall provide costs of the minor repair to include both labor (as priced in CLINs X005) and parts (CLINs X003). All costs for parts must be presented to the Government technical representative or Contracting Officer based on value with competitive quotes, via invoice for approval prior to replacement. Copies of receipts shall be submitted with the invoice in order to receive payment for reimbursable items. (CLIN X003)

1.5. Major Repair. The Contractor shall report any major maintenance needed or major problems as soon as they are discovered to the Government technical representative. Examples of major problems include: Any safety related condition that could lead to an imminent hazard such as: LPG piping or tank corrosion that has reduced the wall thickness to less than that required for the maximum allowable operating pressure. Any crack or other material defect that impairs the structural integrity or reliability of a LPG tank or piping. Any abnormal movement by environmental causes, such as floods that may impair the serviceability of a pipeline, tank or system controls. Any malfunction or operating error that causes the pressure of a LPG pipeline or tank to rise above its maximum allowable working pressure or a leak in the LPG pipeline or tank that constitutes an emergency.

1.6. Frequency. The AFTF shall be inspected a total of two times per contract year. This shall be in conjunction with the winterization/de-winterization (NLT 29 September and NLT 15 April). The SFTF shall be inspected once every 5 years. Any conflict between this PWS and the technical order, NFPA Standards, commercial standards or manuals will be resolved in favor of the PWS required frequency.

1.7. Scheduling. The Contractor shall submit an initial inspection and preventative maintenance schedule to the Government technical representative and Contracting Officer within ten (10) days after contract award. The Contractor shall coordinate and schedule actual inspection and maintenance dates/times with the Government technical representative at Minot AFB to prevent conflicts with on-going missions or exercise.

1.8. Operational Check. The Government, as part of the initial scheduling process, will conduct a complete "operational check'' of each trainer and provide the results to the Contractor at least two weeks before the Contractor is scheduled to arrive on-site. Purpose of this self-inspection is to advise Contractor of any pending deficiencies.

1.9. Reports. The Contractor shall submit a complete report of all inspections, maintenance and servicing accomplished to the Records Management (RM) Point of Contact (POC) within ten (10) days of inspection. The reports shall include a record of conditions found, discrepancies needing repairs, repairs accomplished, recharging, and all replacement parts used. All records, files, documents, regardless of media (e.g., paper, electronic, etc.), as described in the PWS, that are the responsibility of the contractor are the property of the Government and shall remain so upon termination or completion of the contract. The contractor shall keep these items current and maintain and dispose of them in accordance with the requirements established in Air Force Instruction (AFI) 33- 322, Records Management Program, and the Air Force Records Disposition Schedule, found in the Air Force Records Information Management System (AFRIMS), which can be provided by the RM POC upon request.

Records shall be turned over to the Government upon completion of the contract unless otherwise stated. All records are subject to the Freedom of Information and Privacy Act. The Minot AFB Records Management Office (5 CS/SCXR), 723-7542/2084, will provide assistance and training to the contractor to ensure compliance with Federal record keeping requirements.

1.10. Telephone and On-line Technical Support. The Contractor shall provide 24/7 toll-free telephone and online support to facilitate simple troubleshooting and operator maintenance.

1.11. Materials and Equipment. The Contractor shall provide all the specialized tools and testing equipment to accomplish maintenance and testing as required.

1.12. Travel. The contractor is responsible for mobilization/demobilization for scheduled repairs to and from all individual facilities including all shipping, delivery of materials, loading and off-loading of materials, tools, and necessary equipment to perform the required activities to accomplish the performance work statement. The Contractor shall price the Travel line item at the full crew rate, not per person. (CLINs X004 )

1.12.1. Transportation and Living Expenses. Transportation, travel and living expenses in accordance with Government regulations for those employees traveling in connection with the performance of services required by the contract for minor repair. (As applicable if contractor cannot complete at time of providing standard maintenance services under PWS paragraphs 1.1. - 1.2.)

(1) All travel expenses will be calculated using the Joint Travel Regulations (JTR).

(2) For transportation, the actual cost thereof by public conveyance (plane limited to tourist class when applicable).

Non-Allowable Costs: Non-allowable costs are furnished for your information and guidance and are not necessarily all conclusive. These costs, no matter where they appear in the General and Administrative overhead, must be deleted.

(a) Commissions and bonuses (under whatever name) in connection with obtaining or negotiating for a

(b) Government contract.

(b) Contingency reserves.

(c) Contributions and donations.

(d) Dividend payments.

(e) Entertainment.

(f) Interest on borrowings.

(g) Taxes, fees, or charges imposed upon by reason of or measured by the firm's fee.

1.13. Environmental Controls. The Contractor shall be knowledgeable of and comply with all applicable Federal, State, and local laws, regulations, and requirements regarding environmental protection. The Contractor shall ensure policies and procedures are established that protect the health and safety of employees and the community and minimize/eliminate the risk of environmental pollution.

1.14. Safety. LP-Gases used in the facility are potentially explosive. The Fire Emergency Services training ground is a nonsmoking area. Personnel shall practice proper grounding procedures in accordance with the National Electric Code. Personnel shall wear appropriate protective clothing and be aware of emergency procedures to perform emergency shutdown and start-up.

2. Government Furnished Services. The Government will provide the following services as part of this contract.

2.1. Security and Fire Emergency Services. The Government will provide Security Forces and Fire Emergency Services for on base facilities in accordance with Government guidelines.

2.2. Medical. In the event of a severe emergency (sudden onset of a condition with acute symptoms requiting immediate medical care and includes such conditions as heart attacks, cardiovascular accidents, poisonings, loss of consciousness or respiration, convulsions or other operation) the installation Medical Group will respond and transport, if necessary. During hours of operation, the installation Medical Group will respond and transport, if necessary, Contractor employee(s) to Medical Treatment Facility in Minot, ND. In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis.

2.3. Utilities. The Government will provide propane, water and electricity as required. Electricity is available in the Structural Trainer. No Electricity exists at the Aircraft Trainer. The Contractor shall not change or modify any utility system or component; or connect any Contractor property, equipment or system without prior Government technical representative review and approval. The contractor shall practice energy conservation in the Government provided facilities.

3. General Information.

3.1. Qualifications. Personnel shall have the necessary training and experience to perform work on the AFTF & SFTF as prescribed in T.O. 35E 1-2-13-1 (AFTF) and T-500 Live Fire Trainer O&M Manual. Personnel shall have experience with electrical, plumbing and LP-Gases. Personnel shall understand and follow T.O. 35E 1-2-13-1 (AFTF) and T-500 Live Fire Trainer O&M Manual. For instance, but not limited to, T.0. 35E l -2-13-l section 007 00 states "igniter replacement procedures shall be performed by qualified personnel only."

3.2. Environmental Requirements. In addition to all applicable Federal, State and local environmental codes and regulations, the following specific guidance is provided:

3.2.1. Environmental Protection. The Contractor shall comply with all applicable federal, state, and environmental laws and regulations and local safety, and fire requirements, including the Air Force Occupational Safety and Health (AFOSH) Standards. The Contractor shall ensure that the purchase, use, handling, storage, and disposal of all toxic, hazardous and special materials and wastes are in accordance with federal, state and local environmental protection regulations

3.2.2. Supplies. The contractor shall furnish a listing of all hazardous materials utilized during the contract period to the Government technical representative at a minimum of two weeks prior to start for acceptance by the Base Environmental CES office.

3.2.3. Hazardous Material Identification. Material Safety Data Sheets (MSDS) are required as specified in the latest version of Federal Standard No. 313 (including revisions adopted during the term of the contract) for any other material designated by a Government technical representative as potentially hazardous and requiring safety controls. MSDSs must be submitted by the Contractor upon contract award. Failure to provide MSDSs or certificate when requested could result in the Contractor being considered non-responsive and result in termination of the contract.

3.2.4. HAZMART. The Government (5 CES/CEIE Environmental Office) will review and approve or deny use of all chemicals that the Contractor requests to bring on to Minot AFB or any property under its control. Any products that meet the criteria of “Hazardous Waste” must be bar coded and tracked until permanently removed from Government property. The Contractor is responsible to provide 5 CES/CEIE with usage reports after each time maintenance and/or repair is accomplished tallying the amount of each approved chemical used during that service. Criteria for identifying hazardous waste, is contained in Subpart C of 40 CFR, Part 261.

3.2.5. Spill Response. The contractor shall maintain spill control material on hand at all times sufficient to contain a worse case spill, both volume and hazard level. The Contractor is responsible to report to the Government technical representative and promptly cleanup all spills and dispose of all associated waste in a manner consistent with current environmental regulations. Contractor shall have a mobile spill kit large enough to contain a spill at least 10% bigger than the largest container of cleaning product. In the event that it is necessary to utilize Government material, equipment or personnel to clean up a Contractor caused spill, the Contractor shall be required to reimburse the Government for all associated costs.

3.2.6. Hazardous Material/ Waste Management. The Contractor will be briefed on Hazardous Material / Waste Management Plan prior to start of work. The contractor shall adhere to all base level recycling programs. The Contractor will be responsible for purchase of all approved hazardous materials. No materials may be used without prior approval through the Government technical representative to the base Environmental Office (5 CES/CEIE) with an Air Force Form 3952 Chemical/Hazardous Material Authorization Request. No materials or waste can be stored or left at Government facilities between visits. Contractor is responsible for all wastes and waste disposal costs associated with PWS and must remove all waste from site when they leave. All wastes will be properly disposed of according to local, state and federal environmental regulations. Minot AFB must recycle 50% of construction and demolition debris.

3.2.7. Hazardous Material Handling. The Contractor shall have approval from the base Environmental Office 5 CES/CEIE prior to purchasing, handling, using, and storing any chemicals, solvents, lubricants, and other products.

The Contractor shall identify these materials and products on Air Force Form 3952 Chemical/Hazardous Material Authorization Request, Process Identification Form. The Contractor shall provide one copy of the MSDSs for each item to 5 CES/CEIE through the Government technical representative and Contract Administrator (CA) for review prior to any chemicals being brought onto Minot AFB. The Contractor shall maintain one copy of the MSDSs for each hazardous material line item used within the work center. The Contracting Officer has the right to prohibit the use of hazardous materials it deems to be especially hazardous to human health and environment. In the event the Contracting Officer does not approve a hazardous material for use, the Contracting Officer may provide the contractor a list of suitable substitutes; however, the contractor shall retain responsibility for finding an acceptable substitute. The contractor shall take appropriate actions to comply with waste minimization and pollution prevention practices and policies.

3.2.8. Toxic Substances. The Contractor shall not use products that are or contain Toxic 17 chemicals, Extremely Hazardous Substances (EHS), Ozone Depleting Substances (ODS), and/or Persistent Bio accumulative and Toxic (PBT) chemicals. Any HM containing one of these banned substances will not be allowed on base.

3.3. FAR 52.212-4(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services.

3.4. Security Requirements. The installation access will be coordinated with the Government technical representative and Security Forces Squadron. Contract personnel will not enter restricted areas without escort from authorized personnel. The Contractor shall restrict personnel to only those areas required to performing work.

3.5. Disposition of Materials. The Contractor shall dispose of any and all expended and broken items properly IAW federal, state and local environmental protection regulations.

3.6. Contractor Clean Up. The Contractor shall, at all times, keep his work areas free from accumulations of waste material, rubbish or Foreign Object Debris (FOD). Upon completion of the job, the Contractor shall leave the work and premises in a clean, neat, and orderly condition.

3.7. Damages to Government Buildings, Equipment, or Vegetation. Do not allow for promoting the spread of noxious weeds nor the introduction of invasive species from off-site soils. Damages to Government buildings, equipment, or vegetation are addressed in clause 52.237-2 – “Protection of Government Buildings, Equipment, and Vegetation.”

3.8 Performance of Services during Crisis Declared by the Commander(s). This service is not determined to be essential for performance during crisis according to DODI 3020.37.

3.9. Background Check Requirement. The Contractor is responsible for the conduct, professional credibility, and security compliance of contract employee while working on the base.

3.10. Security Requirements. Security and base access requirements are contained in clause 5352.242-9000 “Contractor Access to Air Force Installations.” Contractor employees will be required to obtain and display identification badges. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base.

Procedures for commercial vehicle access to the base are subject to change without prior notice.

3.10.1. Base Pass Information. Upon award the contractor shall provide the following information two weeks prior to contract start date: Full name of individuals who require entry to Minot AFB, full SSAN, Date of Birth, and Driver's License Number and issuing state.

3.11. Contract Manpower Reporting. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Transient Aircraft Services via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

3.11.1. Labor Inputs. Reporting inputs will be for the labor executed during the period of performance for each Government Fiscal Year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.
