1. DESCRIPTION OF SERVICES
The Contractor shall provide all personnel, materials, tools, equipment, transportation, vehicle, supervision, labor, and other items and services necessary to perform inspection, testing, maintenance, and repair (ITMR) of the Electronic Security Systems (ESS) located in the Multifunction Technical Control Facility (MTCF) on the Camp Foster Annex (formerly Fort Buckner) and the 78th Signal Battalion Headquarters and Network Enterprise Center (NEC) on Torii Station in Okinawa, Japan. The installed ESS consists of an integrated Access Control System (ACS), an integrated Closed Circuit Television (CCTV) camera system, and Intrusion Detection Systems (IDS). This contract is designed to provide ITMR for the ACS and CCTV components of the ESS (these components are listed in Appendix A). IDS maintenance is not included in this contract. All maintenance actions shall be performed by Lenel and Axis certified personnel. The required certifications are listed in paragraph 3.11, Required Training and Special Qualifications.
1.1. Quarterly Preventive Maintenance.
1.1.1. Performance Schedule. Upon contract award, and prior to commencing services, the Contractor shall submit an inspection, testing and maintenance (ITM) schedule to the 78th Signal Battalion COR or designated representative for acceptance. The schedule shall include the specific dates and locations for projected work for which the Contractor will perform the ITM tasks listed below. The Contractor shall submit a revised schedule if changes occur, for COR acceptance. The Contractor shall not implement changes to the schedule until the changes are accepted by the COR or designated representative. Additionally, a master list of the ITMR schedule shall be submitted so that 78th Signal Battalion can monitor the overall preventive maintenance performed for the ESS equipment and components throughout the period of performance. All the quarterly maintenance performed shall be noted in the master list and submitted to the Government.
1.1.2. Frequency of Inspection. The Contractor shall inspect, test, maintain, and repair ESS equipment once a quarter.
1.1.3. Inspection, Testing, Maintenance, and Repair (ITMR). The Contractor shall perform ITMR services for the integrated Lenel ACS and Axis CCTV camera systems (and associated devices) of the installed ESS. There will be no Asbestos Containing Material (ACM) and Lead Based Paint (LBP) related work or disposal required. A label including the inspection date shall be documented on the major equipment or ESS enclosure at each facility. The Contractor shall leave the work site clean without any debris or substances left at the end of all work performed.
Inspection, testing, and maintenance tasks shall include the following quarterly preventive maintenance (PM) activities:
1.1.3.1. Pre-maintenance verbal brief prior to start to allow for new or ongoing issues to be discussed with the COR or designated representative.
1.1.3.2. Cleaning, corrosion remediation, and alignment check of external CCTV cameras.
1.1.3.3. Walk-through of each location (the MTCF and Satellite Communications (SATCOM) floor on the Camp Foster Annex and the NEC and Battalion Headquarters on Torii Station) of predetermined routes and rooms within the buildings to “sample” test key components of each component of the ACS and CCTV systems. Subject but not limited to: Ingress, Egress, and emergency evacuation routes (subject to access restrictions. Escorts will be requested IAW each location guidelines).
1.1.3.4. Identification of any system components that need immediate corrective action and repair.
1.1.3.5. Identification of system components that will require parts to be approved and purchased prior to any corrective action.
1.1.3.6. Post-maintenance verbal debrief following each quarterly visit to allow the COR or designated representative to action any immediate concerns.
1.1.3.7. Reports. All reports submitted by the Contractor under this service contract shall be in English. The Contractor shall submit one (1) set of electronic reports to the COR or designated representative for revision and approval within 20 working days in the following month after each ITMR has being performed. The reports shall include, at a minimum, each ITM task, date scheduled, date completed, and the technician(s) completing the task, findings, recommendations for the installed ESS, any “discovered” anomalies identified by the Contractor during the course of his or her inspection.
1.2. On-Call Services.
1.2.1. On-Call Services during Duty Hours (0700-1600 Monday to Friday, excluding Saturday, Sunday, and US Holidays).
1.2.1.1. The COR or designated representative will notify the Contractor of the issue and/or needed repairs, if known. The Contractor shall respond electronically followed by a phone call to the COR or designated representative within two (2) hours of receipt of the service call request.
1.2.1.2. The first attempt to troubleshoot will be via phone. If the situation cannot be corrected over the phone, the Contractor must be on-site within four (4) hours. If the service call is initiated after 1300, onsite response will be scheduled for the start of the next business day with prior verbal or written approval by the COR or designated representative.
1.2.1.3. All On-Call service schedules must be approved electronically by the COR or designated representative prior to site work. If for any reason, the Contractor is unable to immediately carry out the repairs, the Contractor shall make diligent efforts to temporarily restore the defective item or system to a “modified” operational condition and provide replacement part(s) cost estimates to restore the system to full operation.
1.2.1.4. The Contractor shall submit the estimates required for approval prior to performing On- Call Services that require replacement parts. The Contractor shall NOT count the travel hours back and forth to the site as part of the on-call service hours rendered. The Contractor is permitted to invoice only the “work hours rendered on site or during initial phone support” under On-Call Services. In the event of access issues to the base or site, the elapsed time will be considered as onsite work hours.
1.2.2. On-Call Services during Non-Duty Hours (1600-0700 Monday to Friday, including Saturday, Sunday, and US Holidays).
1.2.2.1. The COR or designated representative will notify the Contractor of the issue and/or needed repairs, if known. The Contractor shall respond electronically followed by a phone call to the COR or designated representative within two (2) hours of receipt of the service call request.
1.2.2.2. The first attempt to troubleshoot will be via phone. If the situation cannot be corrected over the phone, the Contractor will confirm action required to the COR or designated representative and schedule an onsite visit.
1.2.2.3. The Contractor shall identify maintenance personnel in writing to the 18th Contracting Squadron and the COR prior to starting the service contract. Identification will include full name, company, and mobile phone number. This information will be provided to the 78th Signal Battalion for their usage during non-duty hours. The Contractor’s POC shall answer the telephone at any time during non-duty hours of operation. The Contractor shall submit a report of the on-call services rendered during non-duty hours to the COR by the next following working calendar day.
1.2.3. Total Hours of On-Call Support.
1.2.3.1. It is the responsibility of the Contractor and the COR to track, collate, and report the number of hours used and remaining for ITM On-Call throughout the year. If at any point the total number of available hours remaining goes below 10% of the Government estimate of required labor hours for the year, additional Contractor support hours must be made available to the Government IAW established On-Call Support rates for the Contract.
1.3. Training.
1.3.1. The Contractor will provide eight hours formal classroom training four times per year (8 hours quarterly for a total of 32 hours per year) for up to fifteen persons at a time. The focus of this training will be the Lenel and Axis applications, as well as the use of the card readers and cameras. All training will take place at the geographic location being supported. For example, training for NEC users will take place in the NEC classroom (building 161) or one of the classrooms in the Battalion Headquarters (building 170) on Torii Station. Until the new SATCOM facility is completed in 2024, training for United States Army Signal Activity Okinawa Defense Satellite Communication System (USASAODSCS) users will take place at one of the locations listed above or one of the conference rooms in building 92 or 103 at the Camp Foster Annex (Fort Buckner).
1.3.2. Training materials for the formal classroom training will be submitted electronically 30 days prior to training. The materials will be tailored to the installed Lenel and Axis systems. The Government will provide logistical support as required to include the training venue and document printing support.
1.3.3. The Contractor will have each student complete a short survey at the end of each training session. The survey will allow the students to rate the value of the training session, the content, the instructor, and the materials and offer any recommendations or comments.
1.4. Approval Parts.
1.4.1. If parts are needed, the Contractor shall provide a list of parts required and a cost estimate to the Government for approval. During non-duty hours the Contractor may wait until the next duty day to provide the cost estimate.
1.4.2. The Contractor shall submit written reports to the COR within seven (7) working days of any required repairs. The COR will inform the CO at 18th Contracting Squadron. Repair estimated costs shall not exceed 50% of the brand-new component value. The Contractor shall furnish parts specified by the manufacturer or an alternative brand name product of equal quality.
1.4.3. All repairs shall have prior COR or CO approval. If the Contractor proceeds with work without prior approval from the CO, it shall be at no cost to the Government. The approval authority of CO and COR for repairs are as follows:
1.4.3.1. Approval of total line item cost estimate lower than micro purchase threshold in accordance with fiscal year yen rate. The Contractor shall provide, in writing, a cost proposal to include a description of suggested repairs, parts required, labor costs, and method of repair to the COR. All parts shall include shipping cost. No overhead, general and administrative and profit shall be included for reimbursable items. Upon approval of cost estimate by the COR, the Contractor shall perform the repair and make it fully operational. The COR shall notify to the CO at 18th Contracting Squadron of the approved cost estimate.

2. GOVERNMENT FURNISHED PROPERTY AND SERVICES.
2.1. Government Furnished Property. N/A.
3. GENERAL INFORMATION.
3.1. Quality Control.
The Contractor is required to control the quality of service delivery and offer to the Government for acceptance only services which conform to contract requirements. The overall control of quality must meet the specified performance thresholds for each requirement in the Services Summary.
3.1.1. The Government shall rely on the Contractor's existing quality assurance systems as a substitute for Government inspection and testing, when contracting for commercial services, unless market research indicates otherwise.
3.1.2. Quality Control Plan. For non-commercial services, or if market research indicates it's a customary commercial practice, the Contractor shall provide a complete Quality Control Plan (QCP) to ensure the requirements of the contract are provided as specified. The Contractor shall provide a QCP describing the inspection system for the requested services listed in the PWS. The Contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of unacceptable services. The Contractor shall submit to the CO for review no later than 01 October 2022. The Contractor shall update the plan as changes occur and changes shall be submitted for review by the CO.
3.1.3. The Contractor’s QCP shall contain, as a minimum, the following items:
3.1.3.1. A description of the inspection system to cover all services. The description shall include specifics as to the areas to be inspected on a scheduled and unscheduled basis, frequency of inspections, and the title and organizational placement of the inspector(s).
3.1.3.2. A description of the methods to be used for identifying and preventing defects in the quality of service performed.
3.1.3.3. A description of how the records will be kept. Records must document all inspections and corrective or preventive actions taken.
3.1.3.4. Records of inspections shall be kept and made available to the Government throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.
3.2. Quality Assurance.
The Government will periodically evaluate the Contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the Contractor’s performance through intermittent on-site inspections of the Contractor's quality control program and receipt of complaints from base personnel. The Government may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the Government may decrease the number of quality control inspections if merited by performance.
The Government will also investigate complaints received from various customers located on the installation. The Contractor shall be responsible for initially validating customer complaints.
However, the Government representative shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).
3.2.1. The COR is the authorized Government representative who will perform assessments of the Contractor’s performance. Subsequent to contract award, the identity of the COR, with a letter defining their duties and authority will be promptly furnished to the successful bidder/offeror.
3.2.2. The COR will inform the contract manager in person when discrepancies occur and will request corrective action. The COR will make a notation of the discrepancy on their surveillance checklist with the date and time the discrepancy was noted and will request the contract manager (or authorized representative) to initial the entry on the checklist.
3.2.3. Any matter concerning a change to the scope, prices, terms or conditions of this contract shall be referred to the Contracting Officer (CO).
3.2.4. The services to be performed by the Contractor during the period of this contract shall at all times and places be subject to review by the CO or authorized representative.
3.3. Physical Security Requirements.
3.3.1. Torii Station is a United States Army installation and requires access approval through the Army Provost Marshall’s Office (PMO). The Camp Foster Annex is a United States Marine Corps (USMC) installation and requires access approval through the USMC PMO.
3.3.2. The Contractor will comply with any coronavirus disease of 2019 (COVID-19) related access requirements and restrictions.
3.3.3. Base passes and vehicle stickers. The Contractor is responsible to obtain such clearances and/or passes as required for his/her employees to enter the U.S. military installations prior to start to work. The Contractor shall be responsible for all passes issued to his/her employees under this contract. Applications shall be coordinated through the Contracting Officer or COR.
At the time of application, security forces may conduct a background check on employees. Upon termination of employment, the Contractor shall be responsible for returning identification cards and base passes within 24 hours.
3.3.4. Interference with Government Operations. The Contractor shall establish work procedures and methods to avoid interference with existing operations within or adjacent to the ITMR work.
Free passage into adjoining or adjacent buildings/areas not in the Contract will not be permitted, except as approved by the COR. Procedures and methods shall also provide for safe conduct of work and protection of property, which is to remain undisturbed.
3.3.5. Key Control (when applicable). The Contractor shall establish and implement methods of ensuring that all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. The Contractor shall not duplicate any keys issued by the Government. The Contractor shall coordinate with the COR to obtain keys for work areas that are fenced-in. The Contractor shall return the keys to the COR before close of business every day. Failure to do this may result in refusal of key use by the Government.
3.3.5.1. The Contractor shall immediately report the loss of a duplicate key to the COR.
3.3.5.2. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon written direction of the Contracting Officer, re-key or replace the affected lock or locks;
however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
3.3.5.3. The Contractor shall prohibit the use of keys issued by the Government by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor’s employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the CO.
3.3.5.4. Lock Combinations. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.
3.3.6. Secured Areas/Buildings. If the Contractor requires access to perform work in secured areas or buildings, the Contractor will be escorted by an appropriate Government official. The Contractor shall provide the COR with an access list to the security personnel solely valid for these secured areas or buildings prior to start this contract. The COR will ensure the access list is delivered to the 78th Signal Battalion S2.
3.4. Hours of Operation.
3.4.1. Normal Hours of Operation for ITMR (except on call services). The Contractor shall perform the services required under this contract during the following hours: 0700 through 1600, Monday through Friday, except U.S Holidays. With prior approval of the CO, the Contractor may work extended hours to ensure timely completion of work at no additional cost to the Government.
3.4.2. Hours of Operation for on call services. The Contractor shall perform the services required under this contract during the following hours: 24 hours daily, Monday through Sunday, including U.S Holidays.
3.4.3. Duty hours of operation are from 0700 to 1600, Monday through Friday, excluding Saturday, Sunday, and US Holidays.
3.4.4. Non-duty hours of operation are from 1600 to 0700, Monday through Friday, including Saturday, Sunday, and US Holidays. With prior approval of the CO, the Contractor may work extended hours to ensure timely completion of work at no additional cost to the Government.
3.4.5. Operations During Typhoon Conditions. When Tropical Cyclone Condition Readiness (TCCOR) 2 is declared, all work will cease immediately. The Contractor will clean up and dispose of all loose debris and waste as directed by COR to secure the job site against damage that may result from anticipated weather conditions. Contractor responsibility shall remain the same during tropical cyclone declaration TCCOR 1 Caution. Upon the declaration of TCCOR 1 Caution, the Contractor employees shall be excused from all duties. Upon declaration TCCOR 1 Recovery, the Contractor will immediately be available for duty.
3.4.6. Recognized Holidays. The Contractor is not required to provide service on the following days: New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Days, Thanksgiving Day and Christmas Day. If the holiday falls on Saturday, it is observed on Friday. If the holiday falls on a Sunday, it is observed on Monday.
3.5. Emergency Services. On occasion, services may be required to support an activation or exercise of contingency plans outside the normal duty hours described above.
3.6. Conservation of Utilities.
The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions which prevent the waste of utilities which include the following:
3.6.1. Lights shall be used only in areas where and when work is actually being performed.
3.6.2. Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the Contractor or by Contractor employees unless authorized.
3.6.3. Water faucets or valves shall be turned off after the required use has been accomplished.
3.6.4. Government telephones shall be used only for official Government business.
3.7. Records.
The Contractor shall be responsible for creating, maintaining, and disposing of only those Government required records that are specifically cited in this PWS. If requested by the Government, the Contractor shall provide the original record or a reproducible copy of any such record within five working days of receipt of the request.
3.8. Environmental Controls.
3.8.1. Compliance with Laws and Regulations. The Contractor shall be knowledgeable of and comply with all applicable Japan Environmental Governing Standards (JEGS can be found at http://www.usfj.mil/Portals/80/Documents/Other/2016%20JEGS.pdf), and requirements regarding environmental protection. In the event environmental laws/regulations change during the term of this contract, the Contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost as a result of the change, the Contractor shall inform the Contracting Officer pursuant to notice requirements and negotiate a modification to the contract.
3.8.2. Notification of Environmental Spills. If the Contractor spills or releases any substance contained in the JEGS into the environment, the Contractor or its agent shall immediately report the incident to the Army fire department at 911 and the COR. The liability for the spill or release of such substances rests solely with the Contractor and its agent. The Contractor is responsible for spill clean-up, remediation and disposal in accordance with appropriate laws and regulations.
A written report shall be submitted to the COR within 7 calendar days from the incident.
3.8.3. Material Storage and Use. The Contractor shall follow manufacturer’s guidelines and professional recommendations for control of humidity, temperature, cleanliness, and materials handling. This includes hazardous materials.
3.9. Government Observations.
Government personnel, other than the Co and the COR, may from time to time, with CO and COR coordination, observe Contractor operations. However, these personnel may not interfere with Contractor performance or make any changes to the contract.
3.10. Safety Requirements.
In performing work under this contract, the Contractor shall:
3.10.1. Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
3.10.2. Perform work in a safe manner as required by OSHA 2206, General Industry, Occupational Safety and Health Standards (29 CFR 1910) and Japan Environmental Governing Standards (JEGS) by US Force Japan.
3.10.3. The Contractor will not disturb building materials that are known or suspected to contain Asbestos. The Contractor shall be required under 29 CFR to provide Safety Data Sheet (SDS) and safety precautions to US Army officials when hazardous materials are brought to the workplace. The Contractor shall be required to protect the human health of Army personnel from all chemical, physical agent, and physical hazards caused by ITMR activities. Accident Prevention Plan/Activity Hazard Analysis (APP/AHA) per EM 385-1-1 should include fire/explosion prevention.
3.10.4. Develop and provide at the start of the orientation period or the start of the first operational performance period (if there is no orientation period) a safety plan for the protection of Government facilities and property and to provide a safe work environment for Contractor personnel.
3.10.5. Provide protection to Government property to prevent damage during the period of time the property is under the control or in possession of the Contractor.
3.10.6. Include a clause in all subcontracts to require sub-Contractors to comply with the safety provisions of this contract as applicable.
3.10.7. Record and report promptly (within one hour) to the CO and the COR all available facts relating to each instance of damage to Government property or injury to either Contractor or Government personnel.
3.10.8. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the contracting officer.
3.10.9. If the Government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist Government personnel in the conduct of investigation until the investigation is completed.
3.10.10. Include a clause in each applicable subcontract requiring the sub-Contractor's cooperation and assistance in accident reporting and investigation.
3.10.11. Emergency Phone Numbers.

3.11. Required Training and Special Qualifications.
3.11.1. The Contractor is required to hold active Manufacturer Partnership Certifications with both Lenel and Axis which allows access to the manufacturer’s Enterprise Service Desk and Trouble-Ticketing System.
3.11.2. The Contractor shall provide a copy of these certifications to the Contracting Officer and
COR.
3.11.3. Contractor support technicians will be required to hold the following manufacturer certificates:
3.11.3.1. Lenel Certified Associate (LCA) in support of OnGuard ACS System.
3.11.3.2. Lenel Certified Professional (LCP) in support of OnGuard Digital Video
3.11.3.3. Axis Certified in support of CCTV System.
3.12. Continuation of Essential DOD Contractor Services During Crisis.
This service is determined to be non-essential for performance during crisis according to DODI 3020.41, Operational Contract Support, paragraph 2.c. In the event of crisis, the Contractor will be notified by the CO of the need to discontinue services due to contingency, base closure or other causes. If notification to discontinue services is not received, the Contractor will be expected to continue performance in accordance with this PWS.
3.15. Phase Out.
3.15.1 If there is a change in Contractor or if the operation reverts to in-house, the incumbent Contractor will provide familiarization, to the Government or the follow-on Contractor, whichever the case may be. During the phase-out familiarization period, the incumbent will be fully responsible for the operation of ESS maintenance.
3.15.2 The Government reserves the right to conduct site visits in all Contractor operated facilities in conjunction with the solicitation of offers for the follow-on contract. In the event the follow-on contract is awarded to other than the incumbent, the incumbent Contractor will cooperate to the extent required to permit an orderly change over to the successful Contractor.
With regard to the successor Contractor’s access to incumbent employees, a recruitment notice may be placed in each facility.
3.16. Publications.
Compliance with all publications, regulations and operating instructions provided by the Government is required when:
3.16.1. They pertain to the procedures for materials expediting herein and where the Contractor is authorized by the performance work statement to accomplish the work specified in the publication, regulation or operating instructions.
3.16.2. The publications prescribe US Army policies, use of materials, procedures and processes applicable to the work requirements.
3.16.3. The Contractor is required to acquire and work on the latest version of any publications.
3.17. Contractor Personnel.
3.17.1. Contract Manager: the Contractor shall provide a contract manager and alternate contract manager (responsible in the absence of the contract manager) who shall be responsible for the performance of the services. The names of the contract manager and alternate(s) shall be provided to the CO in writing prior to the beginning of the first performance period. The contract manager and alternate(s) must be able to read, write, speak, and understand English.
3.17.1.1. The contract manager and alternate shall have full authority to act for the Contractor on all contract matters relating to daily operations of this contract.
4.17.3.2. The contract manager or alternate shall be available on work sites during the normal hours of operation for the CO, COR, and other Government personnel designated by the CO for any matters and issues concerning the contract.
3.17.2. Contractor Employees: the Contractor shall not employ persons for work on this contract if such employee is identified to the Contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population.
3.17.2.1. Contractor personnel shall present a neat appearance and be easily recognized as Contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges, which contain the company name and employee name in English.
3.17.2.2. The Contractor shall not employ any person who is an employee of the U.S.
Government if employing that person would create a conflict of interest. Additionally, the Contractor shall not employ any person who is an employee of the Department of the Army, either military or civilian, unless such person seeks and receives approval according to DOD 5500-7-R Joint Ethics Regulation.
3.17.2.3. The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours or deployment.
Military Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the Contractor’s ability to perform;
however, their absence at any time shall not constitute an excuse for nonperformance under this contract.
3.18. Japanese Road Laws.
3.18.1. The Contractor shall comply with Japanese Road Laws while on US Military installations to specifically include: Article 43, “The Road Law” (Japan) (prohibited acts relative to roads).
No person shall commit the following described acts:
3.18.1.1. Damaging the road, causing roads to be littered with debris, polluting the roads with debris or fallout from motor vehicles or otherwise defacing roads unreasonably or without due cause.
3.18.1.2. Article 43-2 (Measures to be taken to prevent cargo or things loaded on motor vehicles from falling out).
3.18.1.3. The agency managing a road may when there is reasonable cause for him to feel that items or cargo being carried in or on a motor vehicle may fall out and damage, pollute, or otherwise deface the road in such manner as to hinder or obstruct the traffic, order the operator of the vehicle in question to take steps or measures necessary to prevent occurrence of such hindrance by stopping operation of the vehicle, or correcting the method of loading or traveling or operation of the vehicle.
3.19. Insurance Requirements.
3.19.1 The Contractor shall procure and maintain during the entire period of his performance under this contract the following minimum insurance on each vehicle used by the Contractor at the work site.
3.19.2. Type: Automobile Property Damage Insurance, amount: ¥3,000,000 or dollar equivalent.
Bodily Injury Insurance, amount: ¥30,000,000 or dollar equivalent.
3.19.3. All vehicles must be properly inspected/insured in accordance with Japanese Compulsory Insurance (JCI) requirements.
3.19.4. Prior to the commencement of work hereunder, the Contractor shall furnish to the CO a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the U.S. Government in such insurance shall not be effective for such period as may be prescribed by the laws of the state in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the CO.
3.20. Contractor Incurred Expenses.
All expenses incurred by the Contractor while executing this contract to include, but not limited to: travel expenses, lodging, dining, and other miscellaneous expenses will be the sole responsibility of the Contractor. Any and all compensation for these expenses will be considered as included in the pricing quote.
