PERFORMANCE WORK STATEMENT (PWS)
NAGPRA INVENTORY COMPLIANCE
4/20/2023
1.0 INTRODUCTION:
1.1 The Bureau of Reclamation (Reclamation) is a federal agency under the U.S. Department of the Interior that is required to comply with federal laws, such as the Native American Graves Protection and Repatriation Act (NAGPRA) and its implementing regulations at 43 CFR part 10. The purpose of this Contract is to identify and inventory Native American ancestral skeletal human remains and funerary objects, and then draft supporting Federal Register Notices of Inventory Completion.
2.0 SCOPE: This Contract is for identifying and inventorying Reclamation-controlled archaeological materials subject to NAGPRA implementing regulations at 43 CFR part 10, subpart C from multiple counties within four states (Arizona, Montana, Utah, and Wyoming) at five different museum repositories. It is anticipated there are 39 sets of ancestral skeletal human remains and 154 funerary objects, although the final counts may adjust as the inventory is being completed. Once inventories are completed, vendor will write draft Federal Register Notices of Inventory Completion.
3.0 PERSONNEL QUALIFICATIONS: Vendor will have expert knowledge of NAGPRA 43 CFR part 10, subpart C compliance, skeletal identification of Native American ancestral human remains, archaeological funerary objects, museum documentation and record-keeping, and in writing draft Federal Register Notices of Inventory Completion.
4.0 GOVERNMENT-FURNISHED EQUIPMENT (GFE) AND MATERIALS:

6.0 TRAVEL: The Contractor shall use the appropriate government rates as posted on www.gsa.gov.
Vendor shall work on-site at the following non-Bureau museum repositories where the materials are currently located:
Arizona: Museum of Northern Arizona, Flagstaff, AZ Montana: Billings Curation Center, Bureau of Land Management, Billings, MT Utah: Natural History Museum of Utah, University of Utah, Salt Lake City, UT Utah: Weber State University, Ogden, UT Wyoming: University of Wyoming Archaeological Repository, Laramie, WY
Vendor shall work cooperatively with the non-Bureau museum repositories or and shall report directly to Reclamation’s National Curator and NAGPRA Coordinator.
7.0 GOVERNMENT VEHICLES: Contract employees required to utilize any Government vehicle (cars, trucks, heavy equipment, etc.) either as a driver or passenger shall be required to sign a “Hold Harmless” release. This includes Government-procured rental vehicles. The Contractor shall use or rent their own vehicles whenever possible and practical. Signed releases are due to the CO 1 day before use of a Government vehicle. See attached form. Government vehicles are for official use only.
8.0 SECURITY: Discuss any security issues/requirements that might apply. Add to or delete any of the following depending on your requirements.
8.1 The Contractor shall be required to supply Reclamation with the legal names and other personal information of employees who will be working under this contract.
9.0 TRAINING: The Contractor is responsible for all training for its employees except when training can only be provided by Reclamation. Requests for training by exception must be provided to and approved by the CO prior to the Government conducting training. The Contractor shall sign a Hold Harmless Release for any training provided by the Government. See attached.
10.0 DELIVERABLES: Describe (individual paragraphs, if necessary) the end products you want. Each deliverable will be listed in a table later in this PWS. The table below provides a listing of deliverables, the media with the number of copies, and the recipients.
10.1 Deliverable #1 (Inventories): Inventories will be provided for the Native American ancestral skeletal human remains and funerary objects for each location as listed under 6.0 Travel, with up to three separate inventory documents per location. Inventories will be in compliance with 43 CFR 10.9.
10.2 Deliverable #2 (Draft Notices): Write draft Federal Register Notices of Inventory Completion for the inventoried Native American ancestral skeletal human remains and funerary objects, with up to three separate draft notice documents per location and separated out with one draft notice per claimant Tribe.
Inventories will be in compliance with 43 CFR 10.9.

11.0 QUALITY:
11.1 Contractor’s Performance Assessment Reporting System (CPARS). The attached Contractor Performance Report is provided for your information. This report will be completed by the Contracting Officer’s Technical Representative (COTR) at the end of the performance period. This information will be input into the Contractor’s Performance Assessment Reporting System (CPARS) when the system becomes available.
11.2 Performance-Based Contracting. Quality shall be measured based on the following:

12.0 Identification of Contractor Employees: All contract personnel are required to identify themselves as contractors. Whether attending meetings, answering Government telephones, or working in other situations where their contractor status is not obvious to third parties, they must make their status known to avoid creating an impression that they are Government employees.
