DESCRIPTION OF SERVICES / GENERAL INFORMATION
1. General: This is a non-personnel services contract to provide Auxiliary Catholic Priest services to the 10th Air Base Wing Community Chapel. The Government shall not exercise any supervision or control over the contract service providers performing the services herein.
Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The contractor shall provide all supervision, personnel, equipment, facilities, materials, supplies, tools, transportation, vehicles and other items and non-personal services necessary to perform Auxiliary Catholic Priest services as defined in this PWS except for those items specified as government furnished property (GFP) and services. The contractor shall perform to the standards in this contract.
1.2 Background. The Contractor shall provide all Catholic Priest duties as scheduled by the Active Duty Catholic Chaplain in his absence in accordance with (IAW) the below requirements.
1.3 Contractor Identification. Contractor employees shall identify themselves as being a Contractor when attending meetings, answering Government telephones, responding to emails and working in other situations where their Contractor status is not obvious to third parties (e.g., clients, vendors, customers, public contacts, etc.) to avoid creating an impression that they are Government officials.
1.3.1 Use the duty title of Priest while performing services, to include but not limited to printed documents and electronic communications. Contractor shall not use the title or be addressed as ‘Chaplain.’
1.4 Dress Code. Contractor personnel shall be professional in appearance and suitable for the occasion and environment. In support of some work requirements, the contractor may be required to dress business professional (i.e. funerals, formal USAFA events). These work requirements which require business professional dress may be at the request of the Contracting Officer (CO) or the designated Contracting Officer Representative (COR).
1.4.1 Dress according to business casual standards or appropriate religious garments.
1.5 Threats to General Well Being. The Government reserves the right to direct the removal of Contractor personnel for misconduct or security reasons. This action does not relieve the Contractor from total performance of the program tasks specified herein.
1.6 Hiring of U.S. Government Employees. The Contractor shall not employ any person who is an employee of the US Government if employing that person would create a conflict of interest, or the appearance of a conflict of interest. The Contractor shall comply with the Joint Ethics Regulation (JER) in regard to the employment of current and/or former Government employees. The Contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives proper approval. The Contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies in AFI 64-106 Air Force Industrial Labor Relations Activities paragraph 3. The Contractor is prohibited from employing off-duty Government COR(s) who are managing any contracts or subcontracts awarded to the Contractor. The abrupt absence of any Contractor personnel does not at any time constitute an excuse for nonperformance under this contract.
1.7 Key Control/Access Badge Control/Door Codes. The contractor shall establish and implement methods of making sure all keys/badges issued to the contractor by the government are not lost or misplaced and are not used by unauthorized persons. The contractor shall not duplicate any keys issued by the government.
1.7.1 Lost Keys. The contractor shall immediately report to the COR any occurrences of lost or duplicated keys.
1.7.2 Prohibited Use. The contractor shall prohibit the use of keys, issued by the government, by any persons other than the contractor. The contractor shall not provide access to other contractors for government facilities without COR approval.
1.8 Core Hours of Operation. The Contractor shall perform all PWS requirements during scheduled Catholic events as scheduled by the Catholic Chaplain or dictated by Chapel Schedule as overseen by the Wing Chaplain or Designee.
1.9 Federal Holidays. The following Federal Holidays are observed by USAFA but may not always be observed by the Contractor due to mission needs.
New Year’s Day, January 1st or the Friday preceding or Monday following Martin Luther King’s Birthday, 3rd Monday in January President’s Day, 3rd Monday in February Memorial Day, Last Monday in May Juneteenth, June 19th or the Friday preceding or Monday following Independence Day, July 4th or the Friday preceding or Monday following Labor Day, 1st Monday in September Columbus Day, 2nd Monday in October Veteran’s Day, November 11th or the Friday preceding or Monday following Thanksgiving Day, 4th Thursday in November Christmas Day, 25th December
2. GENERAL DUTIES:
2.1. PERFORMANCE OF SERVICES DURING CRISIS. In accordance with the clauses contained in the contract, it is determined that services identified in the PWS are essential for performance under this contract.
2.1.1. Continuation of essential DoD contractor services during crises is required IAW Department of Defense Instruction (DoDI) 1100.22, Policy and Procedures for determining Workforce Mix. A crisis is described in Federal Regulations as “a dynamic situation, with the body of knowledge growing hour-by-hour from the latest situational reports. As such, it does not lend itself to a precise definition. The Contractors duties during a crisis are solely in line with what they are able to professionally provide regarding Catholic Sacraments, counseling, and pastoral needs.
2.2. DECLARATION BY INSTALLATION COMMANDERS REGARDING MISSION
ESSENTIAL REPORTING. Each Installation Commander follows their own protocol related to inclement weather reporting and other conditions that might result in decisions for reduced staffing or closure of the installation. Announcements related to these decisions are broadcast through various media to convey work expectations of military and civilian personnel employed by DoD based on their designation by DoD as falling into the category of "mission essential" or "non-mission essential" personnel. Contractor employees are governed by the employment agreements with their employers and are not impacted by how the DoD manages its military and civilian workforce. Contractors are required to meet the performance expectations in the contract regarding hours of operation and service support. It is the contractor’s responsibility to determine how to manage the workforce and meet contract expectations including dealing with inclement weather conditions.
1.1. 2.2.1 Adverse Weather Conditions. The Contractor shall coordinate with the COR concerning performance of PWS requirements during adverse weather conditions.
Delayed reporting or early release (for Government employees) does not relieve the Contractor of PWS performance. Adverse weather conditions or national emergencies may require the cancellation of services and installation closure, for which the government would not pay the contractor for scheduled services.
2.2.2 Continuation of Essential Contractor Services is included in a contract which the government formally identifies all or a portion of the contractor services as “mission essential functions.” This is significantly different than the above reference to “mission essential personnel” for inclement weather reporting:
The “mission essential functions” designation relates to continuation of services in events of crisis as they affect DoD’s ability to provide vital services or exercise authority, direction and control. In accordance with the Continuation of Essential Contractor Services clauses in the contract, the contractor is required to maintain a Mission-Essential Contractor Services Plan. This plan shall detail provisions for the acquisition of essential personnel and resources to maintain continuity of operations for up to 30 days in a crisis. Although functions may be identified by the government as "mission essential" for inclement weather reporting, the government does not render a designation of "non-mission essential" for all other contracted functions and the contractor is expected to meet the operating hours and performance requirements and develop appropriate contingency plans to meet the terms of the contract.
2.3 Work Environment. Missions are frequently interrupted by base exercises or actual ongoing base security events. Payment for additional hours or overtime is not authorized unless approved in writing by the Contracting Officer prior to the exercises.
2.4 Incident/Mishap Reporting. In the event of a safety incident/mishap, the Contractor shall take reasonable and prudent action to establish control of the scene, prevent further damage to persons or property and preserve evidence until released by the investigative authority.
Immediately report the incident to the CO and the USAFA Safety Office. If the Government elects to conduct an investigation, the Contractor shall cooperate fully and assist Government personnel until completed.
2.4.1 Emergency. Police, Medical and Fire can be reached by calling 911. Caller will reach El Paso County dispatcher and identify that they are located on USAF Academy.
2.4.2 Fire Prevention and Protection. Base fire prevention personnel will make periodic Government provided facility inspections for regulation compliance.
2.5 Custodial Services. The Government will provide custodial services for occupied Government-provided facilities at the same level provided to Government employees. All other services shall be the responsibility of the Contractor.
2.6 Refuse Collection. The Government will make available refuse collection and disposal services for the Contractor at Government expense in direct support of the PWS. Emptying of individual trash receptacles into Government-provided dumpsters is the responsibility of Contractor employees. Dumpsters are available for Contractor use for the disposal of items. The Contractor shall follow guidelines established by the base regarding proper disposal of refuse. The Contractor shall not dump prohibited items in dumpsters. The Contractor shall comply with all base-recycling programs and hazardous waste disposal processes/procedures. (Verify procedures with 10 CES.)
2.7 Background Investigation(s).
2.7.1. IAW DODI 1402.05 Background Checks on Individuals in DOD Child Care Services Programs E3.2.c., each individual working with children under the age of 18 in conjunction with this contract shall successfully complete a Tier 1 background check. The results of a Federal Bureau of Investigation (FBI) advanced fingerprint check must be obtained prior to a person’s employment under Line of Site Supervision (LOSS). Additionally, IAW DODI 1402.5, Background Checks on Individuals in DOD Child Care Services Programs, E4.f., all individuals working under LOSS must wear conspicuous identification such as distinctive clothing, badges, wristbands, etc. that clearly identify the allowed scope of involvement with children. Additionally, posters or other printed information must be readily visible informing Children’s guardians of what the conspicuous identification means. Contractor shall satisfactorily complete, maintain, and present compliance of the criminal history background check requirements listed above. The background check process must be initiated by the contractor and the chapel staff no later than thirty days after the award of the contract. In addition, child protection policies of the Catholic Church within the priest’s local diocese are prerequisites.
2.7.2 In accordance with DoDI 5200.46, “DoD Investigative and Adjudicative Guidance for Issuing the Common Access Card (CAC)”, all contractors who require access to any DoD/USAFA Information Systems will undergo a Tier 1 (T1) background investigation. The contractor must complete Optional Form (OF) 306, “Declaration of Federal Employment,” electronic fingerprints and Electronic Questionnaires for Investigations Processing (eQIP) before system access is granted. Contractors who require enhanced privileges (IT-II), will undergo an Information Technology Tier 3 (IT-T3) background investigation before system access is granted in order to meet the intent of DoDI, 8500.2 “Information Assurance (IA) Implementation.” IT-II/T3 background investigations require completion of OF 306, electronic fingerprints and eQIP submission. IT-II/T3 backgrounds must be adjudicated to “Favorable” for continued enhanced privilege access; however the contractor will not be granted access to classified information or classified information systems.
2.8 Information Resources. The Government will provide access to Government staff and pertinent information for this contract. The Government will provide the Contractor copies of, or access to, all required directives, publications and documents. All documentation provided to the Contractor shall remain the property of the Government and shall be returned upon completion of this contract.
2.8.1 Contractor Software and Hardware. The Contractor shall obtain approval from the Designated Approval Authority (DAA) prior to purchasing software and computer hardware for use on the USAFA network. The contractor shall maintain all licenses for contractor software connected to the USAFA network IAW with Software Policies or as detailed in DAFMAN 17-1203 Information Technology Asset Management (ITAM) and Accountability, Chapter 3. When software use is no longer required, the contractor shall remove the software at their own expense from both Government and contractor computer systems connected to the USAFA network.
2.8.2 Government Provided Site Licensed Software. The Contractor shall install and upgrade software that the Government has acquired site licenses for. The Government will keep current and pay any annual licensing fees for site-licensed software. When Government provided software is no longer maintained under site license use the Contractor shall remove the Government provided software from all computer systems under its control at their own expense.
2.8.3 Data Rights, Copyrights, Patent Rights, and Royalties. Consider these applications are discussed for both the Government and contractor. Associated clauses FAR Part 27 and DFARS 227 form the legal determination of rights of parties and the PWS may refer to the clauses but is not appropriate location to convey rights and responsibilities.
2.8.4 Telephone Services. The Government will provide local and Defense Switched Network (DSN) telephone service. The Government will provide all maintenance service on Government-provided phone lines and instruments and will relocate subject service when the relocation is approved by the Government. Government provided telephone service shall be used for official calls necessary in the performance of the PWS. The
COR may grant the Contractor access to Government long distance service. Otherwise, the Contractor shall provide his or her own non-Government telephone service through off-base switching equipment for personal or unofficial business.
2.8.5 Controlled Unclassified Information: If the Contractor determines that unauthorized personnel have accessed CUI, the contract manager shall immediately notify the COR and fully cooperate with any investigation. Contractor shall comply with DoD Manual 5400.07 Freedom of Information Act (FOIA) Program, 4.1., and DODI 5200.48 Controlled Unclassified Information. These instructions and manuals establish policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding CUI material.
2.9 Government Furnished Facilities. Contractor shall utilize Government furnished facilities in the performance of this requirement.
2.9.1 Maintaining Clean Work Areas. The Contractor shall ensure that all work areas assigned under the PWS are neat, clean and maintained at all times and immediately report any facility and safety discrepancies to the Government.
3. SPECIFIC DUTIES:
3.1 The Contractor shall:
3.1.1 Liturgical Activities:
3.1.1.1 Provide daily, weekend and holy day masses and assist with Parish Penance Services as requested by the Active Duty Catholic Chaplain.
3.1.1.2 Celebrate Sacrament of Reconciliation (Confessions), 1 hour prior to the Saturday evening services on the weekends the contractor is presiding;
Catholics in the military will have access to a weekly scheduled celebration of the Sacrament of Penance. The scheduled times must be separated from Mass start time by at least 15 minutes as shown in the Service Summary.
3.1.1.3 Provide Special Services as needed to include (but not limited to): Lent, Advent, First Communion, Confirmations, Baptisms, Weddings, and Funerals, seasonal devotions (rosaries and stations of the cross, holy days of obligation, Christmas and Holy Week activities, and shall work with other contractors (e.g. musicians, music director, religious education coordinator, youth minister, Parish administrator/Catholic Coordinator) as well as Chapel staff to ensure quality and appropriate liturgies.
3.1.1.3.1 Funerals. Contractor shall coordinate with USAFA Funeral Director and Honor Guard to accommodate the unique context of Military Honors before/after mass and graveside service. Contractor shall coordinate in advance with the Active Duty Catholic Chaplain regarding training and expectations.
3.1.1.4 Assist at the Community Chapel as requested on holy days to include (but not limited to): The Solemnity of Mary, Assumption of Mary, All Saints Day, the Feast of the Immaculate Conception, the Nativity of Our Lord, Jesus, and Communal Penance Service. Length of weekend or Holy Day mass is a minimum of 1 hour. Length of daily mass is a minimum of 30 minutes.
3.1.1.5 Conduct mass in Latin Rite as required by The Archdiocese for the Military Services (AMS) and the Active Duty Catholic Chaplain.
3.1.2 Time Management. Be at the respective places of worship and prepared for each service no later than fifteen (15) minutes prior to the designated starting time of any service, and no later than fifteen (15) minutes prior to the designated starting time of any Special Service. Priest should also plan to be available to congregational members at a minimal of 15-20 minutes following services.
3.1.3 Substitutions/Subcontracts. The contractor shall provide a qualified substitute in the case of non-availability for previously scheduled and agreed upon services one week prior to the event. The substitute shall be of equal capability to the contractor.
Contractor is responsible to compensate the substitute. The contractor shall also give the chapel staff a one week notice for any extended period of absence. The Wing Chaplain or designee is the final approval authority for a substitute. Contractor shall provide substitute with all information required to perform required services.
3.1.4 Admin & Planning. The Contractor shall attend a quarterly huddle with the Catholic team, (other contractors), and Catholic Chaplain to plan for the upcoming liturgical calendar. Meet with the Chaplain/Catholic Priest or the Deputy Wing Chaplain on a quarterly basis to review and obtain the schedule of services for that quarter and submit mandatory quarterly reports to the Archdiocese for the Military Services (AMS). Services will not be scheduled or cancelled without first consulting the Catholic Chaplain or communicating with the Deputy Wing Chaplain.
3.1.4.1 Context Specific Training. Contractor personnel shall accomplish initial and annual Government provided Computer Based Training as required to include but not limited to: Privileged Communication Training, DOD Cybersecurity Awareness, Information Protection, Anti- terrorism, OPSEC, COMSEC, FPCON, Records Management, and other training as identified and provided by the Government.
3.1.4.2 Contractor will consult Chapel Staff to determine what training is required based upon system access or operational posture.
3.1.5 Ecclesiastical Qualifications. Possess and maintain all standard qualifications as dictated by Catholic standards to include ordination certificate and Safe Environment Training and Certification from a Catholic Diocese and shall produce a letter from home diocese giving permission to pursue endorsement with Archdiocese of Military Services.
3.1.5.1 The contractor shall apply for endorsement to the Archdiocese for Military Services, USA within 15 days after contract award.
Endorsement shall be acquired within ninety (90) days of award and maintained throughout the duration of the contract.
3.1.5.2 Comply with intent and protocols in the US Bishop's Catholic conference charter on Child Protection.
3.1.6 Air Force Context: Behave in due regard to public conventions and morals, and shall not commit any act that could reasonably be expected to degrade the position or the Air Force Chaplaincy.
3.1.6.1 Comply with Military Rule of Evidence 503. Under this rule, "a person has a privilege to refuse to disclose and to prevent another from disclosing a confidential communication by the person to a clergyman or to a clergyman's assistant, if such communication is made either as a formal act of religion or as a matter of conscience." Any breach of confidentiality is grounds for termination of this contract; Maintain confidentiality and be familiar with the Air Force Instruction on Religious Accommodation (DAFI 52-102).
3.1.6.2 Contractor shall sign a Non-Disclosure Agreement annually.
3.1.6.3 The contractor shall coordinate efforts with chapel personnel and work in a multi-denominational and pluralistic religious environment to include, but not limited to, Catholic, Protestant, Jewish, Orthodox, and Islamic faiths. Contractor shall not denigrate other faith traditions or religious beliefs.
3.1.6.4 The contractor shall be required to provide all services in accordance with (IAW) Catholic and Archdiocese for the Military Services (AMS) faith requirements.
3.1.7 The Contractor shall be able to read, write, speak and understand English fluently.
English shall be the only language used with regard to this contract for written correspondence, discussions and other business transactions.
3.1.8 The contractor shall not receive any stipend given on any occasion for sacramental ministry or other services provided in accordance with (IAW) this performance work statement (PWS).
