About this file
This document is a Brand Name Justification (BNJ) for a one-time purchase of Ansys software licenses by the General Services Administration (GSA) Federal Acquisition Service (FAS) on behalf of the US Navy Warfare Center (NUWC) division at Keyport, WA. The BNJ outlines the requirement for specific Ansys software part numbers, including LS-DYNA, to ensure compatibility with the NUWC Keyport's current systems and workforce training. The total estimated cost and delivery dates are provided for each part number. The Contracting Officer has determined that limiting the consideration to only Ansys, the original equipment manufacturer, is necessary and represents the best value to the government. The related federal contract opportunity, solicitation number 47QSSC24Q2306, seeks quotes for the Ansys software licenses as a brand name only requirement under FAR 6.302-1(c). Vendors must provide a quote utilizing the provided Excel template, a letter of supply, and any applicable teaming agreements.

Required Delivery Date: Various, Description of Supplies and Services for period of performance for each P/N.
3. Description of Supplies and Services
In accordance with agency objectives, the government has a need to procure new Ansys Licenses to meet the agency’s needs as outlined in this document.
The following identifies the complete requirement:
Part Numbers:

Dates: 09/30/2024 – 09/29/2025. QTY 1
Docusign Envelope ID: 474176C9-CD99-4E6C-B54F-D7C5F6642E4E
2. P/N: LIC0009949, Ansys LS-DYNA HPC-32 - TECS. New Licenses.

Dates: 09/30/2024 – 02/27/2025. QTY 2
4. Identification of Justification Rationale
The circumstances and rationale for limiting consideration to select contractors for award follows:
In accordance with FAR, “Agency requirements shall not be written to require a particular brand, name, product...peculiar to one manufacturer, thereby precluding consideration of a product manufactured by another company.” An exception to this rule is allowed only if there is a written justification...essential to the Government’s requirement.
Additionally, this limited source justification will document that this requirement is essential to the Government’s requirements and the market research which indicated that no other brand is qualified to meet the Navy’s requirements.
5. Demonstration of the Unique Nature of the Required Supply
On August 28, 2024, the requiring agency submitted a Brand Name Justification Memorandum in accordance with FAR 6.302-1, to limit sources for the purchase of the above referenced Ansys Part Numbers.
The basis for limiting source for this acquisition is the software must be compatible in all aspects with existing systems presently installed. Ansys and its derivative products, fit the customers current compatibility requirements as they are the main computational domain modeling and simulation tools used at NUWC Keyport and support multidisciplinary integration of current and future simulations. In addition, the modeling and simulation sectors of the workforce are trained in using Ansys software. Moreover, Ansys is the main modeling and simulation tool used by our academic partners at WSU Bremerton, of whom NUWC Keyport sponsors the Senior Design program. Using Ansys products at NUWC Keyport ensures ongoing collaborative compatibility with WSU Bremerton.
Therefore, for this acquisition, the contracting activity is restricting the consideration of MAS contractors under SIN’s 511210 and 54151 to include the only source that can provide Ansys Part Numbers (P/N’s listed above).
6. Determination that the Order Represents the Best Value
The overall goal of the Acquisition Center is to provide the Government a fast and efficient way for Federal Agencies to requisition for commodities at discounted prices with prompt, cost effective delivery and customer service. The Contracting Officer will compare the pricing to competitive pricing, to determine the best value to the government and determine that the anticipated cost represents the best value to the government. Award of any products other than the above-mentioned brand name products would not be in the best interest of the Government.
Notice of this Brand Name only action will be posted on SAM.gov.
7. Description of the Market Research Conducted
In accordance with FAR 6.302-1(c), The Customer has provided detailed market research that has been conducted to justify this RFQ as Brand Name only. Market research was conducted in August 2024. This research consisted of reviews of similar previous procurements and a market survey through Federal Supply Schedule contractors. In addition, further market research was utilized by using internet search engines (google, bing, yahoo, etc.) Amazon.com, and through GSA Advantage using the part numbers, description, and manufacturer. The aforementioned product, Ansys licenses, is compatible with the current systems and ensures Keyport is in compliance with IA directives causing no impact to operations and customers.
8. Statement of Actions to Overcome Barriers to Competition
Prior to any subsequent procurement the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.
9. Contracting Officer Certification and Approval
I certify that the justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge and belief. Based on the above, I hereby determine that it is in the best interest of the Government and most appropriate for this acquisition to be Brand Name.
