About this file
This is an insurance requirements attachment for the Massachusetts Bay Transportation Authority (MBTA) related to RFP 49-26 for Grant Writing Services. The contractor is required to obtain all specified insurance before contract commencement and maintain it in full force and effect for the duration of the engagement, with certificates of insurance provided to the MBTA at inception and throughout the contract term.
The MBTA requires contractors to carry Commercial General Liability Insurance with minimum limits of $1,000,000 per occurrence and $1,000,000 annual aggregate on an occurrence basis, with a policy endorsement deleting exclusions for work within 50 feet of rail. Automobile Liability Insurance must provide $1,000,000 combined single limit coverage for all owned, leased, hired, and non-owned vehicles. Workers' Compensation Insurance must comply with Massachusetts General Laws Chapter 152, with Employer's Liability minimums of $1,000,000 each for accident and disease claims. Additionally, contractors must obtain Umbrella Liability Insurance with $5,000,000 per occurrence and annual aggregate limits, and Professional Liability or Errors and Omissions Insurance with $1,000,000 per claim and aggregate limits, including a five-year extended reporting period. All insurance must be placed with Massachusetts Division of Insurance-licensed carriers holding a Best's rating of A- or better, must be primary and non-contributory to MBTA coverage, must require 30 days advance written notice of cancellation, and must name the MBTA as an additional insured where applicable. Subcontractors are required to provide equivalent coverage for their operations.
