Dear Mr. Wick:

The Vertex Companies, LLC (VERTEX) of Columbia, Maryland, was retained by Eastern Ecological Science Center (“Client”) to perform a limited hazardous materials survey which included an inspection for Asbestos-Containing Material (ACM), Lead-Based Paint (LBP), Polychlorinated Biphyenyls (PCBs) containing equipment and mercury-containing equipment.

ACM Findings

Mr. Alejandro Daza, a State of Maryland licensed asbestos inspector performed the screening on September 29, 2022 and September 30, 2022. A total of one hundred two (102) bulk samples of suspect asbestos-containing materials were collected from the designated area. Laboratory analytical results identified regulated amounts of asbestos (>1%) in Black Mastic Tar, 9”x9” Brown Floor Tile, 9”x9” Green Floor Tile, and Black Roof Flashing/Sealant. Table I contains the results of the sampling, including location, material description, and analytical result of the bulk samples collected.

VERTEX's inspector performed both the visual inspection and bulk sampling at the referenced location in accordance with methods outlined in the U.S. Environmental Protection Agency (EPA) guidance document titled, "Guidance for Controlling Asbestos-Containing Materials in Buildings" (Document No. 560/5- 85/024). The findings of this report are based upon observations of accessible materials and the number of representative bulk samples that were collected and analyzed.

Bulk samples of suspect materials were analyzed by AMA Analytical Services, Inc. of Lanham, Maryland (AMA) using the approved polarized light microscopy with dispersion staining (PLM/DS) method. Only the asbestos content, if any, is recorded in the bulk sample ‘Report of Analysis’.

If a material contains greater than 1% asbestos, it is considered to be asbestos-containing material. Upon client request, or at the recommendation of the analyst, the Point Counting Method, or Transmission Electron Microscopy, Non-Organically Bound (TEM-NOB) Analysis Method may be used to verify the presence/absence of asbestos when a sample contains less than 10% asbestos by visual estimate and/or is a non-friable organically bound building material. Please reference Appendices A, B and C for the laboratory analytical results, samples locations and photographic log

AMA is an accredited laboratory by the EPA for "Interim Asbestos Bulk Sample Analysis Quality Assurance Program". AMA is also accredited by the National Voluntary Laboratory Accreditation Program (NVLAP).

The PLM/DS analytical method is modeled after 40 CFR Part 763, Subpart F, Appendix A: "Interim Method for the Determination of Asbestos in Bulk Insulation Samples".

Conclusions and Recommendations

VERTEX recommends the removal of identified asbestos-containing materials should future renovation activities disturb or impact the identified ACM in any way. A contractor holding a current State of Maryland Asbestos Abatement license should perform the abatement of all identified asbestos-containing materials in accordance with all applicable federal, state, and local regulations and standards.

All identified ACBMs that remain in place should be maintained under an asbestos Operation and Maintenance (O&M) Program in accordance with current Occupational Safety and Health Administration (OSHA) standards (29 CFR 1926.1001).

It is recommended that suspect materials not identified within this report and uncovered during any future renovation/demolition activities be assumed to be asbestos-containing, unless future bulk sampling determines otherwise.

Lead-Based Paint Findings

VERTEX collected representative samples of suspect lead-containing paint from site. Paint bulk samples were also sent to AMA for analysis. AMA participates in the American Industrial Hygiene Association’s (AIHA) Environmental Lead Proficiency Analytical Testing (ELPAT) for Lead program. Samples were analyzed by Flame Atomic Absorption Spectroscopy EPA Method 7420. State of Maryland regulations define lead-based paint as paint by weight which contains greater than 0.5 % by weight of lead. OSHA regulations also apply to detectable amounts less than or equal to 0.5% of lead.

LBP Regulatory Implications and Regulations

The implications of lead-containing paint existing in a non-residential building are related to the future use of the facility and the need to impact these painted surfaces during the demolition process.

OSHA defines any detectable levels of lead as a potential lead exposure hazard to workers doing construction-type work on these surfaces and requires appropriate safety and health measures be followed as stated in 29 CFR 1926.62. OSHA states that until the employer performs an exposure assessment and documents that the employees are not exposed above the permissible exposure limit (PEL) of greater than 50 micrograms per cubic meter (µg/m3) of air, the employer must treat employees as if they were exposed above the PEL for the following operations:

• Manual demolition of structures, manual scraping, manual sanding, and use of heat gun where lead-containing coatings or paints are present;

• Abrasive blasting, enclosure movement and removal;

• Power tool cleaning;

• Lead burning;

• Using lead-containing mortar or spray painting with lead-containing paint;

• Abrasive blasting, rivet busting, or welding, cutting, or burning on any structure where lead-containing coatings or paint are present;

• Cleanup activities where dry expendable abrasives are used; and

• Any other task the employer believes may cause exposure in excess of the PEL.

Work precautions include providing respiratory protection, protective work clothing and equipment, changing areas, hand washing facilities, biological monitoring, and training until an exposure assessment has determined that the work activity will result in an exposure below the PEL. Additional requirements under this standard include a written compliance program as well as record-keeping.

Waste disposal is governed by the Federal Resource Conservation and Recovery Act (RCRA) regulations that distinguish between solid wastes and hazardous wastes. Solid wastes include general construction debris and are subject to minimum handling, transportation, and landfill disposal requirements under RCRA regulations. Hazardous wastes, including certain lead-containing materials, are subject to restrictions designed to prevent the hazardous materials from entering the environment. Lead-containing waste is classified as hazardous or non-hazardous based on the results of the Toxic Characteristic Leachate Procedure (TCLP) testing. The TCLP test measures whether or not lead leaches from the waste in excess of the regulated level of 5.0 milligrams per liter (mg/L). If the results of the TCLP analysis exceed this level, the waste must be handled, transported and disposed as a hazardous waste in an approved waste site, reclamation facility or incinerator site.

Recommendations

It is recommended that any contractor performing work that will disturb lead-containing paint comply with OSHA Standard 29 CFR 1926.62 “Lead in Construction Standard”, as well as all applicable federal, state, and local requirements pertaining to the disturbance of lead-containing paint.

PCB-Containing Materials

The PCB-containing materials screening objective was to evaluate for the presence of suspect PCB-containing light ballasts that would require special management during planned renovation or demolition activities.

Building renovations may involve the removal and disposal of lamps and/or ballasts. The proper method for disposing spent ballasts is dependent on the type and condition of the ballast’s and the state(s) in which the ballast’s are removed and discarded.

Fluorescent light ballast’s manufactured prior to 1979 may contain small quantities of PCBs. Recently manufactured fluorescent light ballasts are required to have “No PCB” labels. Light ballasts that do not have “No PCB” labels should be treated as PCB-containing and handled and disposed of accordingly.

As part of the site investigation, VERTEX performed a limited site reconnaissance of representative light ballasts throughout the designated area to determine the presence/absence of PCBs within the ballasts.

Representative light ballasts that were inspected had “No PCBs” labels.

It is recommended that during removal and/or upgrade of any lighting ballasts, ballasts which are being removed should be inspected for the presence/absence of PCB labeling. Any unlabeled light ballasts identified are assumed to be PCB-containing. It is recommended that the unlabeled lighting ballasts be disposed of by an appropriately licensed contractor in accordance with a written project specification addressing Federal and State of Maryland hazardous waste disposal guidelines.

Mercury

Mercury-containing equipment (i.e., fluorescent and high-intensity discharge (HID) lamps, HVAC systems switches, thermometers, gas stoves, electrical contact switches, sensors, space heaters, gas-fired refrigerators, gas-fired water heaters, etc.) contain a small amount of mercury that can potentially be harmful to the environment and to human health. Mercury is regulated under the Resource Conservation

Recovery Act (RCRA), which is administered by the United States Environmental Protection Agency

(USEPA).

As part of the field work, VERTEX performed a limited inspection for mercury-containing equipment in the building. VERTEX identified the following mercury-containing equipment: two (2) thermostats and approximately 330 fluorescent light tubes. . These items should be disposed of by an appropriately licensed contractor in accordance with a written project specification addressing Federal and State of Maryland hazardous waste disposal guidelines.

Respectfully submitted, The Vertex Companies, Inc.

Comments

The following footnotes only apply to those samples which the total asbestos result is flagged with a note number.

TEM RECOMMENDATION - Please note, due to resolution limitations with optical microscopy and/or interference from matrix components of this sample, results which are reported via PLM as negative or trace (<1%) for asbestos may contain a significant quantity of asbestos. It is recommended that the additional analytical technique of TEM be used to check for asbestos fibers below the resolution limits of optical microscopy.

MATRIX REDUCTION RECOMMENDATION - Please note, due to interference from the matrix components of this sample, results which are reported via PLM as negative or trace (<1%) for asbestos may contain a significant quantity of asbestos which is obscured from view. It is recommended that the additional preparation technique of gravimetric reduction be performed on this sample to minimize the obscuring effects of matrix components, followed by reanalysis by PLM and/or TEM.

Analysis Method - EPA/600/R-93/116 dated July 1993 NAD = "No Asbestos Detected" TR = "Trace equals less than 1% of this component"

Uncertainty: For samples containing asbestos in range of 1-10% the CV is 0.43, 11-35% CV=0.55, >35 CV=0.23. All results are to be considered preliminary and subject to change unless signed by the Technical Director or Deputy.
