1. PROJECT
Pine Ridge School is located on the Pine Ridge Indian Reservation, Oglala Lakota Nation, in the southwest corner of South Dakota. It provides accredited educational services for approximately 1,000 Oglala Lakota children in grades kindergarten through twelve. The school influence is felt throughout the state and nation, but more directly in the village and surrounding area, serving the towns of Batesland, Porcupine, Manderson, Oglala, and Kyle.
The school provides Native American youth the opportunity for a quality education and the school’s vision includes providing a safe and healthy environment disciplined by adherence to Native American cultural values and practices.
2. GENERAL
The Bureau of Indian Education (BIE) is seeking Design-Build Services for campus fencing, concrete walkways, and concrete leveling around the Elementary Gymnasium requiring demo/removal, minor repairs, and construction.
3. PURPOSE
Provide all Architectural & Engineering phase requirements for Design-Build and Performance Specifications; plus, Contractor to furnish all labor, equipment, and materials to provide construction services.
4. DEFINITIONS

5. SCOPE OF WORK
TASKS & REQUIREMENTS:
The Contractor shall furnish all supervision, materials, equipment, and personnel necessary to manage and accomplish the work. The Contractor shall provide sufficient technical support and project management to assure quality, accuracy of estimates, accommodate several concurrent active projects, and provide flexibility of staff. Additionally, the Government will rely on the Contractor's expertise in recognizing and addressing problematic issues and successful execution.
It is the Government's expectation that work executed against this order shall exhibit superior quality, responsiveness, and customer service. The Contractor's work responsibility shall include all planning, administration, coordination, and management necessary to provide all work as specified.
The work shall be conducted by the Contractor in strict accordance with the contract and all applicable Tribal, Federal, State, and local laws, regulations, codes, or directives as applicable. The Contractor shall ensure that all work provided meets or exceeds critical reliability rates or tolerances specified or included in applicable documents.
6. TASK DESCRIPTIONS:
Task-I: To furnish and install galvanized chain link fencing complete with all posts, concrete, braces, gates and other appurtenances to complete a six-foot chain-link fence around construction zones: 1) Bus Garage, 2) Main Campus, and 3) Football Field. as detailed on Drawing 1, High School Perimeter Fence Construction.
Task – II: Removal and installation of new concrete steps and stoops at Trace Davis Gymnasium as detailed in Drawing 2.
Task- III: Lift and Level Uneven Exterior Concrete for Elementary Gymnasium as detailed in Drawing 2.
1. Task I -Contractor Duties and Responsibilities for Fence installation and Repair
A. Install new galvanized chain link fence, posts, braces, and gates at North side of Dormitory to
West side of Log Cabin.
B. Complete and comprehensive shop drawings and submittals of fencing, materials, and components.
C. Install galvanized chain link walk-thru gates at designated locations to allow employee access to school buildings.
D. Inspect existing galvanized chain link fences at Campus perimeter and Bus Garage perimeter and repair any damage as required for a sound, professional, final product.
E. Material shall meet the requirements of ASTM 392, 2” mesh and 9-gauge galvanized with

IE114 - Pine Ridge School class 2 Zinc coated steel wire.
F. Provide and install galvanized posts with welded top caps, with the galvanized finish touched up with zinc paint after welding.
G. The steel and fence framework shall meet or exceed the requirements of ASTM F 1043 Group
1A.
H. Fence fittings shall meet or exceed the requirements of ASTM F626 and be galvanized steel with 9-gauge wire ties and clips.
I. Gates, gateposts and accessories shall meet or exceed the requirements of ASTM F 900.
J. Line posts shall be placed at intervals of 8’ measured from center to center of adjacent posts and made parallel with ground surface.
K. Posts shall be set in concrete and fencing fabric shall be stretched and cured per manufacturer settings. Excavation of new line post with concrete footings 10” diameter footings with 3,000 psi concrete; depth, and diameter of concrete foundations to be determined and documented in the submittal and shop drawings for approval prior to proceeding with procurement and installation on site - minimum 36” in depth.
L. All fence and gates & installation to be compliant with the BIA School Facilities Design Handbook along with any other applicable general construction section(s).
M. Fence Demolition shall be in accordance with Drawing 1, Sheet 01.
N. Shall dispose of damaged galvanized fencing per federal, state and local regulations.
1) The government will keep old gates.
2. Task II – Removal and installation of new concrète steps and stoop at Trace Davis Gymnasium
Contractors are highly recommended to visit the site and perform a thorough site inspection.
The contractor shall inspect the site to become familiar with the existing conditions relating to the work to be performed and the difficulties and restrictions to the work to be performed. The contractor shall notify the CO/COR of any conditions that prevent the suitable completion of these requirements. All work shall be performed in accordance with the specifications.
The removal and replacement concrete includes, but is not limited to the following:
A. The contractor is responsible for assuring all underground utilities are properly marked and located.
B. Concrete to be removed shall be saw cut a minimum of three inches through the joint of the adjacent slab.
C. Demolition shall be done in a manner to avoid damage to the slabs that are to remain in place. Demolition shall be as follows and depicted on Drawing 2:
a. The contractor shall Demo, remove, and replacement of the concrete pad on South of Elementary Trace Davis Tin Gymnasium Building 333.
b. The contractor shall Demo, remove, and replacement of stoop and stairs on
Northside of Elementary Trace Davis Tin Gymnasium Building 333.

c. The contractor shall Demo, remove, and replacement of stoop and stairs on Westside of Elementary Trace Davis Tin Gymnasium Building 333.
D. The contractor shall take care to avoid damage and spalling of adjacent slabs.
E. Damage to existing slabs caused by contractor demolition shall be repaired and/or replaced at no additional cost to the government.
F. Contractor shall avoid damage to existing structures, vegetation, private and government owned property.
G. Contractor shall employ measures to protect existing concrete pads and structures from staining or damage caused by machinery (tire marks from spinning), Concrete stains from over-pour and screeding, staining from sawcut residue, etc.
H. The contractor is responsible for pedestrian and traffic control throughout all phases of the project. Coordination is required through COR for all closures.
I. All removed (demolition) concrete shall be removed from the government premises on the day that it is excavated.
J. The contractor shall not store demolition spoil on site.
K. Contractor shall assure acceptable subgrade.
L. The contractor shall remove any sub- standard existing subgrade up to 2 inches.
M. Subgrade shall be compacted to 95% at optimum moisture content for site specific existing subbase.
N. Prior to concrete placement contractor shall schedule subbase inspection with the COR.
O. Compaction testing is not required if subbase inspection is scheduled with COR.
P. COR retains the right to reject the subgrade based on perceived moisture and compaction deficiencies.
Q. Contractor, at their cost, may employee a third-party geo technical service to provide moisture and compaction results to dispute COR’s assessment.
R. Contractor shall use locally sourced ½ inch recycled concrete(as available) where needed to replace over-excavated or unsuitable sub- grade.
S. Base shall be prepped to provide for a 4” concrete sidewalk.
T. Contractor should assume up to 10% of subgrade will need repair.
U. Grading, leveling, and elevation fill are not considered part of the 10% , but usual to existing concrete slab replacement.
V. Concrete Placement/Finishing
a. Contractor shall perform all work in compliance with attached specification 03310.
b. Replace all removed concrete with an approved concrete mix design that incorporates the following:
i. No less than 4,000 PSI @ 28 days
ii. Mix design should employee a minimum 5% Air entrainment
iii. Approved plasticizers may be used .
iv. Contractor will not be allowed to “re temper” concrete by adding water onsite.
v. PCC temperature during placement shall be 70 +/- 20 degrees F.
vi. Contractor shall use welded wire mesh.
W. Saw cut Joints.

a. Joints shall be saw cut at the earliest practical point to avoid raveling and not to exceed 24 hours.
b. Joints shall be ¼ inch wide by a depth no less than ¼ of the installed pad depth.
c. Early entry (soft cut) saws may be used.
X. Cure Concrete
a. The contractor shall use a clear, dry, membrane forming curing compound.
Y. Seal Concrete
a. Contractor shall apply a topical sealer.
b. Topical sealer Chemicals Aquapel Plus, or an approved equivalent.
c. Contractor shall apply a joint sealer to all joints.
d. The joint sealer shall be MasterSeal NP 1 or an approved equivalent.
3. Task III – Lift & Level Uneven Exterior Concrete at School Elementary
Gymnasium Contractor Tasks and Responsibilities for Fence installation and Repair:
A. The contractor shall Install PolyLEVEL , or an approved equivalent as indicated in Drawing
2.
B. The contractor shall use a Gray joint sealer for concrete cracks as noted in Drawing 2.
C. The contractor shall lift the foundation and or floors to close the gap from concrete to building, cosmetic damage that may result shall be repaired by contractor.
D. The contractor shall fill voids and lift and level sidewalks on the North and South of the
Elementary Gym, E. The contractor shall use gray caulk to seal the sidewalks that are against the building, as detailed on Drawing 2.
F. The contractor shall replace/ repair any concrete that may have cracked during the PolyLevel lift process.
G. Work area prep to be performed by school personnel prior to installing PolyLevel is as follows:
a. Move items at least 6 feet from the work areas.
b. Provide electrical service for contractor’s tools required for project.
7. DESIGN REVIEW MEETINGS
Minimally, the Design shall include the COR, and school representatives input to influence design.
• Ensure site accessibility for individuals with special needs.
• Consider how the space can be designed to address multiple components that meet the various needs of the student population and community, simultaneously. A review meeting to resolve design issues will be held for each design review package submitted. The meeting will include discussion of BIE comments on functional relationships and technical peer review comments (by others).
1. Participants will include BIE Staff and Design-Build Team A/E members as appropriate for the specific package to be reviewed and others. The Design- Build Team A/E members will each allow for (1) full day for each package design review meeting.

2. The DB team shall allow a minimum of fourteen (14) calendar days for each review cycle. A cycle includes:
a. The BIE’s receipt of the design review submission package.
b. The review meeting.
c. DB team’s receipt of comments from the BIE, either electronically, by fax, or by hard copy delivery.
3. Coordination of the review meeting schedules will be the responsibility of the BIE Project Manager/COR (for the BIE) and the Design-Build Team A/E Project Manager (for the Design-Build Team A/E). See Quality Assurance/Quality Control.
8. SITE PREPARATION – DEBRIS DISPOSAL
The Contractor shall:
• Prepare the site for installation of all construction and new equipment.
• Plan for the mobilization cost of materials, equipment, office trailer, storage bins, and other construction items that need transporting to project site before starting up.
• Plan for equipment storage and security throughout the project. The school shall not be held liable for any lost, stolen, or damaged items.
9. CONTRACTOR’S PERFORMANCE PERIOD
The Contractor shall complete the on-site construction work within 60 calendar days and coordinate closely with the COR regarding the schedule. The review of submittals is not included in the contractor’s performance time. The total contract period of performance will be 180 calendar days after issuance of the Notice to Proceed.
10. WARRANTY
The Contractor should address each of the following:
• Applicable warranty and/or guarantees of equipment and installations including any conditions and response time for repair and/or replacement of any components during the warranty period of 1 (one)year from the date of completion.
11. DRAWINGS/SUBMITTALS
Two (2) sets of 100% drawings shall be distributed to the Contract Specialist, COR and School Facility Manager.
12. CLOSE OUT REQUIREMENTS
As requisite for final payment, the Contractor shall provide to the school, and it’s COR the following:
• Specified quantities of extra/spare materials used.

• Manufacturer Warranties for each building which identifies each building number and location for entire new work/installation against defective materials workmanship, etc. Include a one (1) (one) year Workmanship Warranty.
• Demolition debris haulage tickets, manifests, landfill tickets/receipts.
• As-built record drawings, systems, demonstration of maintenance and upkeep.
• Documentation shall include all certified payroll reports and Release of Claims.
13. PRICING
The Contractor shall submit a cost proposal fully supported by data adequate to establish the reasonableness of the proposed costs, including components, replacement parts, accessories, surfacing materials; and all other related products and services offered by the Contractor, for the life of the contract.
All manufacturer price lists shall be identified in the proposal response. Proposals shall include an itemized list of any Products and Services that the Contractor intends to include in the Master Agreement and assume responsibility for as prime contractor but are offered by the individual authorized distributors and not included in the Contractor’s catalog.
The list shall identify the distributors’ name and location that offers each product and service included.
The Contractor shall be the prime contractor and remain solely responsible for contractual performance, and reporting, for any Products and Services offered by the authorized distributor.
14. OBTAIN ALL MATERIALS AND PERMITS
The Contractor shall ensure that all materials necessary to perform work are ordered promptly upon Notice to Proceed (NTP). To avoid delays, all parts and equipment shall be on hand or readily accessible prior to the commencement of work.
The Contractor shall procure all permits required for the work.
15. SAFETY
The Contractor, installers or subcontractors performing services under this Contract are required and shall comply with all Occupational Safety and Health Administration (OSHA), State and County Safety and Occupational Health Standards and any other applicable rules and regulations. The Contractor and subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the worksite area under this contract.
16. GENERAL REQUIREMENTS
A. Safety: The contractor shall adhere to all BIA/BIE adopted codes and the contractor shall abide by all OSHA regulations while on school grounds and shall review all applicable safety regulations

IE114 - Pine Ridge School before beginning the project. The contractor shall provide signs, barriers, and or caution tape as a safety precaution around the work site. The contractor shall have a fall protection plan if workers are to be performing duties above six (6) feet from the ground or finished floor. The contractor shall bear sole responsibility for taking all appropriate actions necessary to prevent accidents and injuries to individuals and damage to property in and around the work area.
B. Access: BIE Facility Management personnel shall provide access to Pine Ridge School at all times.
The contractor shall sign-in and out with the Facility Manager. The contractor shall minimize disruption of classroom instructions and normal school activities expected in such areas.
C. Cleaning: The Contractor shall always keep the work area reasonably clean. Contractor shall accomplish a complete cleanup at the end of the project. The Contractor shall properly dispose of all debris at an approved dumping site.
D. All shipments of materials, equipment and/or supplies to the project site shall be addressed to the Contractor and not the Government. Preservation and packing shall be in accordance with standard practices for commercial packaging.
E. Government personnel are not authorized to accept deliveries for the contractor, nor are they responsible for off-loading shipments. The contractor shall be present to accept all deliveries.
F. The Contractor shall be providing a comprehensive warranty that covers a period of one year from substantial completion. This warranty shall cover all parts, labor, shipping, and expenses, such that no additional cost is incurred by the government for warranty work.
G. The Contractor shall develop, submit for government’s approval and maintain a Quality Control Plan (QCP) to ensure services are performed in accordance with the contract and this SOW. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor’s QCP is how they ensure that all work complies with the requirements of the contract.
H. The Design-Build shall be prepared and submitted with complete construction documents for review and approval by the Government.
I. No work shall be fabricated or delivered until the receipt of approved shop drawings from the
COR.
J. The contractor shall take all necessary field measurements and investigations to assure that the materials and assemblies will meet contract requirements, and all materials that require regular maintenance shall be identified.
17. EROSION CONTROL
Prevent erosion of soil from any lands used or occupied in the execution of the work under the Contract.
18. CONTRACT ADMINISTRATION
a) The Contractor shall not perform work that is outside the SOW (statement of work) unless directed in writing by the CO. Any work done by the Contractor outside the SOW without authorization from the CO will be at the Contractor's own risk.

b) The CO will provide a Notice to Proceed (NTP) to begin the performance of work after the contract has been awarded.
c) The COR shall coordinate the schedule for each phase, approve technical submittals, inspect work, monitor progress, accept completed work, review invoices, review change orders, and issue/receive Government Furnished Items. The COR has the authority to direct the Contractor to stop the performance of work if unsafe work conditions are observed.
d) The laws regulating wages and hours of workers employed under this contract are subject to the
Davis-Bacon Act.
19. CODES, SPECIFICATIONS, AND STANDARDS
The A/E Contractor shall provide a multi-disciplined Architectural-Engineering team to provide professional design services; each responsible team member shall be knowledgeable of and meet compliance with the most current editions of the following codes, standards, and guidelines.
